This seems so obvious, I almost hate to post it for fear of looking like an idiot....

but, has anyone thought to contact the members of Mr. Baker's family, to see if he ever mentioned Caylee, or did he not even know he was a father?
 
State withdrawing the impeachment of exculpatory hearsay via introduced felonies. Good move. IMO

HHJP Please read fl statute 90.806 paren 1! - he reads and cites Huggins v. State , Fischer v. State (2006), Gonzalez v. State (2007)
 
Why is that? Does anyone know? Seems to me she should be in general population.

She works aboard a cruise ship.

IMO...the State didn't want to take the chance of having a reversable error.

It sounds like this little case law lesson is a warning to defense......don't open a door you don't want used.
 


JA w/HHBP . . .see pg 79 of transcript.... re: putative father of Caylee....Mr. Baker....the State is not asserting that she is credible.....court ordered hearsay statements may be proffered....we have Huggins in our back pocket......

JA there were other issues dealing with the facts.....Jeff H. and etc...all discussion about JH thru 83..... JA is not waiving any argument to go back and find another statement......to see if these are actually true.....no one really knows if Mr. Baker is the Father....we suspect he is not but no one knows if he is deceased....not sure what is true.....

HHBP only thing I will say ...please read FL statuate....hearsay statement has been admitted in evidence ....declarant may be ....(attacked?)..... as far as their crediblity.....cited cases within Huggins.....written by Judge Postin now sits on FL Supreme court... be very careful when you get hearsay statements ...aftershock can have a devastating effect. Right...I heard that! That's why I posted my post (a few up) about why don't they just contact his family members to see if he ever mentioned Caylee.

90.806 Attacking and supporting credibility of declarant.

(1) When a hearsay statement has been admitted in evidence, credibility of the declarant may be attacked and, if attacked, may be supported by any evidence that would be admissible for those purposes if the declarant had testified as a witness. Evidence of a statement or conduct by the declarant at any time inconsistent with the declarant's hearsay statement is admissible, regardless of whether or not the declarant has been afforded an opportunity to deny or explain it.
(2) If the party against whom a hearsay statement has been admitted calls the declarant as a witness, the party is entitled to examine the declarant on the statement as if under cross-examination.
