Justice Beale begins his sentencing remarks​

Justice Beale begins his address, and gives Patterson clear instructions.

"Ms Patterson, please remain seated until I tell you to stand," Justice Beale says.

He outlines the maximum penalties for murder.

"The prosecution submits, and your counsel concedes, that your offending falls into the worst category of offending for these offences and that you should receive the maximum penalties for your crimes," he says.

"I agree."

Mushroom lunch survivor listens to sentence​

As Justice Beale reads out his sentence, Erin Patterson is sitting in the dock glum-faced, blinking rapidly.

Ian Wilkinson, the sole guest who survived the mushroom lunch, is sitting about 10 metres to Patterson's left, with his arms crossed.

Patterson knew about iNaturalist website, Beale says​

Justice Beale says Patterson knew of the iNaturalist website, where users can track and chart the location of mushrooms, for at least a year before the deadly lunch.

"You were familiar with the iNaturalist website from at least May 2022. That is a website on which people can post and view sightings of death cap mushrooms, amongst other things," he says.

"On May 28, 2022. You accessed the iNaturalist website and looked at the worldwide map in relation to viewing of death cap mushrooms and saw it in Moorabbin."

Tensions in Patterson family told to court​

Justice Beale references messages shown to the court during the case, highlighting Patterson's anger and disdain for her estranged husband's family.

"This family, I swear to f***ing God," reads one of Patterson's messages.
Justice Beale says Patterson called the family "a lost cause."

"You said, 'f*** them' and that the best thing that you could do is forget about all of them and live your life," he says.

"You accused Simon of gaslighting you, and Don and Gail of using, 'weasel words'. You called Simon 'a dead beat' and wondered why Gail was not 'horrified by his stance regarding child support'."

Justice Beale outlines the lead-up to the lunch​

Justice Beale recaps Patterson's plans of hosting a lunch in July 2023.

He says she used the premise of a cancer scare to convince them to attend.

After initially inviting her estranged husband Simon, her invite was then rebuffed.

"Hi, Erin, thank you for the kind lunch invite together with mum and dad but I'll decline as I feel too uncomfortable about it," Simon Patterson wrote in a text message.
Patterson used her medical issues in an attempt to get him to attend.

"That's really disappointing. I've spent many hours this week preparing lunch for tomorrow, which has been exhausting in light of the issues I'm facing and I spent a small fortune on beef eye fillet to make beef Wellingtons because I wanted it to be a special meal, as I may not be able to host a lunch like this again for some time," Patterson wrote back.

"It's important to me that you're all there tomorrow, and that I can have the conversations that I need to have. I hope you'll change your mind. Your parents and Heather and Ian are coming at 12:30. I hope to see you there."

Justice Beale discusses the day of the lunch, where Don and Gail Patterson and Heather and Ian Wilkinson attended and ate a poisoned beef Wellington.

Guests fall ill while Patterson runs errands​

If you've been following the trial, much of these events will be familiar with you.

Justice Beale moves onto the aftermath of the lunch, as the four guests became violently ill.

He points out the stark difference between the four guests fighting for their lives in hospital, and Patterson's actions the next day.

"By way of contrast, you made a round trip of approximately two hours on Sunday afternoon to take your son to a flying lesson," Justice Beale says.

Erin Patterson refuses medical assistance despite poisoning claim​

Justice Beale recaps Patterson's reluctance to be treated in hospital, or have her children examined.

"When you returned, you showed reluctance to receive treatment for suspected death cap mushroom poisoning and to organise a medical assessment for your children, who were at school," he says.

"Medical staff were urging you to have the children assessed, because you claimed, falsely, that on the Sunday night, you fed them the leftovers of the beef Wellingtons, with the pastry and mushrooms scraped off."
He recaps Patterson's claim that she purchased the mushrooms for the lunch at an Asian grocery in Melbourne, and that she had never foraged for mushrooms.

He says he is satisfied this was a lie.

Justice Beale says jury did not buy mushroom lies​

Justice Beale says the jury saw through Patterson's claims that she purchased death cap mushrooms accidentally.

"The jury rejected this elaborate explanation. They found that you deliberately poisoned the meals of your lunch guests," he says.

"I am satisfied that your vague story about the Asian grocery was a lie."
He says Patterson then attempted to lie again in an effort to cover her tracks.

"When you realised that the lie would not work, because death cap mushrooms cannot be cultivated commercially, and there were no other reports of people falling ill from mushrooms purchased at Asian groceries, you changed tack," he says.
