Abby & Libby - The Delphi Murders - Richard Allen Arrested - #212

The passage of time evolved from the event and finally getting a suspect in custody is a big factor in why this may fall flat for the prosecution. And I can't help but keep coming back to the Dan Dulin episode.
I'll move away from speculating on whether or not he was qualified enough to be questioning a main suspect in the back of a car park and his poor line of questioning and lack of recording.
What I find really strange is that he'd spoken to Allen in the days after the murders. He filed his report and moved on. But the case never went away. And in Delphi in particular it was part of everyday life with images and videos of Bridge guy all over the place for days /weeks/ years. It's not something he could ever really move on from
Did he never think " The guy in the video looks and sounds like the fella I interviewed in the car park."? Prompting him to chase up his initial report?

Obviously proving Allen is Bridge guy may not prove BARD to the jury that he had his hand on the knife but if LE had got to him earlier it would've made a world of difference imho.

Apologies if I missed it, but did the police ask RA in interviews whether he had ever gone up to the trails and bridge with his gun? I know he said that he didn’t have it on the day in question and that he took his gun when he went foraging for mushrooms or hunting.

That seems key to me. If RA has never been up to the crime scene with his gun , then that is pretty conclusive assuming the science on the casing is accepted.

We didn’t hear anything direct, the implication was that he didn’t ever do that, but no direct question that we’ve heard about.

This was a major issue with their interviewing technique. Too much screaming and not enough talking.

The issue will always come down to the science, and the validity of that testing method (fired cartridges vs unfitted).

If they buy it then it’s game over.

He had changed details all along (what time he was there). He’d do the same, no doubt concerning his gun if he said he had it.

Tells me he has an amazing Defense Team who've done all they can to defend him despite the issues they faced in getting evidence admitted moo.
This amazing defense team??

They had facade evidence that they never got in...why? Because it is a facade, they failed...

Um....no...they didn't do all they could have to defend him. For starters they never called a friend, foe or relative to give a character reference about him let alone give him an alibi for that day.... What a failure they were.

Oh....yes....then we have the pretentiousness of slapping Weber with a sapena while on the stand. Same underhandedness they used with the hair in opening statements for shock and awe, knowing full well its was Kelsie's. What a let down.

I wouldn't call it amazing today when they rested leaving the P in shock, when they could have rested last night. But no no no they needed to catch the P off guard. Oh yes, that's how you give justice to Libby and Abby.

Or, maybe...it's not that they are amazing, maybe its just that they are reckless and irresponsible. They are known for it. Lest we forget the defense team leaving their crime scene photos unsecured and allowed access by a person without clearance.
Who then sold them to the media. Then killed himself...

Their serious failure will....overlap into a guilty verdict.

I cannot LOVE this post enough !!!

I agree with everything.

this D team is ultimate Failure.

Their Attempts, FAKE, FALSE, LIES, UNETHICAL,
UNPROFESSIONAL, .... well, need I go on ??

yeah, he did his report based on photos. And never performed his own tests. I imagine his testimony WAS much briefer than the state's witness on the subject.
I also recall the cross examination of the states gun expert taking the entire afternoon. The fact she was on the stand the entire day is not just on the state. the defense kept trying to talk her into circles.

EBM (bad clipping on my part the first time)

There’s also the matter of the confession(s), and whether you believe that RA did, in fact, admit to having the gun when he was at the trail that day, and did something with the gun that day that caused the bullet to fall out, placing RA at the scene. If you believe that, and that he told Wala about the white van scaring him, it also kind of ties this resolution together.

I thought the Haldol injections were only once a month?
The haloperidol decanoate is a once monthly long acting version of haloperidol.

Haloperidol lactate is a short-acting version that can be given orally, IV, or IM. It is commonly used for acute agitation or aggression.

It would not be uncommon for someone to be on a long acting agent but also need something for outbursts, etc while stabilizing.

Even if he answered that he did bring his gun with him typically, that round still had no business being there, especially between two dead bodies.

The odds of him leaving it prior is somewhere between astronomically unlikely and impossible. His answer means nothing to me either way.

I predict the closing agreements will be over by 1 and we have a verdict by 5.
I do hope that them being sequestered AND being allowed to discuss the case when all 12 were present might help this go quicker. If they had a chance to discuss each day's testimony then they might have already talked through some of the things they have heard. That could be helpful once they get the case.

And in RA's Affidavit, the gun was discussed, IIRC

Thank you. From my understanding he was giving a once a month ejection and wasn't taking the oral one regularly.

Not sure if this one has been posted yet:

The media was moved to the back of the courtroom after being accused of talking during proceedings. The courtroom was warned that talkers would be removed.

Richard Allen’s family is now seated where media was located in the front row of the courtroom, prompting Becky Patty, Libby German’s grandmother, to say “that’s bullsh--.”

Libby’s family remain seated in the second row.

That feels *dirty* of him imo. Changing his opinion on the stand from what he told them in the deposition is just plain dirty. Moo.
Does anyone else remember him originally saying something like it could be anything from a butter knife to a butcher knife? Sorry I can't come up with the link right now but that is clearly saying that he doesn't know what kind of knife it was. I don't find it nefarious to later say, yea it could have been a box cutter. The bad thing is that it could possibly lead to a new trial on appeal for ineffectiveness counsel … Because they were SO BAD
