This "sensitive issue" the DSimms is talking about has to do with the "sealed" item that that was discussed in CA's depo, I think. Anyone remember that? It came up when they were discussing KC taking hairbrushes and hair samples from the A home in CA's depo. At least that's what I'm thinking. Anybody have any ideas on that?

When was this NY Frye stuff brought up. I'm confuzzled.

It was the in Appendix A submittal filed with the State's rely re: hair banding that Ms Lowe? testified to on day 1 of Frye. It included the Petrenko (sp) papers re: hair banding and a deposition he gave in a NY case that Lowe discussed. I believe Petrenko was once upon a time supposed to be a defense expert but bowed out once he reviewed the case.
