From the Daily Mail:

Dr Sorell also confirmed he was asked to check phone data between 8am and 10am on July 31, 2023.

The expert witness said the phone was detected in Leongatha at 8.52am then Outtrim then back at Leongatha at 9.23am.

Dr Sorell said there was a 'half an hour gap' with no 'evidence where the phone was'.

'(The phone) is consistent of moving south-west of Leongatha, (which) will take the phone into the dominate area of Koonwarra,' he said.

The jury had previously heard evidence Patterson dropped her children at school then presented herself at Leongatha hospital.

Patterson left the hospital against medical advice after telling staff she needed to sort out some things at her Leongatha home (pictured) before being admitted.

The court previously heard Patterson returned to the hospital around 9.48am on July 31.

Maybe this has to do with the time Erin checked herself out of the hospital and possibly went to dispose of the dehydrator?

Good question, one I can’t answer.

Unfortunately since the trial isn’t being televised we’re at the mercy of the reporters, which isn’t always the clearest. I checked the Daily Mail updates and found nothing. Maybe it’ll get cleared up after lunch?

Maybe she went to see if she could find more death caps, with self harm in mind.

I haven’t seen anything indicating that Erin would consider self harm. In fact her behavior so far points to a very strong sense of self preservation and prioritizing herself over others. JMO of course.

Agreed. Also death caps seem to cause horrible suffering and death. Highly unlikely that someone would choose them to suicide.

Maybe EP tried to find more death caps for the next lunch with Simon..

We return from lunch

By Judd Boaz

Colin Mandy SC continues with questioning of telecommunications expert Matthew Sorell.

He continues where he left off, underlining that EBM data can change an expert's opinion.

To illustrate, Mr Mandy states that Dr Sorell could not determine whether Erin Patterson's phone had likely travelled to Outtrim based on call records alone, and required the EBM data to corroborate this fact.

Dr Sorell agrees.

Mr Mandy then points out again that Dr Sorell only had access to EBM records for around 20 or so days in question.

Crucial time window in Outtrim examined

By Judd Boaz

A crucial window of time on the morning of May 22, 2023 between 11:18 and 11:42am is again raised.

Ms Patterson's phone hooked in to the Outtrim base station almost exclusively for 25 minutes.

However, Mr Mandy highlights times on either side of the period where the phone checked into Foster North base station, 36kms away, and Mirboo North 38 kms away.

He asks Dr Sorell whether, given the the ability for phones to connect to other base stations, it was possible that the phone never entered the Outtrim area at all.

Dr Sorell says the suggestion is predicated on a vast number of factors, but concedes it is theoretically possible.

Defence attempts to throw doubt over visit to Loch

By Judd Boaz

Mr Mandy takes the same tack with Erin Patterson's alleged visit to the Loch area, on the same morning of May 22.

On Monday, Dr Sorell told the court Ms Patterson's phone connected consistently to a Loch South base station for about 43 minutes.

Mr Mandy says while the data records showed it was connected to the Loch South base station, it could theoretically have connected from outside the area.

"You can't exclude the possiblity that it was somewhere else and connecting to those base stations?" Mr Mandy asks.

"Yes."

This seems to be going badly for the prosecution. I don't know why we are not hearing about triangulation from the base stations, like we have in other cases. Am I missing something?

Also seems a mistake that they did not get a dump or all EBM data records for those couple of years AND that Dr Sorell did not ask for it either. IMO

how I imagine that scenario playing out. I shouldn't be facetious but I swear they take 1000 breaks
How bad do you think it is for the jury. Up and down, and shut in a small room with bickies and tea and coffee. When I was a juror in a murder trial we played lots of naughts and crosses and looked longingly out the window towards mountains. Waiting, waiting... Until deliberation time.

I’m not worried at this point. Something being “theoretically possible” doesn’t equate to it being probable, or rather more probable than the expert’s educated conclusions.

Hopefully the jurors are able to keep up and if not then yes, it’s the prosecution’s job to clarify the conclusions. IMO

Swapping phones raised by defence

By Judd Boaz

After a brief discussion of more topography, Mr Mandy jumps to a completely different topic: people using different mobile phones.

Mr Mandy lists some of the more obvious reasons someone might change their SIM card or mobile phone; reasons such as upgrading to a new model, repairing a broken phone and exchanging phones with a family member.

In their opening argument, the prosecution alleged Erin Patterson utilised two phones and two SIM cards in the days surrounding the lunch.

Yet another map of mobile phone base stations

By Judd Boaz

Mr Mandy finishes, leaving the floor for the prosecution to re-examine Dr Sorell.

They use the opportunity to bring up yet another topological map of the area around Gippsland.

After yet another brief clarification of how base stations might override each other, we take yet another break.

There will be yet more testimony from Dr Sorell after this.

Sadly, in Australia, trials aren't televised.

Range and angles of reception charted

By Judd Boaz

Much of the questioning of Dr Sorell has hinged around the potential range, and angles of a mobile phone base tower.

Dr Sorell has indicated on various maps where the base stations in the Gippsland area are, as well as their elevation and the angles they face.

The jury is being led back into the courtroom now as we return from the brea

It is very, very frustrating that members continue to ignore instructions regarding sub judice.

We won't post this again but members who continue to make posts that are sub judice may suddenly find themselves unable to post.

ADMIN NOTE:

IMPORTANT

Effective with Erin Patterson's arrest, sub judice is in effect and will be until a trial has concluded. For anyone not familiar with the judicial principle of sub judice, please review the following.

WS is based in the USA but we do try to manage the various discussions to comply with laws of other countries.

As this trial is in Australia, the case is under sub judice so please avoid anything that violates the following principles:

Basically anything that may prejudice the accused’s right to a fair trial
Any suggestion, opinion, or direct accusation that the accused is either guilty OR innocent
(i.e. the accused cannot be called "the killer"; use "the accused", "the alleged killer", or "the defendant")
A defendant’s previous history of any offences is off limits
Scandalizing the court (disparaging judges, lawyers, any officer of the Court) is off limits
Broadcasting anything about proceedings which happen in the jury's absence is off limits
Any non compliance with an Order of the court is off limits

Note in the event of an Appeal subsequent to verdict:
Appeals are usually heard by senior judges who are not likely to be influenced by the media, therefore responsible comment is usually considered acceptable once a trial has concluded, regardless of if there is going to be an appeal.

Posts that are determined to constitute a violation of sub judice will be removed. To avoid this, please review the following from the Victoria Law Reform Commission and post accordingly:
