Knowing what he said (for example about wealth versus having less, about specific books, asking about the media, etc.) will be relevant when it comes time to discuss his motives.
JMO.
A motive isn't required for a conviction, though. I guess it might make it easier.

Back after lunch, Officer Detweiler back on the stand. The state asks him if he reviewed all BWC from all officers at the scene that day. He did, and confirmed accuracy. Detweiler confirmed he kept all recordings as business records, and all are now entered into evidence. Karen Agnifilo stands up to question Detweiler about the footage, and asks that the large expanded Mark Rosario NJ license display be taken down.

Karen Agnifilo asks about B4 and B5 camera footage- was Detweiler present? He says he doesn't remember, and looks at the screen in front of him, before answering, "No I wasn't." Defense now objects to B4 and B5 as to this witness, overruled. Marc Agnifilo wants it on record that these are "not business records."

The state offers more BWC footage from other officers as business recordsl. Side Bar. Judge says that any footage that does not contain Detweiler, the state may not question him about it.

More BWC is played from the McDonald's at 9:57AM; Officer McCoy appears to be clearing a table. McCoy says something along the lines of "we're arresting him for forgery." We are watching a new angle of the officers searching his person; I believe we will be watching new angles of the BWC for a bit.

We're watching BWC from 10:10AM, Mangione exiting a squad car and being walked into the police station. Once inside the intake area, Mangione is asked to take off his shoes. There is a desk shown with forms and some plastic bags. We see Mangione standing facing the wall, still cuffed. Another officer empties the contents of the beanie on the desk. We hear Mangione say something about the police having his passport, it was in his bag.

Detweiler indicates they were in the holding area for a few minutes. He asks Mangione if he's right or left handed, and says this is standard to ask. He is right handed.

Evidence is now being shown on the screen (with an objection from Karen Agnifilo as Detweiler couldn't previously identify select items):

The Altoona PA Police Criminal Complaint is now on the screen, with Mangione's address redacted. Detweiler describes it as standard. We see the charges: Forgery, Firearm Carried without a License, Tampering with Records for Identification, Possessing instruments of a Crime, False Identification to Law Enforcement Officer. Detweiler confirms these charges were ONLY in PA, and not for NY.

Detweiler confirms that he did not receive any direct information from the NYPD, everything he knew prior about the case and suspect was from Fox News. The State is confirming the department followed all protocol when it came to the arrest, search, etc of a suspect. The "Search and Seizure Procedure" policies are displayed on the screen, and Detweiler is reading from it.

The "local restaurant" referenced here is called Luigetta's, by the way. Detwiler just clarified.



On cross, KFA is asking Detwiler if he "strategically placed" himself to block Luigi from leaving.

"I didn't strategically place myself anywhere," he says. "I just stood there."



KFA is insinuating that Detwiler was trying to fish for information about the New York shooting. He asked Luigi about New York 3 times.

KFA: "You wanted to get more information about what he was doing in New York?"Detwiler: "I know what he was doing in New York."


Detwiler said he lied and told Mangione that the cops were called because he had been sitting there for too long -- not because he looked like the NYC shooter.

KFA asks if Detwiler was also lying about the steak breakfast sandwich being his favorite.

"No, that's true."

Cross Examination of Officer Joseph Detweiler, 3:31PM EST, by Karen Agnifilo.

Agnifilo: You testified earlier about not getting a search warrant, correct?


BWC footage is displayed from 10:03am at the McDonald's. An officer's voice can be faintly heard saying something about "getting a search warrant for it." Detweiler confirms he heard it. State objects because Detweiler isn't present in the footage. Judge lets the answer stand.


KA pulls up the Altoona Criminal Complaint. She asks who signed the complaint, and Detweiler says DA Weeks. KA asks him to read the charges, and asks him to confirm that Forgery is a higher crime than Unlicensed Firearms. He confirms. KA reads from the bottom of the complaint about falsifying statements to police, and asks why Mangione was charged with that when Mangione told the truth when confronted. Detweiler says he was told to.

KA brings up the text from Hanley about promising him a hoagie if he takes down the NY Shooter (paraphrasing). She confirms this was done over text, not by dispatch. She also confirms that he didn't use his lights or sirens when driving to the McDonald's with his fellow Officer Frye. KA asks if they pulled up a picture of the suspect before they arrived on scene or discussed any strategy. He said no, because he didn't think it was going to be him.

KA asks about the entrances to the McDonald's and the layout- the front entrance doors and the side entrances etc. She asks if he spoke with anyone upon arrival- did he speak to any concerned customers or the manager who called 911? Did he need help identifying? He said no. He said he was the only one in there with a mask on.

KA confirms that Detweiler walked straight to the back and knew within 2 seconds of Mangione pulling down the mask, he "knew it was him." He says yes. She points out the layout of Mangione's table, and that there was an "opening" next to the table, and Frye stood there at Detweiler's direction.

