The verdict form asks the jury to decide the first count – second-degree manslaughter – before potentially moving to the second count of criminally negligent homicide. Only if it finds Penny not guilty on the first count, can it consider the second count of criminally negligent homicide.

This is gonna end in a mistrial imo

Most of us believed that before the trial started. People are very firm on this trial, and charges. They are either for "Team Penny" or "Team Neely". No middle ground here.

I don't see anyone "splitting the baby" here.

If they are following the evidence, this isn't about being on any team, but going where the law leads them. And, IIRC, there are two lawyers on the jury. Whatever their decisions are, they wouldn't be pressured into changing based on any pressure from a judge or prosecution, I assume they would stick to following the law and the evidence presented.

Sure, but the jury has to decide what a reasonable person would do and that question of what was reasonable is a purely subjective. Each juror is going to consider that based upon their own life experiences. And this seems to be what they are struggling with. I'd say this is certainly leaning towards a hung jury.

Wow I did not realize there are 2 lawyers on the jury. Interesting, IMO.

I’m not a lawyer, but wouldn’t the jury have to find him not guilty on count 1 before moving on to count 2? I’m confused.

And, is there anyone to blame for this *hung jury situation/don't know if/how we can force jury to 2nd charge decision*? Or do we blame the laws? Or will we keep finding ourselves in the same situation (just different people) in the future? OR will there be no one left who will ever attempt to protect themselves and others in the future?

I believe the jury may just be asking themselves those same questions!!

To be fair, we don't really know who has the majority opinion on the jury.
The majority could be the folks that have already decided he's guilty, while the minority refuse to budge and believe him to be innocent.

I agree. I am team Penny. He did what I would hope any man would do if I was in a room, subway, train, plane or anywhere I couldn’t escape and a man gets on acting crazy and saying he wants to die or kill someone and seemingly on drugs. Penny may have saved lives that day. We all make choices how we live. <modsnip: not victim friendly>

If we start tossing blame around I guess there are all sorts of individuals and agencies we could be looking at that could have (possibly?) done more to have prevented this outcome. Maybe.
That's the problem with the "what ifs" - it's all really just guesswork.
End of the day, I'm not even sure that's all that helpful.
