Why is she asking hypothetical questions?? Come on!! Just ask legitimate questions and get on with it. I was in such a good mood when Judge Perry announced that the State approved funding through May... but DCS's has gotten me in a bad mad!

Dr. Logan is not even an expert witness! It's been proven and there is nothing DCS's can do about it now. Asking the same question a million times in a different manner is not getting you anywhere.

Me thinks that as Dr. Logan is answering DCSs questions, in the back of his mind, he is dreading the cross by JA. I'd be dreading it too, if I was him.

Maybe we'll get lucky and JA will say "no questions your honor" and be done.

You know, I bet Dorothy Sims is a very nice person. She seems somewhat scattered to say the least, but she seems to be sincerely doing her best for her client.

She just doesn't have a leg to stand on here.

Despite my annoyance at the droning on and on, I feel a bit sorry for her that she's gotten mixed up in this case. Someone who sincerely works this hard (although misguided and in over her head) should't have to put up with all the DT games and shortcomings.

This may be the only nice thing I will ever say about anyone on that team - and I reserve the right to take it back at any time, lol!

What I would like to know, and maybe joypath can answer this accurately, is HOW can anyone dispute methodolgy without actually performing the same testing themselves.

When DNA was first introduced at trial it faced the same issues. New science will always be faced with this.

Yes, exactly, which is why I am thinking the fact that they cannot find articles and experts is a problem the prosecution. I am not seeing that this guy is not an expert as a smackdown for the prosecution. It just seems like a big waste of time but may be demonstrating that there is no scientific opinion/general acceptance of this stuff.

DCS appears to be a legal beagle who CAN run her way thru the morass of steps required to get an answer close to what she wants.......BUT this is criminal vs civil court and IMHO, HHJP is "on the money" regarding the nuances of the law!
