I think we need to rely more on the witnesses' testimony of where they were that night. I do not believe any digital evidence will show where in the house they were. Perhaps general location of that neighborhood but not whose bedroom or bathroom they were in or which set of steps they climbed up.

Since eyewitness testimony is notoriously hit and miss and attorneys LOVE to jump on that, I hope they rely on as much evidence from as many sources as they can provide. Just in case. JMO.

I don't have a lot of faith in eye witness testimony

DM's eyewitness account happens to match the suspect in both description of suspect as well as giving the time she saw him which coincides to seeing the white car on video. Her description matched his license and started the investigation on Kohberger's path.

@StarryStarryNight

From your post…

“He wasn’t studying course materials or writing a true thesis, that was secondary. He was studying how to kill people…”

I think you nailed it.
“He was studying how to kill people” should be the first line in the prosecutors opening statement.
A bit late to respond to this.

Not that my thoughts are any revelations but it sort of hit me - the end of his time at DeSales was likely mostly spent researching but not for a paper or grade or any sort of degree or doctorate. It was for becoming a highly polished killer. He was using the educational side as a cover of sorts, asking actual criminals questions without it appearing obvious what was really happening. What a slippery serpent he is. I wonder how much skin he’s shed while sitting in jail?

Asking a criminal what they did & what mistakes they made puts a rookie criminal in a very advantageous position.

Yes, it would be quite nice if the prosecution would work that angle into their opening statement. He was studying how to kill. How to kill without leaving forensic evidence behind. He was working towards a degree at DeSales - a degree in first degree murder.

It’s a piece of the puzzle - the DNA likely will be the final blow on the head of the nail. I have a feeling the amount of evidence is going to be overwhelming, hence all the defense allegations prior to trial. Once it gets there & if it does in fact get there, it’s possibly going to be desperation mode.

I’ve been doing some research on homicide by stabbing and came across forensic science article at link below which has some interesting and informative info. Article is rather lengthy, includes type of stab wounds, type of weapons, manner and cause of stabbing death etc., etc. I snipped a couple parts out as they’ve been ongoing recent topics of speculation and discussion r/t one perp/one weapon, amount of visible blood etc. ***A warning that some parts/descriptions in the article are graphic.

Snipped & BBM from article (with a couple of my comments added underneath paragraphs):

Weapon dimensions:
A single weapon can produce a series of wounds encompassing a wide range of skin-surface lengths and wound depths. This is often seen in a multiple stabbing fatality and is consistent with the use of only one weapon.”
However, it is rarely possible to exclude any speculative suggestion of more than one weapon, and, by inference, more than one assailant.

**IMO r/t the purple bolded above is pretty much what AT & Co. have suggested/speculated, that
more than one weapon was possibly used/more than one assailant possibly involved. At the hearing a few weeks ago, AT mentioned having a tip/lead on alternate/other suspect. And previously Judge H had said that he will not allow speculation about other/alternate suspect(s), that AT & Co. needs to bring/show facts/evidence if such exists before the court by iirc May 14th. Let’s just say hypothetically for argument’s sake, AT’s tip/lead pans out and she has found and collected evidence of an alternate/other suspect, imo it would not exonerate BK as based on all known facts and evidence numerous LE agencies and the state has against him, imo BK cannot be separated from this horrific crime so
it would have to be a co-conspirator.
IOW, instead of TODDI (This Other Dude Did It), it would have to be BKATDDI (Bryan Kohberger And This Dude Did It). Not saying that I believe BK had help at all just positing a hypothetical based on AT saying she has a tip/lead on an alternate suspect and Judge telling her she needs to present evidence to the court if it exists. I personally think BK did the crime all alone and that AT & Co. have nothing, are desperate and throwing up smoke and mirrors. If anything, I expect her to ask for a continuance/delay but Judge H seems to have made clear he wants trial to stay on track for August 11th, so I don’t really see him allowing the D more time to chase down a lead on some alternate phantom perp aka
a lead that goes absolutely nowhere/nonexistent alternate perp. I could be wrong, we’ll have to wait and see what happens at next court hearing in May.

