Asking about the person doing the testing. What they have to know, the set of rules or instructions for how someone runs a test.

DSims is asking what would happen if a person didn't know how to run the test but ran the test.

Objection.

Dr. Logan's demeanor reads uneasy. He sounds tentative.

doctor logan doesn't look thrilled this morning

This will come out all sideways I think but..isnt this the dr that left washington state in with a cloud over him?

I cant remember which one it was but I think it might be him.

Wonder if the SA will bring it up.

I believe so. Basically fudged the results of hundreds of DUI tests. Had quality control and ethic issues with the state lab he ran.

what are the consequences of using a new test without knowing its limitations.

can you tell us what a false positive is?

  • #167
Or improper training of the person interpreting the results?

yes.

  • #168
well placed cough

  • #169
DCS - False positive can be caused by improper training of an individual correct?

Logan - Correct

IMHO: to attack Dr. Vass' techniques

With respect, I can't imagine what scientific test could carry more weight with a Jury than half a dozen people ( or more) who walked up to her car and said "OMG, what died?" :innocent:

DS: "Can you tell us what a false positive is?"

Clearly going to attack the results and say that gas chromatograph wasn't validated *for these compounds*.

Does it appear this witness is getting annoyed with the questioning?

  • #174
The technology is reliable, generally, but have to make sure all the other factors must be checked and validated. Witness says.

He is now listing off the other places the gas chromatigraph is used.

ita, I guess I wasn't clear... I don't see how this is going to put a ding in Dr. Vass' techniques imhoo...

  • #176
DS: what other tests is gas chromo used for
BL: drug, explosives . . . .

  • #177
doctor logan doesn't look thrilled this morning

That light they have shinning in his face is like a search light...Good Lord, he's going to be blind by the time he's done testifying!

  • #178
now asking what is the american academy of forensic science

  • #179
At least Ms Sims is actually sticking to Frye procedures?

  • #180
I believe all of these general knowledge questions are an attempt by the dt to give some credibility back to this witness and attempt to wash away what happened last week. Even though i dont think its working. jmo
