Okay, I’ve skimmed through the last ten pages or so.

Having missed the majority of the hearing, what I garner from the posts here is leaving me gobsmacked.

It seems from what I’ve skimmed that AT and Co. are attempting to infantilize Bryan? Apparently there were comments that he had trouble tying his shoes and forming the numeral 5 correctly?

He was getting his PHD for gosh-sake. I hope his college paper is admitted as evidence. That will show how this new narrative is so off.
Did they claim this was when he was a child, or a persistent problem as an adult???

In any event it seems that Judge Hippler is smacking down all this nonsense, seeing as how BK managed to live alone, drive, go to college and so on.

I’m astonished/not astonished that his defense is flailing around, as they really have nothing to support BK as innocent. But I am truly surprised as to how they are coming across as such amateurs.

Most of their arguments fell flat as a pancake.
JMO and thanks to all my fellow posters for keeping the rest of us so well-informed.

Plus he may be fascinated with crime scene photos and glare at witnesses -- or jurors. He might creep everyone out.

Have we at least heard the last of Sy Ray? That was quite the dressing down.

No, I think he is still her phone data expert witness. He is supposedly going to give his own version of the ping map and tell us all where BK was that evening/early morning. :rolleyes:

Someone said it is over, but I was under the impression that it will continue tomorrow. I believe that it was scheduled for two days, and I do not think they got two days of work done today. JMO

BK's attorney is ready to challenge the DP during trial. Admit it, she already sees this case as a dumpster fire. Done deal. So, she wants to edge in her own manufactured defense based on BK as "incompetent". Completely infantilizing him. He can't tie shoes, can't this, can't do that.

So, the defense is that BK was too stupid to commit the crime? But he was admitted as a PhD, in "Criminal Studies". And he also goes driving around aimlessly at night to look at stars.

I wonder why AT is so worried about his affect in court? Are there any reports of him behaving bizarrely or inappropriately during his various hearings?
He looked drugged today?

Well, to be fair, on Nov 13 he was apparently driving around in the wee hours of the early morning, stargazing on an overcast night, so there's that. JMO

But didn't the judge expose this? That there's nothing misleading about the State's position -- except for the error in timing, there's agreement that BK's phone and Elantra were SW of Moscow.

Sy Ray can't testify to where BK might have been between 2:54 and 4something because BK's phone was off.

AT is exaggerting significance of the disparity between 2:47 and 2:54 but it's sick a moot point! It's not relevant to where he was at 4:15.

She should withdraw Sy Ray's affidavit yesterday and beg for the judge's mercy for her utter lapse in judgment. Serious accusations without any evidence, dangerous waters for her and her witness.

Maybe a proper sanction would be to scratch Sy Ray from the Defense, to spare the jury something intended only to confuse.

From what I understand autism or “being on the spectrum” is a personality / mental health disorder, as are psychopath and sociopath.

If defense has an official diagnosis for BK’s autism and they can use it to his advantage and possibly restrict state’s use of the term, why can’t prosecution have an evaluation to know if BK is also a psychopath or sociopath, and if he is, use that to their advantage? Why did defense bring that up for a ruling? I guess we would know by now if the state was going to get a psychological evaluation by an “expert” on BK. MOO.

Also, related to BK’s family testifying early so they can then be in the courtroom, what if later after they have been sitting there and listening for days or weeks the state needs to recall one of them for some reason? Having them in courtroom and having them testifying first (out of order) certainly seems like a disadvantage for prosecution. MOO.

I do NOT believe that he has either autism, nor on the spectrum: ~~~ 100% YES to personality / mental health disorders AND psychopathy and sociopath.

Watching parts I missed earlier.

AT asking to limit the State's witness from saying it's Vehicle 1 at various points along their proposed route. Because it's only identifiable in one image .... so even though the vehicle in the other images is consistent-- both in appearance and timing -- she doesn't want the witness to claim its the same one.

AT is arguing with the judge over the years of the Elantra and HE reminds HER that the witness expanded the year range. She says they only changed the years  after BK was identified, but the judge answered her, "that's not true." She continues, saying again that the expanded years came after BK was identified.

Judge: I don't think that's consistent with the facts.

Judge says it's in the province of the witness TO testify if he believes it's the same vehicle in all the images.

She is floundering.

Painful to watch.

I don't think she has a legitimate diagnosis in order to prevent the State from launching their own assessment. She's playing a new shell game. I think she's found a witness willing to say that, based on certain behaviors BK exhibited as a child, he could have been diagnosed then as having ASD and AT is putting it on blast as proof thst he had it, carried into adulthood, without providing the State with any workable discovery.

And she wants to populate her opening statement with references to ASD to explain to the jury why he's so weird but like I said she's using ASD as a mitigating factor for sparing the DP. In other words, her argument jumped the track. Pulling mitigating evidence from the caboose in front of the guilt phase engine, in her opening, while simultaneously seeking to prevent the State from using the same against BK.

Without a credible diagnosis, she's going one step further IMO, to group all individuals on the spectrum into one group, magically including BK, and then ascribing the most debilitating of features to BK as if he's a vulnerable adult in need of class protection.

I'm up to bushy eyebrows.

Defense says DM can't be trusted because of her alcoholic consumption across an entire day. Defense says DM didn't mention (bushy) eyebrows until the third interview so it's unreliable.

Long wordy read from the Defense about false memories, confabulation.

Defense claims DM was shown a balaclava and then drew one.

I'm sorry. Despite alcohol and sleep, DM is very credible because the facts are consistent with her interviews.

IMO this is all suitable, not for suppression, but for cross.

Move on already.

ITA & IMO her "intentions" are totally laughable, unbelievable by any jury with even a minimal brain function, and ridiculousness.

I hate time wasting when these poor parents are seeking/awaiting for justice for their innocent murdered children. To listen to this trash spewed by the Defense is soul crushing and insulting not just for the families but for us too who know better!

Let the jury assess her credibility.

I can't believe the Defense represented to the judge that the State intended make a positive identification between DM's description and the selfie! State isn't using to DM to introduce that photo! DM nene identified BK as the person she saw. She just perfectly nailed his appearance. One male, athletic, lean, not muscular, taller than her, dressed all in black, with only his eyes visible, with bushy eyebrows.

Too bad for the Defense she described BK -- and weeks before he was identified by DNA --
It's not overly prejudicial. It's just incriminating as hell.