Collapse and death:
“A lethal injury can lie beneath the most trivial looking skin wound, emphasizing the fact that the primary characteristic of a stab wound is its depth. Stab wounds kill mainly as a result of hemorrhage, which is usually internal rather than external. Indeed, there may be little bleeding onto the skin and clothing in a fatal stabbing.
Whereas the loss of a large volume of blood will clearly account for death, a much smaller blood loss, of about one liter, may have a fatal outcome if it occurs very rapidly”…

**IMO It’s very disturbing to think about what these four precious souls, KG, MM, XK, EC, last moments on earth were like. I’m glad MM was heavily intoxicated and likely sleeping, never woke up to realize what was happening, and hopefully same for EC as has been speculated. Poor KG and XK were aware/somewhat aware what was happening but even if just for a little bit, it’s harrowing to imagine the fear and terror they likely felt in their last moments on earth. Regardless of who was awake/aware of what was happening or not, it’s just so sad and heartbreaking that four beautiful, innocent lives with so
much promise were taken from this world so brutally and violently
by an evil madman lunatic.

I agree, and especially so in this case, where the eyewitness was admittedly intoxicated. Defense will do what the defense has to do, and that will be to pounce on that. DM's testimony has held up well so far, but any and all corroborating evidence there may be would certainly be brought out at trial. JMO

I agree completely.

It has, in fact, been mentioned previously somewhere in all these threads.

What I see in his questionnaire is BK trying to collate a how-to book from people who’ve already done what he was bursting to do. How did they choose their victims? How did they make their escape? etc.

A guidebook, so he wouldn’t make the mistakes that landed these people in prison.

The questionnaire seems amateurish to me. I know this is qualitative research that allegedly would lead to a thesis, but it’s hardly original to inquire of a murderer “Why’d you do it?”

I’ve written two Master’s theses, and they require original thought on a unique topic. I’ve never written a Doctoral dissertation, but if that were in his future he would have had to have chosen a topic that would be illuminating; not repetitive of the knowledge already published in his arena. Typically a dissertation is highly focused on a little-known and narrow topic, in which you as the author demonstrate expertise that has not been covered before.

There are databanks available to Ph.D. candidates to help them avoid a well-trodden subject.

BAM! No, that wasn't @Warwick7. I will leave that one for her. This one is the sound of yet one more door slamming in the face of the defense! Is there anything else they can try, to get the death penalty stricken, a "pretty please" maybe? JMO
Please guys post as much as you can I'm sitting at a doctor's office and I don't get much information in here.

Good grief. So people's veracity is in doubt because they identified an attacker in their personal home, but due to the fact the person had been drinking, which is perfectly legal, all testimony can be impeached?!

This has such huge implications. So basically we have have to be 100% sober at all times, in case we are witness to a crime?! In our own home?! Bah. Our criminal justice system is disgusting. We have become so convoluted that the law seems to protect criminals far more than victims.

I’m behind due to RL and still getting caught up on posts on this thread and last thread but wanted to comment after reading some of the Judge’s written orders on motions that dropped recently. Thank you @wendy44 for keeping track, providing and updating motions’ list.

IMO with majority of Defense motions to suppress highly incriminating evidence DENIED, BK’s goose isn’t just cooked, it’s burnt to a proverbial crisp.

I opined in a previous post about how I’d love to be a fly on the wall when AT & Co. meet with BK to hear the type and tone of the conversations they’re having with him. Another place I’d love to be a fly is during conversations, if any, BK has had/is currently having with his parents. Iirc his Mother wrote an essay/article that mentioned infamous evil SK Ted Bundy and that she’s against the DP, so imo I’d think with her Son going to trial with all the incriminating evidence against him and especially now after learning his ASD can’t be used to strike the DP which she’s against, I’d imagine his Mom wouldn’t want him to risk going on trial and potentially facing the firing squad someday, and would be encouraging him to tell the truth accept responsibility and try to see if he can negotiate an 11th hour plea deal with the state to save his life (imo the state will not negotiate as the evidence against BK is solid/they have a strong case and appear confident they can secure conviction at trial).

