Am I the only one having buffering issues with the livestream? It just started stalling a few min ago. Wondering if it's me or the livefeed.
No buffering issues on my end, however, audio isn't clear.

They send the discovery as soon as they get it. They said they are at about 95% for the discovery. They can't give the defense what they don't have...

I have  never met a case where the Dedense hasn't made that claim.

She just said she's hurrying to get through discovery. IMO she has a massive data dump and doesnt know what's in it.

The State IMO isn't going to jeopardize its case by purposefully withholding discovery critical to their case.

100% Defense posturing IMO.

Predictable.

Nothing more.

Says she can't say more about this alibi until she gets the discovery.

Says she has experts. But they can't be experty without CAST information.

Absurd.

The experts need to know where the State says the car was so her experts can... what? ... invent where driving-around BK drove?

The State is calling her out.

Taylor said genetic data is linked to how Kohberger wound up on police’s radar. IGG information contains sensitive material, state says. They don’t need access to all of it, according to deputy prosecutor Jennings.

Taylor wants info for a timeline to see how state put together its investigation. Judge is saying he allowed access to info that was potentially relevant. Contact with Kohberger’s family could be an issue, and it needs to be justified, he says.

Taylor wants permission to keep talking to Kohberger’s family. Her investigators need access to find out how Bryan’s name was first mentioned as a suspect. May not come into trial.

Judge says he’s been through all of the info. He’s not ready to grant full access to sealed documents without motions and hearings on this issue. Pulling people into case that have no connection is his concern.

State said from the very beginning that IGG info was not used to get the warrant for Kohberger’s arrest. Has to be sorted out, judge says, and he’s keeping an open mind. Defense needs to justify access to genetic materials.

Next topic: Supreme Court appeal filed by Kohberger. No info on whether Supreme Court is going to hear the case. Moving on to change of venue hearing scheduling. Taylor wants it in May. State is asking for denial or setting hearing closer to trial date.

Motion was to put everyone on notice, Taylor says. We should take care of it soon because trial is going to take a long time, and courtroom in Idaho needs to be secured, she told the judge.

Judge says it’s a sticky situation. Changing venue is something he’s been struggling with for months. He’s not really happy about setting trial in 2025. Affects families of victims, as well as defendant. Judge says he wants to be fair and realistic.

Thompson says end of summer this year would be OK with state. Discovery could be completed by end of August. Death penalty triggers multiple motions, he says. State has trial date suggestion, March 3, 2025.

State proposing discovery deadlines, and a pre-trial conference week of Feb. 6, 2025. Jury questionnaires to judge in November, and then he can assess venue issues. Taylor says death penalty case will require discovery in a timely manner, without having to fight.


Dragging info out is difficult, not Thompson’s fault, and she needs time to examine discovery and respond. Multiple agencies involved, including Moscow PD, Idaho State Police and FBI. Public nature of case - “people don’t want to talk with us.”


Taylor is opposed to March 3 trial date. She wants a hearing on venue in May. She says trial date is unrealistic, hoping for summer of 2025.



Prosecutor Bill Thompson says state is handing over discovery materials as quickly as possible. Deadlines are necessary to get this case to trial, he says.


Change of venue motion is premature, Thompson says. There’s publicity everywhere, more stories coming out of Boise than locally, he says. How it affects jurors is the main issue.


Taylor says massive amount of media coverage has an impact on potential jurors. By May, she will have a good case for change of venue. Trial has to be held in Idaho.


Judge says he’s curious and wants to hear more. Personally, he doesn’t want to go to another county for a lengthy trial, but he will do what’s necessary. Hearing set for 1:30 on May 14. Trial could still be March 3, 2025. Death penalty case adds a lot, judge says.


Alibi is Kohberger was driving around on the morning of the homicides. State wants a more detailed alibi so they don’t get ambushed at trial. Taylor says it’s more than Bryan was just driving around, but she needs expert investigation on cell tower information to be done.


Deputy Prosecutor says defense may be trying to look at discovery to form an alibi, which is not appropriate. Judge says he thought alibi was already complete, but he’s giving Kohberger until April 17 to provide more details. Hearing has ended at 2:18.

She (AT) seems determined to make the State reveal their case to her, which also does ALOT of the work for her. She's said that before, that she's going to rely on THE STATE'S EXPERTS in BK's Alibi defense. Boo....

BBM.. If he has stated his alibi and she believes it, then why can't she say much about the alibi until she has the discovery? Why does discovery have to do with HIS alibi? If HE is innocent, then where he was has nothing to do with the discovery. Interesting isn't it.

I'm not sure why no one is talking about this or addressed it head on. There is no remedy or recourse that helps BK. Not a realistic one anyway.

It seems like the media (and talking heads) are just as interested in dragging this along as the defense are.

I have a stupid question... why would defense need the autopsy x-rays? What could they possibly glean from them in regards to whether or not their client did or didn't perform the murders? What am I missing? Thanks.

The only point of it is to stall. She knows he's guilty, and doesn't want to try the case on its merits. moo

This is exactly what it seems like. They want to find a potential hole and put Kohlberger in it and use it as the alibi. That's why they are so interested in what there is aside from the IGG.

If Kohlberger provides anymore alibi detail and the prosecution discovers or provides evidence that directly contradicts it...thats a gigantic problem for him.

Good on the judge for giving them until April to provide more details to the alibi. It's time to stop playing games.

More delay tactics, MOO. Defense keeps proving they will use ANY reason to hold up this trial, IMO.

But the problem is...defense is waiting on the FBI CAST report for his alibi which they have been told they will receive about March 31st.

So the judge basically said ok give the alibi after you read the CAST report. He totally disregarded what the Pros said which is exactly what they are going to do...see what the FBI has then find a hole to plug BK in for his alibi.

What did you think about the "the video analysis that the state really likes in this case...I don't have the full scope of that video with audio..."

That line was super interesting to me. Particularly her going out of her way to mention the audio portion.

The first two that come to mind are the Linda Lane footage that's been reported on by Websleuths approved sources and the video/audio included in the PCA that captured the thump and dog barking. Both of those videos would be ones that "the state really likes" because they can establish the timeline. But I wonder if there's more....

Defense Attorney Anne Taylor muses about the possibility that exculpatory footage of BKs car exists in the discovery she's' in possession of because there's "a lot (of video) I haven't seen yet". Which was kind of the theme of her arguments today - whether it's time/resources or the prosecution holding out (her perception).

That was really SHOCKING to me. Because after hearing the defense proclaim that there's a lack of connections to Kohlberger I figured that was after going through all of the discovery. Especially the video feeds of the night of the murder. So now I'm wondering what else they haven't looked at yet.

I think there is more too. I don't know why the audio is important to defense though.

But give them a hole and they will try to plug it I guess. With BK being elsewhere...driving...with his phone turned off until it wasn't.

Do you think he has a list of certain noises that he remembers along his fictional drive? :rolleyes:

I'm being facetious but on the other hand this state, which I live in, could not successfully carry out a death penalty execution today. BK must have laughed outloud. :( How embarrassing.

I call BS on that claim. Grand words but nothing to back it up. That was the sound bite she wanted on the evening news....distorted of course.

Another thing that caught my attention since I am in my spare time my family and my DH's genealogist...and I work with DNA too...was the statement that the mitigation expert was working on BK's family tree and was at 3 generations.

But yet they didn't want the IGG info for the mitigation expert. I call that one an outright lie. They want to fit the unknown IGG relative on his family tree. Whatever...
