Did they depose this guy or what? She is so haphazzard, I can't stand it. Her questioning has zero rhyme or reason ever.
 
Did I just hear she's going as far back as President Lincoln which resulted in the ANS report in 1863? Of course the witness doesn't know! he he .....

She wants it added as evidence and recorded? Baez jumps up to tell her something (good job perhaps). Your Honour looking somewhat confused as to why?

Sims says Lincoln founded National Academ of Science. Great new trivia question:

What do ICA and Abraham Lincoln have in common? I wish I knew the answer, but I don't :)
 
D. Sims speaking about a document being created that addresses what is valid science and is critical. Frye is not our burden it is the states burden but we believe that entire article should be considered by the court as to whether the witness...and he should be considered as an expert.

The judge is speaking.
 
Wow, is DS "reaching"? OK, so in 1863 this was established and that has what to do with this hearing?
 
There is quite the crowd on the SA side of the courtroom - I see Schaeffer and Kathi front and center.

DS really sounds like she is reading a script. She seems not confident with the subject matter and obviously did not prepare with the witness. Which i Find strange considering how unprepared the whole dt was last week with this witness.

Judge: under ramerz...they outlined the four part test the courts are required to give...scientific evidence...

one of those....I'm simply talking about ramerz which was found(citing numbers)decisions of the FL supreme court.

Interesting - HHJP knows this document and it's about the Ramirez (sp) decisions - he is asking which of the four prongs does this questioning go to?
 
HHBP: under Rameriz vs. state outline parts that courts are required to have all
four prongs. I am simply talking about Rameriz 2 . . . . . 1995 decision

JB & DS looking for papers

HHBP: curious as to the 4 steps we talked about . . . which one of the 4 or all 4 discovery?
DS: Number 1 - assist jury to understand the evidence, scientific expertise and methodolgoy
#2 the trial judge must decide on scientific principle -there are requirements/steps to gain certain acceptance

I agree, and I think the DT looks even less confident today. Maybe they know something we don't. Maybe JP gave them a "hint" towards how he's leaning on the odor evidence?
