Samsung phone taken from Erin Patterson's home

The prosecution presents a Samsung phone that was seized by police from Erin's home.
Data was then extracted by police.
The first pieces of evidence we see from the phone are Facebook messages.

I wonder how police were able to access the phone, assuming it had ether password or biometric access security. I assume Erin did not help them with this.

Secondly, how would they get past the data encryption, or could it have been an older phone without encryption?
Maybe photos were taken using the phone and then extracted from Facebook by police using another of the devices seized. So photos might be somehow marked with identifiers indicating the phone or device they were taken with or created on? Not sure?

honestly the questioning felt pretty weak to me. Like oooohhhh but you didn't look at EVERY mushroom in EVERY store EVERYWHERE so you don't reaaalllly know for sure!!!!!!!!!!!

I'm being facetious but you get my point. It's okay, they're just doing their job.

I think the prosecution is trying to confirm that there is 100% certainty that Erin wouldn't get the Death Caps mixed up with benign edible mushrooms. But I'd like to see how this plays out in court over the coming days.

So basically:
no mix up -> Erin was deliberately planning to at least murder someone for months.

However, it seems like the mushroom expert testified that it is possible to get edible vs poisonous mushrooms mixed up as shown in The Guardian article here: Distinguishing between edible and poisonous fungi is difficult, mushroom expert tells Erin Patterson trial

So now I am interested in how the prosecution would handle this and what the jury would think. Essentially now the prosecution's witnesses are basically contradicting each other. But I wonder how both the defense and prosecution would handle the web of evidence.
Did she 'accidentally' pick bad mushrooms?, there are problems for the defense trying to sell that theory.

--- That neither she, nor her kids or dog were accidentally poisoned, is problematic for the accidental theory.

----Even if she 'scraped' off the mushrooms, anything that was cooked alongside them would have absorbed the deadly toxins. So her kids would have been ill if they really ate leftovers from the same
meal.

----And she admitted eating 1/2 of her Wellington, just like Gail did. And poor Gail became very ill in the middle of the 1st night. And by Sunday afternoon, she became deathly ill and was declining rapidly.

She was so weak that she was not able to stand or walk very well, and she had vomited many dozens of times and had severe diarrhoea beginning on the first night.

So we saw that EP did not have the same physical response as the others had. Even though she told people she had all those symptoms there did not seem to be any evidence that it was anywhere near to severity of the others.


----Also, it seems odd that she was so resistant to just staying in the hospital for treatment and even more odd to me that she resisted bringing the kids in for examination. She saw how ill the others were and she still delayed her children's doctor visits?

----Which also brings up the totally bizarre situation with the children being served leftovers from the lunch for Sunday dinner.

EP ALREADY had told her children that she herself felt 'unwell' [and she also had probably had a message from Simon by then. If not, that is really surprising to me. ]

She admits to feeling ill and having the runs and a bad stomachache----but then goes ahead and serves the lunch leftovers to her 2 kids?

They never did get sick, neither did her beautiful Labrador. That also makes me wonder about the 'accidental' element of this tragedy. How did everyone but her 4 lunch guests avoid the Death Caps?

So the question asked above--->>>How does the prosecution handle the situation of Death Caps being hard to recognise?

I think the behaviour during and following the served lunch makes it unlikely this was an accidental situation, imo.

It's looking like she has schemed, planned, and perfected her revenge for 4 odd years for what, in her mind, Simon and these people 'did/upset' her.

A closer look at the bowel chart​

The court is shown Erin Patterson's "Bowel Chart" from July 31, 2023.

It refers to times Ms Patterson went to the toilet at 10:00am, 10:04am, 10:06am, 10:25am and 11:50am.

Three "medium" amounts of content were collected, and two "small" amounts were collected, the chart shows.

On all occasions, the "consistency" was described as "liquid".
Was it reported that the patient said stomach issues became a problem on the night of the lunch (Sat)? Then on the following day, there were no obvious stomach issues for the gas station stop and drive to the cancelled pilot lesson. Yet, on the Monday morning, after the patient returns to the hospital from an absence, the nurse is able to record five events on a “bowel chart” for her patient. Quite unusual.

