The table appearing in AT’s motion is disgusting as it presents for mitigation purposes every possible factor for his alleged criminality except his own free will. His supposed autism alleged on the shallow basis of social awkwardness and upside down or backward letters (fairly common as youngsters learn their numbers and letters…adults imitating children writing do that), late progress at shoe tying, an auto accident when he was a child. It is like AT has mined BK’s parents’ likely agonizing and unwarranted blaming of themselves - what did WE do wrong to make HIM this way - for the choices BK has made.

AT should add a row at the bottom of the table “evades responsibility for his own choices and actions.” And then delete all the rows above that.
 
Just wondering, will we ever hear the results of the investigation into the source(s) of these leaks in this case, or will they just be dealt with by the court without us ever knowing, assuming they do not involve any key members of the state's team or the defense's, and I cannot imagine that they would? I suppose if charges are filed against anyone, it would be public record, and could be found in a search, if someone knew when and where to be searching? Any thoughts as to how long that investigation might take? IIRC, Judge Hippler wanted the names of anyone with access to information leaked to Dateline within two weeks of his May 15 ruling, so the court has likely had the information for about two weeks now. Will that investigation necessarily have to be concluded before we move on to trial?
What a great question, nosey me definitely wants to know as well.

Joking aside, it was a substantial leak of info. I think it will be from a number of different sources not associated with the actual Prosecution or Defense.

Even with this it won't work, juries are down to earth people and generally don't fall for lame excuses.

BK has no chance of an acquittal or even hung jury IMO.

So, I guess anyone who was ever involved in a car accident as a child should get a free pass to commit quadruple homicide? JMO

Again, who cares because it doesn't establish guilt or innocence.. ONLY MAY matter to the death penalty part or more likely to sentencing. Premature for sure.
For all intents and purposes, AT has probably already conceded the guilt phase of the trial is a lost cause, and is focusing all of her energy on keeping BK from facing a firing squad. I would be, if I were her, and even that may be a lost cause too. JMO

I agree that the jury won't be swayed by various mitigating factors during the guilt phase of the trial, but I do think that it is possible during the penalty phase of the trial. I think there will be juror(s) who may not be comfortable with sentencing a defendant to death by firing squad if it is presented that he is on the spectrum, etc. I think a life sentence is more likely that than death penalty in this case. JMO.

I'd be SO very disappointed with just a life sentence, mostly because he'd probably like it.

AT is spending so much time looking for “reasons” to exonerate Bryan’s actions, all while claiming he didn’t kill anyone. (So why is she searching for past trauma if he is just a good boy)?

He isn’t on trial for being on the spectrum, he is on trial for a quadruple murder, yet she persists in finding “reasons” that she will try to turn into “excuses.”

Not cheering for anyone to be in a car accident, of course, but if he was traumatized somehow in an accident, that is still not an excuse to mass murder some young people.

People have survived the Holocaust without afterward murdering innocent people.

People have survived living in abusive homes with dangerous parents, and from what we have learned about his family so far, they seem to have been very supportive. Even as an adult, with dad ferrying him home cross-country.

We here have all become familiar with cases in which the evidence is undeniable.

Just in recent cases—-Murdaugh at the dog cages, Libby recording Richard Allen on the bridge, and Bryan Kohberger’s DNA on the knife sheath.

These criminals have been caught red-handed. There is proof that they didn’t intend to leave behind, but which puts a bulls-eye on them.

Cannot wait for the trial to start. Nor for the judge to lay down the hammer.

It’s all in Table I, attached at the end of the State’s 17-page objection to AT’s 40-page Motion to Continue. I’d post images of the table here, but it’s multiple pages long. 🙄

The table addresses all the things AT has already done (or can easily do without delaying the trial) to meet the ABA guidelines for mitigation in death penalty cases.

The only reason that I can think of a car accident being relevant is if BK sustained head trauma. I assume AT would then use an article like this one to support her case:

The problem with saying a TBI can cause a neural or behavioral defect is that it’s hard to tease out which came first. For example, individuals with untreated ADHD may be more likely to impulsively engage in activities that have a higher chance of brain injury.

Anyway, the article is excellent, IMO, and worth the read.
