AT is also motioning again inflammatory evidence ... State says it's relevant evidence and the Defense hasn't shown how it's Inflammatory to the degree it's prejudicial.

Judge says no use of "psychopath" and "sociopath" because there's been no testing to indicate it.

"Murder" is in, because it's what the charges are. "Commit murder" and "murderer" from witnesses are arguable (I assume he means that it's subject to objection.)

Makes it clear that, prior to closing statements, he WILL NOT allow any latitude for it.

Regardless of what you can and cannot call it, if it looks like a duck, walks like a duck, and quacks like a duck, I think the jury can recognize a duck. JMO

As to Inflammatory evidence, the judge says he can't know what that is until he sees it

Expects both sides to be professional.

Admits the photos are brutal but the crime itself was brutal.

Says he will judge the nature of exhibits in a case by case basis (which photos and how many to admit).

He is NOT going to wholesale deny inflammatory evidence.

State says issue is settled with the Defense. Defense won't say that the State "is trying to kill" BK. Judge says indeed that is argumentative, not allowable. Again expects counsel to comport with expectations.

When the judge says to the defense, "I don't think we are reading the rule the same way", you know whose reading is gonna win out, and it isnt gonna be good for defense.

Defense is whining about BK's paper. Judge reminds that, even if it's considered a prior bad act, the State CAN use it --

Judge: "I don't think you're understanding of the rule comports with... my understanding..."

Defense continues, wants Amazon thrown out as a bad act.

Judge says 404 doesn't preclude evidence of foreknowledge!

Defense wants the traffic stop out because they say the crime is prior act but not on a level with the crime.

Defense says it show BK in Moscow, at night, in the car, arguing, not wanting to give his phone number... clear video of the car...

They don't want the State to introduce all those elements to the jury.

Judge: why is that a problem?

D: because it might show that his car is similar to the one in the 1122 video.
