Not Ripe.
Yeah, the Daily M report is misleading and uninformed, full of irrelevant innuendo and short on facts.IMO.

Dr Wolf may appear on November 7th as defense witness in support of D's motion to strike DP on grounds of vagueness in balancing mitigating and aggravating factors. Imo it's not certain judge has over-ruled state's objection yet; if court rules in favour of state after hearing argument on Nov 7th, Dr Wolf may not end up testifying in support of that motion (although approval to appear by zoom, If she does end up testifying, has been granted).

DailyM goes on ad nauseum re Dr Wolf's role in OJ's defense at guilt trial, and then misleadingly via omission conflates that with BK's guilt phase trial, as if Dr Wolf has also been hired by Defense for comparable reasons in this case. Such a load imo and a good eg of a new misleading and sensationalised media report that may subliminally affect the impartiality of the Ada County jury pool. Moo.

State's objection to Wolfe giving testimony on Nov 7th

@jepop Thx :) for linking ID's Objection to Expert Testimony from Dr. Wolf and pointing out inaccurate news coverage.

Daily Mail. Sigh.

From ID's motion:
"...Defendant’s method of execution claim is not ripe for judicial determination...."

I'm old enough to remember the trial but did not immediately recognize her name. So I looked up the transcripts.

It looks like a large part of her contribution was focusing on the mistakes that the medical examiner's office made that in her opinion resulted in a incorrect time of death. Which helped the Defense tighten the window in which OJ could have committed the crimes.

I'm not saying that Kohlberger's defense team is going to rinse and repeat and use her in a similar way. But the parallels are interesting...

Two summers ago BK's defense (through court filings) was clearly suspicious of a car LE initially identified (white Sentra if I recall correctly). Which was caught on camera much earlier in the night. They further implied (MOO) that LE did not follow up on that vehicle and it's owner. Instead choosing to focus on Kohlberger (the perfect patsy) due to mounting pressure to solve the case. I think this is also the basis for their interest in IGG and where it came in on the investigatory timeline. MOO.

So this is a very very very interesting hire.

That's my opinion of the Defenses's actions of course. I do not believe their premise, however, I think BK did it. JMO

I'm thinking of the conscious pain and suffering of four college students woken in the middle of the night by someone stabbing them to death.

That makes me care less about the pain and suffering of the person who (allegedly) chose to do that to them. And I say that as someone who believes in humane treatment of prisoners.

She,'s been hired to speak to a strike death penalty motion filed by defense. This is a pre trial matter about a potential sentencing trial matter, nothing to do with the pending guilt phase of BK',s trial.

Jmo looks like Dr Wolf may have extended her area of expertise into ethical/legal area do with DP. OJ trial was a very long time ago but seems the notoriety never dies. Dr Wolf might have issues similar to an actor who has been type cast. Idk but not predicting defense's guilt phase trial witnesses based on daily m innuendo and slanted reporting style. Daily M conflating and misrepresenting the existing hire imo.

oh okay. I see what you are say. Thank you.
All good. Thanks for responding.

I was just having a quick scroll through the latest defense responses to the states objections re striking DP (mouthful or what ...jeeze) and actually decided to read Hippler's order on zoom participation by the D's witnesses.

Turns out order does specify the permission is conditional upon the court allowing their testimony. My guess now is Hippler will make that decision between now and Nov 7th rather than during the hearing itself. Jmo

Quoted from page 1 of 2.
"...shall be allowed to participate remotely at the motions hearing...if permitted by the court to provide testimony."

Just went out to find more sources after reading your post. I stand corrected.

I rarely ever visit any Murdoch or formerly Murdoch owned news sources. This is a great reminder of why.

Thanks for pointing me in the right direction!

As University of Idaho student murders suspect Bryan Kohberger gets closer to a November hearing that his defense hopes will take the death penalty off the table before he goes to trial, his defense team is burying prosecutors in a barrage of court documents.

Here is an example of death penalty cases ALWAYS filed in cases to get the DP thrown out as unconstitutional. These are some examples from the Ohio Wagner murder indictments and court motions. All DP attorneys try to get the DP thrown out. Normal.

You'd have to imaging that the defense would want them up there. Especially if they saw nothing. It's not a strong challenge to the timeline considering the amount of time it takes to deliver food....but its a challenge no less. MOO
