State goes first and typically lead investigator is called first to the stand. moo
Many times that's because the case started with the discovery of the victims, a 911 call to police that a body or bodies were found and first responders showing up to the scene.

This case was a disappearance first and a search to discovery. I'd think introducing the girl's and how the day at the trails began would be the logical starting point. I could be wrong.

I saw this really good point made about the hair allegedly found in Abby’s hand. The defense brought this up during Voir Dire, and not in any of their filings, to include their motion to dismiss.

That tells us all we need to know.
I'm thinking maybe it's a case of the type/quality of the hair DNA can't identify RA as the contributor but it can't eliminate him either?

I don’t think it’s even that. Even hair without roots can be used to develop a strong profile. I think they would have made mention of this in a filing “…victim had unidentified human hair in her hand.”
 
NO, I dont remember that they were.

they were told they would be during deliberation if they could not reach a verdict before end of the day.

But not during the trial.
Someone just reminded me of one juror bringing eggs to another juror so they had to be able to go home. I'd forgotten all about that.

And in the RL search warrant, it was stated that the victims showed no signs of having put up a fight/struggle. If she was found to have had a tuft of hair clenched in her hand, I would say that would be a sign of a struggle. I'm thinking just a stray, random hair that belonged to no one related to the crime.

What I mean is, even in opening, either side can allege things not actually established by the evidence. But when the evidence of the hair is actually introduced - and even the hair as an exhibit - we'll get the detail. I really see no point in speculation from the bare claim of the attorney, let alone a surrogate who supposedly knows no more than us.

This is the same as how you would not regard things alleged by Nick as "facts"

Friday is game on. The rest is hype IMO.

Very good point. Whatever it is, it’s going to be way overblown.
 
Jmo, an opening narrative concerning the heinous crime against both AW & LG and society and how RA acted alone. The DA will humanize the case. There is no doubt that AW & LG become easily relatable to the jurors. Tough case for jurors.

Of course, one narrative for the defense will focus on -- RA having no previous criminal history.

What I want to know: is his daughter going to testify???????

at this point I am thinking the hair is a red herring completely unrelated to the murders (possibly transfer from some event earlier in the day sleepover/borrowing a hairbrush/hoodie/that ended with the hair eventually ending up in victim hand during undressing/redressing or something of that nature)

I am content to hear what the state has to a say about that hair.

I don't trust the DT. They've played fast and loose too many times for me to listen to a word they have to say.

Yes they need to set the stage and get to know the girl's, a little bit about them, the victims, from family. Then their mood and plans for that day, how that progressed through drop off. MO
I imagine the D will tell the jurors a bit about RA as well - and I think they should. Mooo.

Delphi Murders trial is not in session today - tomorrow jurors will be sworn in then transported to their hotel near Delphi and given the afternoon to settle in. Opening statements are scheduled to begin Friday morning at 9!

Q: because they’re sequestered, have the tvs typically found in hotel rooms been removed ahead of time from their rooms to prevent them accessing the nightly news on this case? Many such tvs are “smart” as well, so wifi connected with access to Spotify / YouTube / Internet which would defeat the purpose of sequestration imo. So what will the jurors be doing while sequestered and not in the courtroom?????

I wonder that too. It is a pretty long time to be sequestered imo.

A gag order doesn't prohibit them from making arguments mentioning the hair in court filings. I'm sure the state has an explanation, as the defense would have used the lack of one to their advantage in pushing for a dismissal.

The way the defense attorneys work, it wouldn't surprise me if they didn't mention it in any filing on purpose, to save it for trial if the other issues didn't stop the trial. They're clever foxes.

I think in other trials, jurors have said that they read, play board games, etc. During the Casey Anthony trial, a juror wanted to watch some sports game and they were able to arrange that for them.