KA asks if this was so Mangione couldn't get away? He says he's not sure.

KA: Did you stand there to block him once you knew who he was?

Detweiler: Well, we needed to stand somewhere and we weren't going to stand there and hold each other's hands.

KA: So you strategically placed yourself there so he wouldn't leave?

Detweiler: I didn't strategically place myself anywhere.


BWC footage is played from the initial interaction between Officers and Mangione at 9:29AM.

Now we're at 9:30AM, and Detweiler has asked Mangione where he's from and if he's been to NY (after Mangione handed over a false ID). KA confirms that at this point, they have no idea the ID is false and that the "loitering" complaint was not accurate; they are just having casual conversation. Detweiler says he wanted to see how he reacted. There is an objection to KA making "comments," and Judge says he thinks "counsel gets it by now, no comments." Detweiler tells her "she's doing great" after she tells him to feel free to clarify anything she is unclear on.


BWC footage continues to play, at 9:31AM, KA points out that a brick wall outside appears to be curved, but it's just a camera distortion and it's a flat wall- not curved. We can hear Detweiler speaking to Hanley saying, " Tom it's him. I'm 100% sure it's him. Why don't you come out here, Tom?"

We now see footage back inside the McDonalds. KA points out an employee going into a supply closet of some sort to Mangione's right. KA points out we heard the 3rd time that he asked him if he's been to NY. Detweiler says it was the 2nd time. She points out that Detweiler and Frye are on either side of Mangione. We hear the Officer tell him about the loitering policy, and KA says, "But that wasn't true right?" He says he actually doesn't know if they have a policy.

BWC at 9:41AM shows Detweiler moving the backpack behind him. KA points out the Narcotics Officer in the corner view who signals for Detweiler to "pat down" the suspect. He confirms and identifies the other Officers in the footage. KA asks if Detweiler saw a customer leave the restroom casually at 9:42AM- he says Yes, Ma'am. KA then points out that Detweiler then says "McCoy" 3x, to come and replace where he was standing so he could step outside. He says yes. KA asks...Because you were strategically standing there???

Detweiler answers yes. KA then asks him to identify the officers in the footage we are viewing. KA asks him if he knows the distance, wall to wall at the McDonald's. He says 6 feet. She says, would it surprise you that it's 13 ft? He says, oh, wall to wall- "I thought it was table to backpack." KA notes that Mangione is about 10 ft from the backpack.

Mangione is shifting his head between watching the BWC, and then watching Karen Agnifilo question Detweiler. Sometimes he even changes his position to get a better view of her. Now he's taking notes as the BWC continues to play from 9:48AM on, when an Officer asks him about why he gave a fake name. KA asks "Was that to better gather evidence?" Objection. Sustained

Detweiler: Yes

KA: At 9:50AM, we see another customer walking towards the bathroom correct?

You weren't worried about not having control of the place because 10 Officers were there?

KA: But differently than when you did it, correct? His hands are on the wall, and you had his hands on his head?

OD: Correct.

KA: At 9:50:06, We see Officer Fox placing handcuffs on Mr. Mangione. We see three officers behind Mr. Mangione, correct? And other officers in the area?

OD: Correct

KA: I believe you testified during direct, around this time, that Trent and Hanley had been communicating with the NYPD.

OD: I think they possibly already had been.

KA: And with the DA's office about the possible false ID charges, correct?

OD: Correct

KA: And do you know if they were trying to contact the FBI?

OD: Yes,I believe they were trying to contact the FBI.

KA: And that's what they were talking about when all huddled around the trash can?

He is not sure.

KA points out another customer leaving.

As we watch more BWC, KA points out that at no point was Mangione given back the NJ ID. Detweiler confirms that to be correct. BWC follows Detweiler and Fox outside where they discuss being 100% confirmed it's the NY Shooting Suspect. KA points out another female customer walking to the restroom. She pauses when it's 9:53AM, and points out that more officers have arrived- Detweiler confirms about a dozen at this point.

KA asks about a red light on their BWC. Detweiler says yes, the red light turns on when it's activated. You can see when it's on or off.

KA brings up that Detweiler was made an honorary NYPD Officer because of this arrest, and asks if he was proud.

"To me, this is another arrest."

KA: You posted on social media, yourself getting an award by the NYPD.

OD: I didn't, my wife did.

KA: Fair enough.


KA confirms that when Detweiler has Mangione cuffed in his squad car, he does not speed, nor use lights or sirens. We hear the Officers speaking in the car, saying "The fake name was ridiculous." Apparently, Mangione said something to them prior, but Detweiler doesn't remember.


KA shows via BWC, that Detweiler parked significantly far away from the entrance to the precinct. "Just like McDonalds, you felt like you had everything in control?"

OD: Correct.
