Protecting other people from a potential threat doesn't mean you kill the threat when the threat is pinned to the floor of a subway.

This is a moot point because there were no members of LE present at the time JN was aggressively threatening passengers.

Had DP not been present, or had refused to act to protect the other passengers there could have been fatalities if JN had carried out his threat.
Key words: "could have", same reason police don't arrest people before crimes are committed. No one know if Neely's threats were anything more than angry ranting any more than posters claim to know that Penny didn't intend to kill him.

Daniel Penny didn't have a weapon. So he was an unarmed man defending himself and others on the subway. JMO.
His weapons were his arms, just like other people use their hands to strangle someone.

Just curious if you're aware of JN's well documented, violent criminal history?
Penny wasn't at the time of the attack. That's what's relevant.

I'm not sure Penny killed Neely. I see lots of reasonable doubt. JMO.
I don't. I see a man who was competently pinned to the floor on a subway car, held by a man trained in martial arts administering a chokehold for six minutes when it takes less time than that for a chokehold to kill.

What happened before the chokehold is not the question, imo, but what happened as soon as the defendant administered the chokehold and held around the victim's neck even as the train stopped, the doors opened, passengers left, other men appeared on the scene.

I see no reasonable doubts in the minutes the victim's lifeline was strangled by the defendant.

I'm somewhat disappointed he didn't testify. Although I guess maybe he's in the darned-if-you-do-darned-if-you-don't category on this one.

As we all know here on WS, it's usually not a good idea for the defendant to take the stand.

That's how Neely assaulted women. With his fists.
Anne Mitcheltree said she was randomly punched in the head in June 2021 by Jordan Neely inside S.K. Deli Market on 2nd Avenue in the East Village.
Law enforcement sources said that Neely had 42 prior arrests on his long rap sheet — most recently for punching a 67-year-old woman in the East Village in November 2021, which landed him in jail for over a year.

What's he got, sobs and tears?
He can't answer the questions he would be asked by the prosecution with that 30 min interrogation video that was entered as evidence.
The jury would see that he's a liar if they haven't already.

After reading what defense's expert witness said, I have reasonable doubt as well.
While everyone has a right to an opinion, obviously, the two experts testifying are clearly not in agreement.

If the experts don't agree, that's basically the definition of reasonable doubt for any rational person humbly admitting the experts know far more than non experts.

The victim isn't the one on trial here.
That's because Penny stopped him from carrying out his threats of violence against innocent subway riders. JMO.

The judge let both sides get most of the evidence in that they wanted the jury to see/know and if the "arrest warrant" and JN's psych record was in exchange for DP's 30 minute interrogation the prosecution won that battle big time.
The arrest warrant was no smoking gun but the video was.

Yes, he did stop him from harming others...and then killed him as the passengers exited the train to safety.

Totally preventable death. My opinion.
