Judge just said defense request that Kohberger be allowed to wear street clothes will be taken up at a later date.

He’s asking state and defense to be professional during proceedings. Stakes are high, but attorneys need to adhere to their oaths.

She's pushing back on the June, 2025 trial date.

New discovery and an expert passed away.

Anne Taylor is addressing the June court date, now expressing concerns about the vast amount of discovery to sift through.

She says there's 398 GB of discovery.

She also says an expert who they were working with has passed away, and are working with a new one.

New Kohberger judge says non dissemination order (gag order) remains in place and he expects it to be "religiously adhered to." Says he will not tolerate violations to gag order.

Prosecutor Bill Thompson estimates Kohberger trial 1.5 months for state’s sentencing side. Taylor will need 4 to 6 weeks. In other words, it’s going to be a long trial. Set for entire length of summer 2025, which concerns judge.

State says month and a half for their portion...

State says Defense has said 2-3 months. AT estimates 4 weeks for her portion.

Total, 10 weeks.

Now asking for penalty phase estimates.

State estimates a week. AT estimates two weeks for her portion.

Sounds like Judge was wanting to move the trial back to May.

He's concerned about a trial that runs all summer. Might be hard to seat a jury.

Two proposals: start first week of May with trial and start the penalty phase in September.

State prefers May.

AT advocates for September for trial.

Judge concerned about having the Kohberger trial in the summer - thinks it will be harder getting jurors willing to give up their entire summer. They are discussing other options.

Judge has a concern about the Defense and their deceased expert.

AT does not want to disclose more about the nature of her expert.

She has replaced that expert. Believes she cannot meet the deadline for expert witnesses. Continuing to push.

AT's expert is a mitigation expert. Deadline is in March.

Judge feels that's ample time -- March is a long time from now.

AT asks for an end of April deadline. Because times passes quickly.

Judge Hippler proposes two alternative start dates because a trial beginning in June could pose difficulty for jurors, particularly those w/ children. Hippler proposes May 2025 or Sept 2025. Prosecution wants a May start date. Defense asks for September bc an expert passed away.

State requests the ex parte hearing for a judge to make his determination. In lieu of/before simply moving the trial start date.

AT has a flight out today.

Ex parte hearing will happen after this hearing before determining deadline for this one expert, relative to trial date.

Trial date will be taken up in ex parte hearing after this hearing. That's where one party - defense in this case - will be meeting with the judge. There are questions Anne Taylor didn't want to answer about this specific expert, who she says will present during mitigation phase.
