Interesting that she chose to largely downplay the boat stuff theft/felony prong of the citizen's arrest law...expecting to hear more on it in rebuttal.

  • #203
State throwing a fit right now. She saw Sheffield's exhibits for his closing. Photos, drawing and items she was never provided that have never been entered into evidence. Drawing on use of force, etc.

Defense is trying to play "dirty" by painting TM as a great coast guard officer by showing his profile and training.

  • #205
"Everybody in this case had a gun, except Ahmaud Arbery."
In fairness to Roddie (claims he joined the chase on impulse, not out of prior coordination with the Ms), I believe his attorney presented credible evidence that he very likely does not own a handgun and was thus unarmed that day.

The evidence consisted of state records indicating that he has never purchased a handgun through an FFL. A significant majority, but not all, weapons are purchased through FFLs. These are tracked. Guns purchased via "private sellers" are not tracked.

Coast Guard student profile report (on TM) is one of the items, also some shots of his training manual.

State doesn't want them using his training in use of force because he wasn't acting lawfully so it's irrelevant to the case.

  • #207
Arrogant arse. Trying to slide evidence in sidewise has been his MO, but his arrogant snipes at LD are new Maybe he's getting nervous how this going for his client Travis.

  • #208
defense wants to show images of his own notes taken during testimony.

State says this is improper.

It is so freaking disgusting- I don't think I will have the stomach to watch the defense closing - all BS-- what has his coast guard training have to do with what he did on 2/23? NOTHING

State: If #AhmaudArbery hadn't been pinned between two pickup trucks on Holmes with Bryan running him toward the white truck, would he still be alive? Yeah. They put him in reasonable fear and that contributed to where he ended up and his death. Felony murder.

State: After 5 minutes he's still running away from them. Hey stop, we want to talk to you. They're trying to falsely imprison him. Putting him in fear with their actions. Bryan actually runs him into a ditch. Aggravated assault. #AhmaudArbery runs away from them, runs away

State: Malice murder, caused death of another person unlawfully with malice aforethought. No premeditation is required. It's intention to kill without justification. Justification is self-defense

State: You may also find malice where there doesn't appear to be significant provocation and circumstance shows abandoned & malignant heart. What is that? You just don't care. You do what you want and whoever you're doing it to better be OK w/it.

State: I'm going to order you to stop & talk to me and if you don't, I'm going to pull out a shotgun on you. And hey, you're still going to run? Oh yeah? I'm gonna come at you, intercept you at the corner. How dare you turn on me? BAM! Malice, right there

Travis.jpg

State: Remember Mr. #AhmaudArbery had to have engaged in significant provocation. What did he do? He ran away for five minutes. That's what he did. Hands out at his sides in those baggy shorts. No weapon, no threats, no way to call for help, for five minutes.

State: How could Bryan be held responsible when he's filming all this? How can Greg McMichael be responsible when he's in the back of the truck when the shots rang out? It's called party to a crime. Someone who encourages, enlists, or helps should be held responsible under GA law

ADA8.jpg

State: What's enlisting, advising, encouraging? Hey Travis, get your gun, that guy is outside--not, Hey Travis I need to call 911. Advising: Cut him off, cut him off! What Greg McMichael said.

State: Ladies and gentlemen how do you think about this? Everybody gets a Super Bowl ring. The quarterback, and the guys on the field, and the guys on the bench. Everybody's involved, everybody's responsible. That's what the law says.

State: Bryan--cooperation after the fact doesn't erase the crime you committed. Bryan did film the murder, gave it to police, made statements. So what? You're still responsible for your actions. Now, let's transition to citizen's arrest & self-defense

State: Travis McMichael had to reasonably believe it was absolutely necessary to defend himself--and he threw in his dad, which he never mentioned before--against imminent use of unlawful force. That it's life or death right now! Guess who it applies to? Everybody

Travis2.jpg

State: There's no exception because "I was in the Coast Guard." Reasonableness is set by society. You decide--reasonable or not that Travis McMichael had to defend himself with lethal force. Where's the imminent use of lethal force by #AhmaudArbery?

State: #AhmaudArbery is just running away. Look. He's not even up to those mailboxes, & that's Travis McMichael pulling that shotgun out. He's going to say, "I could tell he's running toward me and was going to attack me!" Is that reasonable? Who brought the shotgun to the party?

Travis3.jpg

State: You cannot create the danger to yourself. You cannot be the unjustified aggressor, create the situation and then say, I was in danger. He attacked him! And I'm not talking about Mr. #AhmaudArbery attacking Travis!

State: You're not justified--you're guilty if you use excessive force because it exceeded what's necessary. You can't bring a gun to a fist fight. You don't get to say Hey let's step outside, and when he's better than you, you pull out a gun.

State: Ladies & gentlemen, these defense attorneys are GOOD. They're going to get up here and make this seem like Oh yeah, this is scary and Travis McMichael had to pull out a shotgun on him. Put on your critical thinking caps and use your common sense.

State: The amount of force has to be reasonable. Unarmed man running with hands at the sides, never pulled a weapon, never threatened anybody, this is completely excessive force.

Travis4.jpg

State: You can't start it with your driveway decision, unjustified because you didn't see a crime committed that day, and then say I acted self-defense. What's their justification? We wanted #AhmaudArbery to talk to us & he wouldn't so we tried to force him & then we killed him.

State: That's really what they're going to tell you. They'll probably make it seem much more palatable & OK but that's it. You can't provoke someone into defending themselves against you so you intentionally harm them, then claim self-defense.

Travis5.jpg

State: Three on one. Two pickup trucks. Two guns. Unarmed. Mr. #AhmaudArbery was unarmed. I don't know what they're going to say. The defense attorneys are good. The State's worried they'll make it seem so reasonable--everything Travis & Greg did.

State: They'll say the victim started it. Remember Greg McMichael said he was trapped like a rat. Or they'll say this is about the front of the pickup--try to make it seem #AhmaudArbery attacked. Doesn't matter. They weren't committing a citizen's arrest or in real fear of Arbery

State: The bottom line: This was an attack on #AhmaudArbery. They committed the crimes, the 4 felonies, they attacked him, they shot and killed him. They can't claim self-defense because they were the initial unjustified aggressors.

ADA9.jpg

State: You think all this was completely made up for trial, since no one ever said it on Feb. 23, 2020? Use your common sense. Put your critical thinking caps on. That's all the State can ask you to do. Ladies & gentlemen, I give you the defense.

To imply his suspicions about AA weree well founded, because he was a mechanic in the CG?

He was armed with a motor vehicle which he used as a weapon. He also knew that the others had guns. MOO.

his training gave him muscle memory (TM) - barf

Control techniques, blah blah blah. Use of deadly force. TM tried to educate you all about these things. What gave him the right in CG to inspect, seize, etc.

None of which is relevant in the commission of your client's felonies.

  • #217
TM taught us about using a weapon for de-escalation. (that didn't turn out so good for Mr. Arbery there did it Mr. Sheffield?)

Kids won't play after dark, nobody will walk at night. Yep here it comes, TM was the lone hero out to save the poor victimized neighborhood.

What muscle. He is fat and soft, especially at the time of the murder.

We have six hours of this kind of attack on the truth & sensibilities to endure. You may need to pace yourself, tlcya. ;)

So because there have been instances of crime within the community within the last 10 years, means you get to shoot and kill someone?
