That is true, but what I'm concerned with is the hard time the jury in the Barker case had with premeditation may correlate with a jury here veering between a drowning accident and murder.

If LDB can slam CA about the ladder incident on the 16th via her phone records and co-worker testimony then I don't think the jury will have a hard time with dismissing the pool accident theory.

My only concern is that if they don't get the searches associated with ICA then the premeditation might go out the window and if it does so does the 1st degree charge.
