IMO, if the prosecutors believed in this case, they would have accepted a mistrial and retried him.
I’m relieved he was found not guilty.

Jurors sided with Penny’s defense attorneys, who had argued that the Marine veteran was justified in rushing to protect his fellow subway straphangers when he subdued the erratic homeless man. The lawyers had also questioned whether there was sufficient evidence that the chokehold caused Neely’s death.

A pathologist hired by the defense testified that Neely died from a mix of schizophrenia, K2 use, a genetic condition and his struggle with Penny.

Witnesses said Neely boarded a train in Manhattan on May 1, 2023, started moving erratically, yelling about his hunger and thirst, and proclaiming that he was ready to die, go to jail or — as Penny and some other passengers recalled — kill.

Penny came up behind Neely, grabbed his neck and head, and took him to the floor. The veteran later told police he “just put him in a chokehold” and “put him out” to ensure he wouldn’t hurt anyone.

A jury with decency and common sense. I am just one person who is so grateful. As much as I am sorry that a man lost his life, it is time people are responsible for their actions. Help is out there for those who desire the help. We cannot always “fix” those who don’t want help. At least the jury realized DP was trying to save the lives of others.

A Manhattan jury has cleared Daniel Penny of criminal wrongdoing in the chokehold death of Jordan Neely on a crowded subway — a caught-on-video killing that sparked fierce debate over the city’s mental health system and crime underground.

The panelists acquitted Penny of criminally negligent homicide — which could have put him behind bars for up to four years — in Neely’s chokehold death aboard a crowded uptown F train in May 2023.

The anonymous jury, made up of seven women and five men, were told before they began deliberating that they had to come to a unanimous decision on the top charge of manslaughter in the second degree before moving on to consider criminally negligent homicide.
But Judge Maxwell Wiley changed that order Friday after jurors twice sent a note saying they could not reach an agreement.

Help was absolutely NOT there for Jordan Neely.

I couldn’t be happier!
Any funds left over, he’s donating to veterans because he’s a terrific stand up guy!

I hope he gets the heck out of NYC and never looks back
