Prosecution calls for maximum penalty for murder charges​

Addressing the court, prosecutor Jane Warren says Patterson has no recorded prior criminal convictions but notes a VicRoads record relating to a matter in 2004.

Beale says Patterson has no relevant criminal history. Warren agrees.

Warren says all the charges fall in the “worst category” .

She says the prosecution is calling for a maximum penalty for the murder charges. But she says it does not make the same submission for the attempted murder charge.

Judge questions Patterson's Asperger's claim​

Victorian Supreme Court judge Christopher Beale has questioned the evidentiary basis of Erin Patterson’s claim that she suffers from Asperger’s syndrome.

Patterson’s defence counsel, Colin Mandy SC, told the court the claim appeared in the brief of evidence, including in conversations with her estranged husband, Simon Patterson.

Mr Mandy said the claim was supported by a recorded conversation between Child Protective Services and Patterson, in which is was noted Patterson had Asperger’s syndrome.

He also said Ian and Heather Wilkinson’s son, David Wilkinson, had told police he believed Patterson had “high-functioning autism”.

Erin Patterson's only surviving victim forgives her, asks for confession​

Erin Patterson's only surviving victim has forgiven her for trying to kill him as he urged her in court to confess to the murders, which she continues to deny.

"What foolishness possesses a person to think that murder could be a solution for their problems, especially ... people who only have good intentions towards her?" Wilkinson told the court.
"Erin has brought deep sorrow and grief into my life and the lives of others.

"In regard to the many harms done to me, I make an offer of forgiveness to Erin.
"I say harms done to me ... I have no power or responsibility to forgive harms done to others."
He then urged Patterson so spend her time behind bars wisely.
"I encourage Erin to receive my offer of forgiveness for those harms done to me with full confession and repentance," he said.
"I bear her no ill will, my prayer for her is that she will use her time in jail more wisely to become a better person.
"I am no longer Erin Patterson's victim, and she has become the victim of my kindness."