If the defence admitted that EP foraged for mushrooms and lied about the purchase of the mushrooms, then prosecution and defence agree on this. What is the need of going through the list of all the stores that were visited and inspected for their mushrooms on sale.
I think they want the jury to clearly understand that she never purchased Asian mushrooms like she was telling Doctors and Social Workers and Public Health Officials. And more than that, they want them to comprehend the purpose of that lie.

And I think they want to illustrate what a waste of time and energy that lie created for health department, the doctors and the victim's families, etc.

So they want to show the enormity of that persistent lie. It was told to so many people, important people who were trying to save the victim's lives and prevent any future deaths if possible. And she continued to tell this intricate lie, including what the packaging looked like, how they smelled, etc.

And she actually acted out the helpful process of looking through her bank account purchases on her phone, feigning concern. But it was all a big lie being told, wasting time while her loved ones were dying.

It is reminiscent of Casey Anthony, walking the detectives, who were looking for her missing Caylee, into the huge headquarters of Universal Studios, boldly telling them she worked there, pretending she was taking them to her office, as she waved at people she passed by, until finally she had to admit she did not work there.

Patterson ‘emotional, crying’ after medics said kids would need hospital assessment​

Registered nurse Mairim Cespon, who oversaw Patterson’s care at Leongatha Hospital on 31 July, 2023, has taken the stand.

The court heard Cespon saw Patterson in her peripheral vision, while she was tending to Heather Wilkinson, when the mother-of-two first arrived at the hospital.

When Patterson later returned to the hospital, Cespon said she settled her into a cubicle and Dr Chris Webster came into chat to Patterson.

In the presence of Cespon, Dr Webster mentioned to Patterson that her children needed to be medically reviewed because they ate part of the meal.

“At that point, Erin became emotional, she was crying,” Cespon said.

“She was asking if it was really necessary for them to be assessed because they didn’t have symptoms. She said she didn’t want them to be panicked or stressed.”

Cespon said Dr Webster told Patterson:”You don’t want to wait for them to get worst”.

Patterson bowel chart shown to court​

The court has been shown a bowel chart written while Patterson was at Leongatha Hospital on 31 July, 2023.

The five entries on the chart included the following details:

10am - amount “M” - consistency “L”

10:04am - amount “M” - consistency “L”

10:06am - amount “S” - consistency “L”

10:25 - amount “M” - consistency “L”

11:50am - amount “S” - consistency “L”


The court heard that “M” meant medium, “S” small, and “L” liquid.

The court heard Cespon also made further notes about Patterson’s hospital stay, including an entry at 10:10am that Patterson “went to toilet x 3, still watery, white and yellow in colour but patient said it is a stool”.

The notes also indicated that Patterson has spoken to police to obtain the leftovers from her home and that she had given a pain score of “7/10”.

Cespon explained that the pain score is subjective and Patterson explained it was a “cramp-like pain and that when she opens her bowels it settles a bit, but everytime she feels like going to the toilet it goes back up.

Cespon said Patterson told her she had felt sick on the evening of 29 July, then had diarrhoea all day on Sunday 30 July.

“She was distressed and emotional including the thought of her kids (having to go to hospital),” Cespon said.

“She was saying she feels unwell, that she has this pain, that she has been having these loose bowel motions, (and) she was emotional about feeling unwell.”

The Asian mushroom investigation​

Troy Schonknecht, a public health officer for Monash City Council, has taken the stand.

The court has heard Schonecht was tasked with launching an investigation into mushrooms sold in Asian grocers in the Oakleigh area.

Schonecht said he was told by police they were interested in dried mushrooms in clear, plain packaging and the likely purchase date was in April, 2023.

The mushrooms of interest were described as “sliced” and like “shitake”. mushrooms.

He said he then used the council’s database to narrow down Asian grocers or similar in the area, before visiting each one in person.

The court was then shown a report compiled by Schonecht, which identified five businesses in Oakleigh, four in Clayton, and four in Mount Waverley that were selling dried mushrooms.

Public health officer’s report findings shown to court​

The court has been shown Troy Schonecht’s findings in relation to his Asian grocer mushroom investigation.

In the report’s concluding statement, the questions posed by the investigation and his answers were as follows:

1. Has there been any changes in supplier since April?

All premises visited and that were identified as selling fresh (initially) or dried mushrooms had not changed their supplier since April or in 2023.

