Interesting. BK wrote during at least one of the hearings I watched.
Maybe it was a new rap song to follow up on the one he previously uploaded to Soundcloud so many moons ago.

Do you think if Xana heard somebody upstairs, she's going to yell, someone's here? She would probably think they were like Kaylee and Maddie's guests.

I think it's more sense that Kaylee said someone's here and went to get the doordash.
Not if Xana saw the door open too. She’d put both things together.

Discussion apparently alluding to the Dateline broadcast was apparently held behind closed doors prior to the televised hearing beginning.

Judge is entering orders for both sides in order to retain records re: violations of the non-dissemination order. He's open to a request for the appointment of a special prosecutor and that special prosecutor would ask for a special magistrate so they had to power to subpoena and to question people under oath, grant immunity, etc.

He’s taking this alleged breach of the gag order very seriously.

Yeah, because what can he do, besides sit there and seethe silently. It isn't like AT is gonna jump up and shout, "I object, your honor. My client says that wall isn't exactly right. You can't see into that bedroom when you first get down the stairs". JMO
Oh I WISH he would say that in court! It would be such sweet justice.

I notice I accidentally misspelled his name in my post you replied to. I bet BK has to deal with SO many inaccuracies during this long process.

And having to just listen to other people talk.(Especially AT!) Maddening.

To me the two most important things were him basically keeping a murder scrapbook on his phone, and the click history beginning two days after the murders, and one day before we heard about the Ka-Bar. Absolutely damning.
RE: Dateline: These were very big moments. The number of times the Elantra circled the house on King Road was also pretty damning.

But they can't subpoena the Press... so that's the end of that.

I do believe LE have him dead to rights, and I wouldn't be surprised if BK's defense knows this.

From the Dateline episode : Disagree with the defense saying that like (paraphrased), '...like a house of cards & if one falls the rest will tumble after'.
One wild card ('new' evidence) is not going to negate the other evidence; and this case isn't a flimsy house of cards.
Ridiculous.

I didn't care for the way the defense seized on the fact that the roommate said (about BK's photo) she didn't know who that was.
He had a balaclava on, and only his eyebrows stood out.
For her, seeing his entire face in a photo lineup would've been different, and in a way that can be used for the prosecutor's benefit, as Brian had never been to that house nor did he personally know anyone there !

It's going to be difficult for the two survivors to be on the stand as I fear the defense is going to attempt to debunk their testimony.

BK built a puzzle, with each interlocking piece adding to the final outcome.

And as far as his recent diagnosis, imo there are high functioning autistics who do know what they're doing and can discern right from wrong.
Thinking from earlier threads where BK was using gloves to dispose of waste at his parents, and the clothing worn during the murders -- why throw good clothes away, Brian ?

Because BK murdered them, we are missing the testimony of KG and XK, as witnesses. Quite possibly by his design.

But if they could testify, think of all the details they'd have.

Were EC and MM awake, to any degree?

Did Murphy alert at 4 am or 4:10 am? Or both?

Did any victim ascend or descend the stairs?

Was XK at any time in the bathroom? Whimpering, crying? Or did the wood floor carry that sound, from XK on the floor?

Based on layout, the bathroom is just before XK's room, why did DM think that's where the crying was coming from? Was it?

What did XK see, hear, notice? Where was she when she encountered BK? Did he catch her by total surprise? From behind?

Did she see him attack EC? Did BK inflict leg injuries to EC to render him immobile? Did he inflict an injury to EC's chest/neck that was lethal but not immediately fatal, left to bleed out?

To whom did BK say it's okay I'm here to help? And where did it fit in the timeline?

Did XK hear the upstair roommates bring murdered? Was it drowned out by TikTok? Did she see KG, exchange any words with her?

What if anything did BK take with him when he left? What was he carrying? The knife?

Today was somber.

Counsel, on notice, he's not messing around.

It's getting real now.

Ok, so I have a soft spot for JJ. He's in a rural area some 6 to 8 hours away from Ada County where there are not an ample number of judges in the Idaho panhandle, especially if he was taking over for another judge in a nearby county because of conflicts of interest or whatever. He knew the resources, local infrastructure, etc. were going to be stretched thin and the fact he was on the brink of retirement. He did the right thing as to his handling the change of venue decision.

Frankly I am also glad the venue was changed so the town of Moscow did not become another side show where people were bothering kids coming back to school at Idaho and WSU, flocking to the 1122 King Road site, etc., etc., given a reheating of the story and attention if the trial was still going on into August and the early fall.

Xana could have seen a change in the kitchen that implied that someone had entered the house uninvited, as previously speculated here (part of BK’s kill kit, an open slider, etc)

Yep, and should there be a knife, it literally could be used to spread said icing on said cake.

Even though I firmly believe the knife is swimming with the fishes at the bottom of the Snake River along with the rest of his murder kit he hurled off the Red Wolf Bridge when he took his little Sunday sojourn down to the LC Valley.

Yes.
Like the jurors, witnesses are summoned to the court for a duty without wrongdoing or a court related official capacity of any kind.
The police, the D and P attorneys, clerks and the judge are all officers of the court.
I see a distinction on the type of public exposure each should be exposed to.

Nope, he mentioned security reasons and dangerous weapon, which couldn't possibly be a leather sheath...

Maybe it's A knife that was seized in PA, but maybeeee it's THE knife! I dunno, huge part of me thinks he buried it somewhere with whatever other little souvenirs he snatched up, but who knows.

I'll need to rewatch when lives over, but he deffo said stuff about chain of custody, dangerous weapons and security and something about there not being a gun in this case but "the knife will be in a display case"

Sheath could work as an icing spreader too. It's big enough and sturdy enough.

What a complete dips$*t leaving that sheath. If I were a Desales University stakeholder of some sort, I'd seriously be re-thinking the degrees BK earned there.
