I dont understand what AT is trying to get at? If his autism makes him devoid of understanding the consequences of murder then that is an aggravating factor.

I didn't see him when he entered, are BK's hands shackled?
Doesn't look like it. He was taking notes while AT spoke about his autism, and his hands didn't appear to be restrained.

AT: people said unkind things about BK but those things he did make sense in the context of his ASD. Standing as he does, staring too long, etc.

Judge says it's a jury instructions.

But AT thinks the State will overrun it during the aggravating stage, using BK's behavior against him because it's a function of his condition.

State : BK doesn't have a right to have his family in the courtroom.

Judge asks the State to call family members right away. State only intends to call a few family members....

Judge is looking for accommodation. Call them upfront to testify so they can be present for the remainder of the trial.

State says the D shouldn't be able to dictate how they present their case (order of witnesses, etc).

D trying to use the right to a public trial to cover the right of his family to be there....

D sppeals to the judge's humanity. Says the family is devastated because of headlines that they're going to be called as witnesses.

Judge is going to take it under advisement.

They are exactly right. During the trial for Patrick Frazee, they had their order of witnesses perfect! First they brought in his mother, and all she did was say I plead the fifth I plead the fifth I plead the fifth.... when they brought in the other Witnesses, the behavior of how the mother acted made Frazee looks so guilty it was unbelievable.

It was a work of art!

Broader than that! That BK is so peculiar the D wants the State NOT to present examples of BK's weird behavior to the jury.

State does not intend to put forth mental health/illness as an aggravating factor until or unless it's opened for Rebuttal. (During the DP phase)

AT: BK didn't ask to have ASD. BK sits rigid, speaks longer on topics, holds his hands a certain way, etc.

AT says that the State shouldn't get to use BK's condition and behavior against him.

Judge says he can issue an instruction during the penalty phase.

BK used the victims condition against them. They were drunk, and he knew it, which caused them to hardly be able to fight back. 😡

How is AT going to convince the jury that BK is somehow part of a protected class ... when he's a PhD student who was living and functioning alone? We can just explain away all his behavior??

This is likely true, and in a different context would be sympathetic, but the man is not on trial for standing too closely and staring too long.

To state the obvious and already oft-stated, he was able to live alone, drive, attend school etc. We know he knows right from wrong by his attempts to hide his crime.

This doesn't really answer my question of if he was actually diagnosed. I know his attorneys are claiming it but I was just wondering if anyone has seen an actual doctor diagnosis.

Okay did I hear that right? The defense has had 2.5 years to investigate other potential suspects. Yet they don't know who their alternative suspects are 4 months before trial?? 😡
