There's a power outage down at court

It appears there's been a bit of a power outage here in Morwell.

People have told me traffic lights are down outside and cafes nearby aren't able to serve coffees.

Here in the court building there's a constant beeping that started about 20 minutes ago.

But it appears there's a backup source of power, with some lights still on.

We're trying to figure out what this might mean for proceedings, which are due to be underway about 10:30am.

Regarding the lunch plates, I’m prone to believe that white plates could be confused with grey ones, especially if they’re light grey. Three people believed there were four of same colored plates, except for Erin…

What happened to the lunch plates?

According to Erin:

She says she used "just the dinner plates I had" to serve.

"I think there's a couple of black, a couple of white, one that's red on top and black underneath, and then I've got one that [my daughter] made at kindergarten," she says.

She says she didn't own any other dinner plates and didn't own any grey plates.

This conflicts with testimony from lunch guest Ian Wilkinson, who claimed lunch was served on four grey plates and one tan-orange plate.

According to her son:

After they said their goodbyes, the boy said he helped Patterson clean up from lunch.

“I remember taking some plates up to the sink and putting them in the dishwasher,” he said.

“I collected all the plates put them in a pile next to the sink... I collected all the glasses put them near the sink.”

He said he did not recall any remnants of food on the plates, which he believed were “plain white” dinner plates about 15cm in diameter.

Asked if he thought they were all the same, the boy agreed.

According to Ian:

The church pastor said the guests ate off grey plates, but Ms Patterson's plate was an orange, tan colour.

Mr Wilkinson said each plate had a serving of mashed potatoes, green beans and an individually-cased beef Wellington, which resembled a pasty.

According to Heather:

Heather Wilkinson, who died after a July 2023 lunch at Patterson's Leongatha home, asked questions about the meal as she started to become ill in the subsequent hours, prosecutor Nanette Rogers SC told a jury of 15.

"I noticed that Erin put her food on a different plate to us, her plate had colours on it, I wondered why that was," Wilkinson allegedly said before her death.

IMO, please correct me if I'm wrong , the actual colour of the plates does not matter that much.

What does matter is that both Heather (through Simon's testimony I believe) and Ian stated that Erin's plate was a different colour to the others.

Ian seemed to be a very credible witness from what was reported, he even spoke about Erin kindly saying she seemed like a normal person. So as a juror I would likely believe his account and give consideration to the fact the he might not remember the colour of the plates correctly (as it's a small detail many people at a lunch wouldn't take notice off) and considering the trauma he went through losing his wife and almost his own life too.

What does matter is that both Heather (through Simon's testimony I believe) and Ian stated that Erin's plate was a different colour to the others.

Ian seemed to be a very credible witness from what was reported, he even spoke about Erin kindly saying she seemed like a normal person. So as a juror I would likely believe his account and give consideration to the fact the he might not remember the colour of the plates correctly (as it's a small detail many people at a lunch wouldn't take notice off) and considering the trauma he went through losing his wife and almost his own life too.

I believe that a woman who went to this much trouble to prepare a meal just so, and appears to have plenty of money WOULD want to make an effort to have matching dinnerware (more than 4 matching plates), appearances are everything to her - especially when this isn't her first dinner party- so the fact that she didn't tells me that there's a reason, and that it's to color-code the plates so she knows who has the poisoned portions.

Yeah, that was my thought too. What’s most interesting is that Ian, Heather and Erin’s son all seemed to think there were four matching plates. Yet Erin testified that she had only two that matched. She had a couple white ones, a couple black ones and one red and black one. Oh and one her daughter made in kindergarten.

So three other people couldn’t tell black from white? Even a color blind person could tell.

To me it’s just another lie that I hope will be noticed by the jurors.

Erin Patterson is expected return to the witness box for a fourth day of evidence this morning.

Defence barrister Colin Mandy, SC, is expected to continue his questioning of the mother of two, who began providing evidence on Monday afternoon.

Once Patterson concludes her evidence in chief, the prosecution will get a chance to cross-examine her. Her defence team will then get an opportunity to re-examine her if they wish to do so.

Day 26 recap

While we wait for today’s proceedings to get under way, here’s a reminder of what the jury heard on Wednesday:

1. Patterson said her estranged husband, Simon, accused her of trying to poison his parents using a dehydrator the days after the lethal lunch. Patterson says Simon asked, “Is that how you poisoned my parents … using that dehydrator?”

2. The accused said she believes there is a “possibility” she unintentionally added foraged mushrooms to her beef wellington mix while trying to improve its “bland” flavour.

3. Patterson says she lied to her lunch guests about requiring cancer treatment because she was “embarrassed” to tell them about plans for weight loss surgery. “I was ashamed of the fact that I didn’t have control over my body or what I ate,” she said.

4. Patterson said she ate the remainder of a cake brought by her mother-in-law, Gail, to the fateful lunch. She says after consuming the cake in the evening, she felt “over-full” and “brought it back up again”.

5. Patterson also admitted she lied to Gail about requiring a needle biopsy the month before the lunch. She said when she mentioned a lump in her arm, her in-laws showed a lot of care, which “felt really nice”. “I shouldn’t have done it,” she said.
