To me, BK looks less engaged today than he has been at any previous appearance. Playing a part now, perhaps? JMO
He looks like one of those puppets on a string that you move the hands and arms from the top. I believe it's all acting. Nothing to do with a mental illness or motor skills.

She was just listing the things he is being 'called'... because of his "Autism" spectrum crap. And Judge H told her she is not citing ANY Idaho cases.

I laughed out loud when she said that he can be the first Judge to rule on this. She can’t cite case law, only studies. Juries are instructed to rule only on evidence, not the defendant’s courtroom demeanor.

Defense wants the judge to set a precedent ....

Jury isn't supposed to deliberate on anything but admissible evidence... so how can he instruct them of that but also let the Defense talk about his mannerisms?

As a matter of fact I am shocked how the defense/kohburger has been slapped down today.

We have a conspiracy theorist, but, we have no professional diagnosis.

Jmo, it appears some complicated gaslighting has been attempted today. It hasn't passed muster with Hippler. But this is why many of us are feeling so confused and gobsmacked. I totally am. Hippler would not be an easy man to gaslight Imo.

Intelligent people often make the most basic mistakes when doing crime, because their own estimation of their intelligence versus the intelligence of the investigators means they don't bother to conceal what they've done in anything more than a cursory way. They assume they're too smart to get caught.

Take the guy who was a MENSA member who poisoned his neighbours over petty neighbour dispute nonsense with thallium.


He had a vial of thallium in his home, along with other dangerous chemicals, a homemade journal which was basically a guide to poisoning people including several chapters on the administration and dosages of thallium, and a copy of Agatha Christie's The Pale Horse, her famous work that educated the common person on the dangers of thallium and has saved the lives of at least two poisoning victims.

Sometimes, a big brain just helps you get in your own way. I think it's certainly the case here.

This is cringy. The whole afternoon.

The evidence is too incriminating so throw it out for being prejudicial.

The Defense is still searching in discovery for an alibi and a SODDI.

BK is so limited by ASD he couldn't have commit this crime but has no expert who can testify to that.

That is why Joshua Hurwit went for the throat and demanded data behind two elledged expert mental health evaluations of Kohberger.

He requested additional materials, including test results and the facts supporting the experts’ conclusions, to allow their own experts time to review and prepare a rebuttal. The supplemental discovery request specifically refers to evaluations by forensic psychiatrist Dr. Eileen Ryan and neuropsychologist Rachel Orr.

He demanded it, because it doesn't exist. 😂

So let me see if I have this straight. The alleged assailant, BK, studied for and planned to be an expert of the ‘human’ condition relating to the ‘psychology’ of criminal conduct, criminal activities, and forensically investigating such crimes. And that includes murder and similar crimes IIUC. And now this defendant and his counsel want to attempt to invoke a supposed or feigned illness or condition for his own purposes at trial? Absent any evidence for it? SMH.

It would seem if the defense had some reports of such a condition that type information might have already been introduced to the record by some means. To become publicly available? Unless it is being withheld for some other reason? Or maybe that condition has not been examined as one is not willing to attest to it? MOO