I asked further if they had anyone attend the premises trying to (wholesale) sell them mushrooms for the intention of on-selling and they all responded that they had not had anyone trying to sell mushrooms.

2. Are there any products that do not have proper labels? If any that may be collected/dehydrated locally?

Only (one store) Golden Grocery was repackaging product and applying their own label. It was identified during the investigation the product was too large and were whole dried mushrooms as opposed to the sliced dried mushroom. Any non-compliances identified have been referred to the Area Officer to follow up with proprietor. No products were identified to be local or manufactured in Australia. All dried products were imported.

3. Are any suppliers’ local producers?

All dried mushroom products investigated were imported and importer/supplier details identified.

Asian grocer mushrooms pulled from shelves amid investigation​

The defence have commenced cross-examination of public health officer Troy Schonecht.

Schonecht was shown a series of mushrooms sold at Golden Grocery, which were in clear plain packaging.

The court previously heard Golden Grocery was the only store identified to be repackaging mushrooms, which the store attributed to the manufacturer sending large packages which were broken into smaller portion to meet customer demand.

The defence put it to Schonecht that the packaging identified at Golden Grocery matched the description initially provided by Patterson.

He confirmed that was correct.

Under questioning, he also confirmed the shitake mushrooms from Golden Grocery were removed from sale for a period of time because of they had similarities to the description they had received from Patterson.

Digital forensic expert returns to the stand​

Shamen Fox-Henry, who works as a digital forensic expert for VIC Police, has returned to the stand.

‘This family, I swear to f***ing god’: Patterson’s Facebook messages to friends revealed​

The court has been shown a series of messages extracted from Patterson’s mobile device.

The messages were in a Facebook group with women the court previously heard she initially connected to through a Keli Lane case interest group.

In the messages, which were sent on three days in December 2022, Patterson complained about her ex-husband and his family, describing him as an “deadbeat” and his parents as a “lost cause”.

(If their) daughter came to them laying all of the same complaints about her husband, that I did about Simon, they would never say we (don’t believe you).

The court has been shown a series of photos found on a Samsung tablet.

Patterson’s phone ‘wiped remotely’ after being given to police​

The court has heard Patterson gave a phone to Victoria Police on 5 August, 2023.

An digital forensic analysis was then performed on the device two days later.

The court was then shown the report obtained from the analysis, which indicated the phone had been subjected to four factory resets.

The details were as follows:

  1. 12/02/2023 16:53pm - wipe - factory reset - wiped locally by user
  2. 02/08/2023 11:09am - wipe - factory reset - wiped locally by user
  3. 05/08/2023 13:20pm - wipe - factory reset - wiped locally by user
  4. 06/08/2023 5:16am - wipe - factory reset - wiped remotely by user
The last entry cited the reason of remote wiping as ‘’find my device”.

Under questioning from the prosecution, Fox-Henry explained that there were multiple ways a phone can be wiped - including in the menu settings of a phone or remotely via an external application.

Prosecution: “What does that do if you do that (a factory reset)?”

Fox-Henry: “Recovery of user data is not viable and is destroyed.”

Prosecution: “Is that reversible or not?”

Fox-Henry: “It is irreversible.”

The court previously heard Patterson had two phones at the time of the lunch and only of the phones was ever recovered.

Nurse enters the witness box​

The jury has entered the courtroom.
Justice Christopher Beale told the jurors to come to court at 11.30am today, instead of 10.30am, because the parties would be dealing with an “issue” for the first hour of the day.

The court heard senior digital forensics officer Shamen Fox-Henry would return to the stand later.
“We’re going to interpose two witnesses,” Justice Beale said.
Nurse Mairim Cespon has now entered the witness box.
She told the court she worked at Leongatha Hospital in July 2023.

'We were concerned for her health': Nurse saw Erin after mushroom meal​

Ms Cespon told the court she was working on July 31, two days after the lunch.
She said she cared for Heather and Ian before they were transferred to Dandenong Hospital for more intensive treatment.

She confirmed she saw Erin when she first presented to the hospital about 8am, before Erin left five minutes later and did not return within 30 minutes like she said she would.
The jury has previously heard from Dr Chris Webster, who also worked at Leongatha Hospital.
“Dr Webster tried to call up a couple of times to check on her,” Ms Cespon said.
“But she did not answer any of those phone calls so Dr Webster was concerned for her wellbeing.
“Dr Webster called police … for a welfare check to make sure she was okay because we were concerned for her health.”
Ms Cespon confirmed Erin returned the hospitalat 9.48am of her own accord.

