If I were the prosecution, I'd have spent the weekend having someone researching and making a list of all the big name cases that had Dateline episodes about them broadcast before their trial started (Vallow/Daybell). See how many of them included previously unknown facts that came from exclusive anonymous sources "close to the investigation." And whether or not that caused the judges in those trials to make rulings/changes based upon the potential effect upon the jury pool.

Honestly, I'd be shocked if absolutely none of the new information came from Steve Goncalves, who would have gotten it via his PI or even LE telling him, hoping he'd keep it in confidence. There is also his claim that member(s) of the Idaho grand jury have come to him and told him things.

I can absolutely see this being the case. I have always believed he was pretty much the reason for the gag order in the first place because he was very vocal in the beginning and not careful about the information he was giving out IMO. Then came the gag order which I'm guessing meant the families got a while lot less information than before, just the basics and need to know stuff before it gets made public through hearings.

All just my perspective though, which is often proved to be wrong!

State needs no advantage and IMO isn't going to jeopardize their case.

Defense will attempt to capitalize on it but shouldn't dare accuse the State outright (been there, done that, got spanked). I don't think they leaked it (in order to motion for dismissal).

Perhaps someone not bound by the gag order. Private investigator or LE, once privy to the investigation, now retired....

Or rock solid docujournalism, deep diving with multiple sources.

Won't change the outcome of the trial. We live in an age of global coverage and mass saturation and still seat impartial juries.

And will for BK too.

Even if the public watches this episode of Dateline every single day. And twice on Sunday.

Think of all that prosecutors made public about Heuermann (LISK). They published his murder notes, for goodness sake, yet New York thinks he’ll get a fair trial.

I really dislike gag orders. The one in this case, IMO, is directly responsible for a malignant cottage industry that has vilified the surviving roommates and convinced who knows how many people that BK is innocent, in spite of all the evidence. Talk about poisoning the jury pool.

I agree with the poster who said he sped out of there because he assumed Dylan would be calling 911. so he sped home thinking any minute there would be breaking news..he would be on the phone with his mom when it broke..he would be like wow..turn on the news...wow! but nothing happened...literally nothing..he kept her on the phone for an hour....he drove back over there...nothing..

he must have been beside himself trying to figure it out..if it wasn't so horrible it would be funny.

I've been adamant about this for a long time now.

Let's put ourselves in his shoes (all MOO):

His plan dramatically fell apart. Killed 3 people more than we think he intended to kill. That's a lot of unanticipated violence. A lot more blood. A lot more unpredictability. Loud noises (thumps and furniture) one of which could be heard on neighboring cameras accompanied by dog barks.

Now we find out he might have sat down in exhaustion.

Remember, we'er starting to hear (IMO) evidence that Xana may have gone upstairs causing Kohberger to chase her (forgetting the sheath) which might have led to her death. His intention was to probably prevent her from calling the police.

IMO, when he made eye contact with Dylan he was likely shocked. Probably thought she heard and/or witnessed the entire thing and knew what had just transpired. So he high tailed it out of the neighborhood. And I believe that BF saw him outside of her bedroom window getting out of his bloody clothing while running to the car.

Lastly, I've always thought that his drive by the house that morning wasn't to bask in glory, or see a frantic scene of law enforcement and yellow tape.....

IMO, Kohberger saw Dylan and figured that she had most certainly called the police. So when the morning rolled around and he didn't see anything reported he drove by the house in utter disbelief (IMO).

I don't think it was in a "did I imagine the entire thing" sort of way (obviously) but I do think he was probably utterly confused, because again, he saw Dylan.

I haven't seen the other Dateline episodes, but were some of them death penalty cases? If not, I think that might be a significant difference.

I believe the new information came from the prosecution. The prosecution has been manipulating the public since day one on how the case is perceived. They said a lot of false confusing information. Which pointed the blame to other people. Remember jack S? I think this was done to confuse Bryan and to help with the investigation etc. But now that trial is coming, they are turning it around and releasing the evidence that points to Bryan. Because they want to undo the smoke screen from the past and start pointing the blame to Bryan, and keeping it fresh in their minds as the jury pool is selected. It's all a planned PR strategy, in my opinion.

I heard somebody connected to the case a while back say that, we're not done yet. This was said after some shocking information about the case just came out, like that Bethany and Dylan saw the guy leave out the back door. So I think he said that in terms of, not done with shocking information coming out. So in my opinion, I believe there's going to be a lot more shocking information that will come out at trial.

I have some guesses on what that is. I'm not sure if I can write it here cuz it's just my own theory. But I kind of want to, because then I can go back after trial and say, hey I predicted that. Maybe I will later. I'll write my grand theory.