Unless? his parents believe he didn’t perpetrate the crime which if so, they’d have to ignore a bunch of facts and a boatload of damning evidence pointing at BK’s guilt and must think he’s the unluckiest man on earth being framed by the ‘real killer’ and railroaded by numerous agencies of LE and the state of Idaho. Having said that, I realize how powerful denial can be and my gosh what parent wants to believe their offspring is an evil quadruple mass murderer.

IMO BK likely doesn’t care what his parents think nor is it likely that he’d consider or heed their advice if they’re encouraging him to tell the truth/come clean. Rigid thinking BK doesn’t cooperate or heed anyone’s advice as he thinks he’s the smartest person in any room.

IMO BK wants to go to trial as he’s sure he’ll be able to beat the system. IMO this is a game to him that he thinks he can win. But before it turned into a game, I think it started out as a pet project so to speak for BK. From the start with all the prep/planning, then putting the plan in action aka perpetrating the crime, after which I believe he didn’t think he would get caught (I’d give him an “F” aka major Fail for dropping/forgetting/leaving behind the knife sheath, and for all the other stupid mistakes he made- hello! oh-oh-oh digital forensics, gotcha!!), to where he sits now approaching trial/the end of the game that he still thinks he can win and is loving all the attention he’s receiving.

As far as his adoring fans/groupies, this phenomenon has been around for decades and there’s now a name for it called Hybristophilia.
IMO these groupies/fans of killers are lonely, desperate, deluded, possibly mentally ill people with zero self esteem. From Manson and Bundy to name a couple from back in the day, to Mangione and Kohberger present day, and scores of other murderers in between had/have adoring fans.
It’s as wacky as it is sickening.

I feel very bad for BK’s parents,
I’m sure they love their Son and always will no matter what happens, he’s their child after all. The struggle is real doesn’t even begin to describe what they’re likely going through. My heart goes out to them and his two sisters. At least their Son and Brother is still alive, they can talk to and visit him.

At the same time, there are 4 sets of parents whose daughters’ and Son are no longer alive/they’ll never see again. As a parent, the thought of never seeing my child again is unfathomable, unbearable to even think about. My heart aches for them and their respective families to have their beloved children and family member taken from them so violently while they were just living their best lives in college, on the cusp of adulthood with their whole lives ahead of them, brutally murdered in their safe space. A place they should’ve felt most safe and likely did until an evil coward came in, ambushed and butchered them to death. Literally the stuff of nightmares, a parent’s worse nightmare for sure.

IMO BK not only took 4 precious lives, he ruined the lives of 5 sets of parents and their families (includes his own), and the collateral damage he caused extends to the two surviving roommates, their families, the friends of all of the victims, and a whole community left reeling/devastated by this horrendous crime. It’s hard to put into words or describe the extent of the trauma and devastation caused by the evil actions of an evil, selfish, homicidal maniac.

If the case goes to trial court as scheduled in August and I believe that it will, this Judge seems to wants to keep trial on track, BK will be protected by the 6th Amendment of the constitution, presumed innocent and will receive due process. His D attorneys will have a tough job trying to poke holes in the state’s case/raise reasonable doubt considering all the incriminating evidence the state has against BK (imo there’s more we don’t even know about yet), and the P will be bringing their A-team to represent the state of Idaho to prove BK’s guilt BARD to a jury of his peers to ensure the voices of the four precious victims are heard and their killer is held accountable.
Which reminds me of a quote by novelist Lois McMaster Bujold-
“the dead cannot cry out for justice; it is a duty of the living to do so for them.”

Kaylee, Maddie, Xana and Ethan,
there are thousands of people from all over the world supporting and crying out for justice for all four of you. Hang on a little longer precious souls, for it’s almost here.
Looking forward to justice being served soon so that you can all finally rest in peace. xo

I love this line from Judge Hippler found on page 6 -

"Defendant cannot demand everything under the sun and then complain about the weight of all the planets."

:-)

I think Judge Hippler is amazing.

I cannot fathom the amount of time he has to invest, searching through case law for precedent, (or his paralegals’ workload) in order to torpedo the massive amount of motions that come before him in this case.

All with wit and precision, and memorably pithy remarks.