“Dr Webster mentioned that her kids needed to be medically reviewed because they had ingested part of the meal,” she said.

Ms Cespon said Erin asked if it was necessary for her children to be brought to hospital, since she said they did not eat the mushrooms in the meal and did not have any symptoms.
“She didn’t want them to be stressed or panicked,” she said.

“We needed to catch the bowel motion … and get a sample from it,” she said.
The court heard she used a pan, known as a witches hat, which was placed on the toilet seat.

How council launched its 'mushroom investigation'​

Troy Schonknecht, an environmental health officer from Monash City Council, has now entered the witness box.
He told the court he was involved in the investigation after Erin told officials she had used dried mushrooms from an Asian grocer in the beef wellington meal.
Mr Schonknecht said he was told they had been bought from an Asian grocer in either Oakleigh, Clayton or Mount Waverley.
He said he reviewed the database of business registrations to establish the Asian grocers in those suburbs.
The jury has now been shown a spreadsheet titled: ‘Mushroom Investigation: Monash City Council’.
The court heard the scope of the investigation was narrowed from all mushrooms, both fresh and dried, to shiitake or porcini mushrooms.
Mr Schonknecht said he was also told by an official the dried mushrooms had been bought at an Asian grocer on a strip, had a white label, were unbranded and weighed about 100g.

Crown prosecutor Jane Warren is now asking Mr Schonknecht about each Asian grocer he visited.
The court heard there were five in Oakleigh, five in Clayton and four in Mount Waverley.

He said he took more than 300 photos during the course of the investigation.

He will return to the stand at 2.15pm.

Mr Schonknecht is now being cross-examined by defence barrister Sophie Stafford.
She is asking him questions about the dried mushrooms he found at Golden Grocery in Oakleigh.
Photos shown to the jury taken by Mr Schonknecht at Golden Grocery show products labelled “black fungus” and dried “tea tree” mushrooms.
He told the court some of these mushrooms were removed from sale for a period of time.
The court heard Mr Schonknecht was not tasked with visiting any Asian grocers in Glen Waverley.
The jury has previously heard Erin told officials she may have bought the dried mushrooms from an Asian grocer in Glen Waverley.
But Mr Schonknecht said this information was not passed along to him.

We now know that Erin did indeed view the photos of the Death Cap mushrooms posted on-line, so if she didn't know previously (cough) she would have gleaned the knowledge of what the Death Caps looked like.

'This family I swear to f***ing god': Erin's messages shown to jury​

Senior digital forensics officer Shamen Fox-Henry has returned to the witness box to continue his evidence.
He is being asked by Crown prosecutor Jane Warren about a device seized from Erin’s house, particularly messages sent to a Facebook group chat by a user with the name ‘Erin ErinErin’.
In its opening address to the jury, the prosecution said the accused participated in Facebook groups under the account names of Erin Patterson, ‘Erin Erin’ and ‘Erin ErinErin’.
The court heard members of the group chat included Erin’s online friends Daniela Barkley and Jenny Hay, who gave evidence in the second week of the trial.
The first tranche of messages, sent on December 6, 2022, have been shown to the jury.
The messages read:

Simon’s dad contacted me this morning to say that he and Gail had tried to talk to Simon about the matters I raised and to get “his side” but he refused to talk about it other than to signal he disagreed with what I said. Beyond that he won’t talk about it. So Don said they can’t adjudicate if they don’t know both sides and Simon won’t give his side (emoji) so he said all he can ask is that Simon and I get together to pray for the children (emoji) (emoji) this family I swear to f—ing god.

I said to him about fifty times yesterday that I didn’t want them to adjudicate (emoji) nobody bloody listens to me. At least I know they’re a lost cause.

I wonder if they’ve got any capacity for self reflection at all? I mean clearly the fact that Simon refused to talk about personal issues in part stems from the behaviour of his parents and how they operate …”

I thought his parents would want him to do the right thing but it seems their concern about not wanting to feel uncomfortable and not wanting to get involved in their son’s personal matters are overriding that so 🤬🤬🤬🤬 em.”

