Something occurred to me. If the killer was heading out the back door, he was likely in a hurry. I don't know about anyone else, but I often take a second to register something, like he might have turned the corner into the kitchen before it registered that the door was cracked open. For the first time, the state is alleging that Kohberger’s phone was in fact turned off during the murder window. This is a departure from the AA, in which they said it was not communicating, or something to that effect.

So the thing that's the same as the one thing and is another thing but isn't really a thing at all.
No amount of discovery buried in the terabytes was going to give BK a magic alibi. Oh, how AT tried. She firm up the alibi once the State turned over discovery she couldn't quite name, she tried to sail this toothpick; BK couldn't be "over there" because his phone was "over here" somewhere. Guess she thought maybe the judge never heard of criminals turning off their phones.
Sy Ray's theoretical exculpatory data points just got punted.
I mean I knew BK didn't have an alibi -- or she'd have lead with it -- but everyone should take note of how both AT and Sy Ray represented themselves in front of the judge in a hearing she wanted streamed.
So now we're supposed to believe BK was driving around in his Elantra in all the places where there are no cameras, with his phone intentionally turned off and that's his alibi? While a different Elantra looped around 1122 and somehow delivered BK's sheath, at the scene of a quadruple murder? In the hands of someone who looks like the defendant?

I actually saw that episode on Criminal Minds, maccabre storyline with twins Wallace and Jesse Hines, separated young.
But I'm pretty sure BK's mom would remember a thing like that, a second baby.
It's worth noting -- in that episode, both twins were played by the same actor.
And that gets us a little closer to the truth. BK and his 5 octillion to 1 imaginary twin are one and the same.
Alibi falls flat.
Sy falls flat.
No guilty? Flat chance.

I agree. Even though he is surely smart enough to know he isn't going to walk free, I think BK is looking forward to his time in the limelight. Even if he never takes the stand, and I feel certain that he will not, he will still be seen, and he will be recognized by some who never gave him a glance, and he will probably have groupies, and he will be a lead story on the nightly news for three months. The world will know his name and face, and he will be talked about in the same breath as some of his idols. He will be infamous, which is as good, for him, as famous, maybe better. No way he would plead guilty and miss out on all of this. At worst, even when he is convicted on all counts, there is a reasonable chance that he will end up with LWOP anyway, as some juror may be unable to pull the proverbial trigger on a firing squad, so he may as well make the state work for it, and if he does happen to get the DP, well, that can be tied up for years in appeals. Bring it on, he is ready for his close-up, eyebrows and all. JMOI don't think he's going to take a plea. He's going to see this through until the very end

Most.Most guilty defendants are absolutely terrified of the DP when it is up close and personal right before a trial with overwhelming evidence against them. The DP attorney's biggest job is to keep their client off of DR.
