Abby & Libby - The Delphi Murders - Richard Allen Arrested - #199

"The defense told jurors they believe the girls were killed somewhere else and their bodies were returned to the crime scene — that searchers saw no bodies or girl’s clothing in the creek on the night of Feb. 13, and witnesses near the crime scene also never heard any screams."

I don't know what time the sun set that evening the kids were out on that bridge - but if DG was out looking for them - is there any way he could have MISSED noticing clothing in the creek? How about other searchers? When did LE find the clothing in the creek and where along the creek were they located? Do we know yet?

So now the state is scrambling to test the hair? (according to BM) Ooof, WTG Indiana, glad to see my taxpayer $$ going to such stellar LE! JMO

I can't wrap my brain around this hair wrapped around a finger of a murdered child not being tested. And that's not the prosecutor's fault....but why didn't HE ask for it to be tested in the 2 years leading up to this trial? Was he hoping the defense team wouldn't notice?

As always, JMO.

I’m way, way, way behind but thank you to all who’ve mentioned so far that the hair in Libby’s hand belonged to a female relative of hers.

So it was just a “smoke and mirrors” magic trick attempted by the defense, a typical “Hey look over there” distraction.

Cheapest of cheap tricks.

I don't think the D has to prove their theory that the kids were killed elsewhere, do they?
No, but if they're going to present it, they have to make it seem plausible, or the jury will reject it wholesale.

If they're going to discuss it at length, they're going to have to make it seem like a valid alternative to the prosecution's theory of the case. It's going to be hard work. I'm interested to see how they develop it as the trial proceeds.

I wonder why Abby's clothes were in the creek if the girls were killed elsewhere. Did the killer not only decide to return the heavily bleeding girl's bodies to where the all the search action was, but also toss the clothes in that part of the creek? I am surprised he didn't leave a note with his name and number as well!

Baldwin questioned the timeline and cellphone evidence in the state's case, holding up a phone to the jury and saying, "Forensic data on these phones don't lie."

Baldwin said the prosecution claims Abby and Libby were dead by 4 p.m. on Feb. 13, 2017, and their bodies were never moved until they were recovered the next day. He said the prosecution's timeline puts Allen in a parking lot near the trial at 1:30 p.m. but his cellphone data shows he was gone by 2:15 p.m.

Addressing the unspent round found at the crime scene, Baldwin said law enforcement commonly used that type of bullet, but police never investigated if an officer was missing one. He also said the owner of the property where the girls were found owns a similar weapon but his gun was never tested.
How strong is the cell phone evidence that shows RA left the area by 2:15pm? Can't be that brilliant or they'd have applied for a dismissal ages ago, no? Unless they only found this out like incredibly recently? moo

How are they going to discredit the blood splatter experts testimony that the girls were killed at the scene? I’m very curious to see what will come out about that.
They will likely say that blood spatter evidence is a discipline of interpretation, not hard science, and point to cases where convictions based on blood spatter have been overturned based on appeal because of bad science.

I don't think that it will work, because you can't move a blood pool from another location to the woods after the fact.

Still, add up the evidence:

1) He was on the bridge just before the girls arrived; no other men were seen but him
2) Libby videotaped a man that looked like him and was dressed like him walking towards them on the bridge
3) Libby recorded his voice "Guys, down the hill"
4) A bullet that matched his gun was found between the girl's bodies
5) He confessed to murdering the girls numerous times - supposedly

Should be enough for a conviction.
I would not send a person to prison for the rest of their life based on circumstantial evidence.
I have doubts about all of your points.
Dear Prosecutor: Please show me evidence solid enough to find him guilty.

So searchers (eg: LG's family) who arrived to look for LG, they didn't see any clothing in the creek while the girls were missing? WHen were the clothes found then?