I would be shocked by this. Bill Thompson has always struck me as an ethical, by the book/by the law prosecutor. I don't think he would allow this to happen under his watch.

MOO Since Xana fought she likely saved DM.
After silencing what he thought was going be a 911 caller (he was right) and then to find yet another person and killing them too, he may or may have not seen DM on the way out, but MOO his crime math starting to kick in and he did not want to repeat going after someone only to have more people and more fighting back, so with time ticking by and the chances of apprehension growing by the second he walked out.

I know that I, like probably almost all of you here, was anxiously anticipating the Dateline episode that aired last Friday, and I dare say that very many here watched it, and those that did not have likely seen bits and pieces, or have read of many of the new details that were presented. I have actually watched it more than once now.

Guess what? I have friends that know nothing of the upcoming trial. They couldn't tell you who Bryan Kohberger is if their lives depended on it. They may have heard about the murders 2 and a half years ago, when they happened, and have not given them a thought in at least the last two years. They do not watch Dateline, or 20/20, or 48 Hours. Many do not watch news at all on tv, local or national. I'll bet each of you has friends or family like this too.

My point is, even in Idaho, where probably people are, as a group, more likely to have heard of the murders, and some of the details of them, moreso than there are perhaps in other areas of the country, I still think there will be no difficulty finding 15 people who have not followed 100+ threads on WS, like a lot of us have, and have not heard or read everything we have, and can hear the evidence presented in this case, and render a fair verdict, based only on the evidence presented in this case. And when they do, to borrow a phrase that I see here often, its bye bye Bry. JMO

These murders happened almost 2 1/2 years ago. There hasn’t been any information released about any other suspect for 2 years. The PCA alone made it pretty obvious they got the right guy. I really don’t think the prosecution is busy violating gag orders because they accidentally convinced a lot of people that BK isn’t guilty. Jmo

In Boise, Idaho for what appears to be the final pre-trial hearing in the Bryan Kohberger case.A few big decisions left to be made about what evidence will be allowed, jury questionnaire, etc.Hearing is 9am local time/11amET tomorrow.

Call up a worried mom & dad after the killings & let know backerds 5’s can’t tie my laces is doing just great now - don’t worry mom & dad - I might have a change in plans. It wasn’t my car circling around the place. Dad, you still planning on coming out here for my ride home at the end of the semester? Creepy photos attached. Can’t wait to see the family & bring my baggage home to try & hide yet again. I have a new method for house cleaning you may find interesting - get extra gloves.

I have talked to my husband about this case and anytime I mention it he has no clue what I'm talking about. Same with my adult children. It's like I have to start from the beginning every time. So I don't bring it up with them anymore.

You think she saw him getting out of his clothes outside from her window? Why?

Same here. Voir dire could pretty much rule out the likes of us. I think the idea that this is prejudicial is absurd.

The trial cannot get here quick enough.

There seems to be a mountain of evidence on the Prosecution's side...but what does the Defense have?

The Defense will probably concentrate on:
1) The innate inaccuracy of cell tower triangulation trying to infer that BK was only on a road that passed near 1122 King Street on his way out to star gazing all those times. This won't fly. Especially when they show that it stayed that close for many minutes.

2) DM eyewitness testimony that is shaky with very little detail and that she cannot say as a fact, that the man on trial is the same one she saw in the house. Me: Yeh, like he had a mask on.... duh.

3) No physical evidence (DNA, hair, personal items) of the 4 students that were slain found in BKs car or (apparently) at his apartment. How could so much blood be shed with none found in his car or apartment?

4) How could 4 people be stabbed to death in only 12 minutes (or whatever it was)? Again... the Defense is not really rebutting the evidence... just postulating doubt in the timeline created by the Prosecution.


What else does AT have to work with???
We have yet to hear about the tip for an alternate suspect AT announced at the last hearing. Maybe she's gotten enough time now to research it.

"Kohberger’s defense aims to argue at trial that alternative perpetrators, and not Kohberger, are responsible for the crime. The defense team is still investigating a tip to police that it recently came across about a different potential suspect, Taylor said. “We have produced an expert that believes that it’s likely that there were two people, two weapons,” she told the court. Hippler ordered the defense to present an “offer of proof” of a specific alternative perpetrator by Wednesday if that is a legal argument they intend to make at trial."
It's after close of business now in Boise. I wonder if we will hear anything about this for a SODI defense.

Interesting idea that BF might have witnessed BK removing his kill clothes. I don’t think anyone else has suggested that and if it true, what an evidentiary treasure! Like video of Murdaugh at the dog kennel. OMO.