Maybe it’s easier if he’s not involved in even paying their school fees, meaning I can choose their school all by myself and don’t have to refer to him, if he wants them to go to a private Christian school then he can help pay for it. If he doesn’t want to help pay for it then I don’t have to send them there, do I? So maybe it just means I have even more freedom and about choices, a blessing in disguise.”

His mum was horrified I had claimed child support. Why isn’t she horrified her son is such a deadbeat that I had no choice but to claim?”

Photos of dehydrator, mushrooms on scales found on tablet​

Mr Fox-Henry is now being asked questions about photos extracted from a Samsung tablet seized from Erin’s house.
The jury have been shown photos extracted from the device, including a photo of black dehydrator and several photos of mushrooms on a set of kitchen scales.
The photos had a last modified date of April 30, 2023, and May 4, 2023, respectively.
Four screenshots from an internet browser were also extracted, with three referring to ovarian cancer.
“Ovarian cancer rarely metastasises to the brain. If it does, it is more likely to occur with advanced stage carcinomas, more than one year after diagnosis and rarely presents as a single lesion. Early detection, treatment and close follow-up is essential to optimise prognosis and prevent long-term disability,” one screenshot reads.
The three screenshots referring to ovarian cancer had a last modified date of May 4 and May 10, 2023.

Phone handed over to cops by Erin was wiped numerous times​

Mr Fox-Henry confirmed he also examined a Samsung mobile phone handed over by Erin during the search warrant on August 5.
The jury heard the device would be called “Phone B”.
The court heard four factory resets were conducted on the device on February 12, August 2, August 5 and August 8, 2023.
A report shown to the jury shows the phone was “wiped locally by user” three times and “wiped remotely by user” once.
“No user data had been extracted from the device,” he said.
Mr Fox-Henry will return to the stand tomorrow.
Court has adjourned for the day.

Because otherwise the defence would have an easier way to cast doubt over whether this avenue really was excluded and whether the mushrooms potentially still could come from an Asian grocer.

Also I think prosecution wanted to show what a huge public health effort using taxpayer resources was used. Store owners were grilled and stressed unnecessarily too.

It all helps to paint a picture of what kind of a person EP is - it's erin erin erin after all (all about her, very little consideration for what consequences her actions have on others!)

I don't know how they can do this when Erin has admitted to foraging mushrooms and that she lied about it?
I guess the defense kind of didn't have a choice---the P was putting on their case, listing all the Asian markets etc, so they were going down this road too.

And the D doesn't want to sit there silently giving them a big win, so they pushed back a little. I get it. lol

That language is so offensive. It is so ugly.

I think that someone was living a double life. Ian Wilkinson thought she was “normal”. He said that in his testimony.

People are not always how they portray themselves to be.

Was this just a tragic accident?

I am still of the opinion (as I previously posted a couple of times) that the defence has not admitted to buying Asian mushrooms for the meal as a lie.

The ABC blog does not mention it, apart from the days summery, so I think they got the summary wrong.

The last entry cited the reason of remote wiping as ‘’find my device”.

Under questioning from the prosecution, Fox-Henry explained that there were multiple ways a phone can be wiped - including in the menu settings of a phone or remotely via an external application.

Prosecution: “What does that do if you do that (a factory reset)?”

Fox-Henry: “Recovery of user data is not viable and is destroyed.”

Prosecution: “Is that reversible or not?”

Fox-Henry: “It is irreversible.”

The court previously heard Patterson had two phones at the time of the lunch and only of the phones was ever recovered.
Police seize her phone and it is wiped remotely twice afterwards.

I hope the jury is paying attention!

Was this just a tragic accident?
She knew how to hide this persona from them. I wouldn't necessarily say double life, many men who commit DV crimes for example, seem completely normal or even charming to outsiders prior to the offence.

In Erin's case I feel that a lot of hurt and disappointment that turned into anger and hatred speaks out of her and results in the offensive language (not excusing it at all, just considering how it originated). Once upon a time, I'm sure she did love Simon and his family. This changed when they were no longer on her side - not inviting her to a family event (although SP later stated, this was miscommunication, the hurt was done), Don and Gail being on Simon's side or keeping out of issues concerning the separation, she felt alienated and her hurt turned into hatred over time and she started scheming against them.
