HHBP: science in litigation science. Rule in Federal rules of evidence
Section 4 - intrepreting science data,
Section 5 - anaylsis of hair, control substances, paint & coating
Section 6 - methods of forensic science
7 -
8 - education and training
 
HHJP giving a reading lecture about what the four prongs are - listing off what is and is not acceptable.....not looking patient....
Mr. Ashton has a valid point and question will be sustained unless you have a valid point - DS still going on and on...
 
The defense always seems to try to cite case law that simply does not apply. :banghead::banghead:
 
objection will be sustained unless dt can speak to one of the four prongs
 
The judge is speaking: what is forensic science, next the forensic community, three: in evidence in litigation law and science. A section that talks about the frye standard, and a decision that is not valid in fl but judge says is interesting.

section four: interpreting scienctific data,...listing each section...

section six: performance in forensic science
eight: education and training
nine: med examiners
ten: finger print and homeland security

unless you have a specific section of this article which has some relvance of what you want to read...table of contents.
 
HHBP: under Rameriz vs. state outline parts that courts are required to have all
four prongs. I am simply talking about Rameriz 2 . . . . . 1995 decision

HHBP: curious as to the 4 steps we talked about . . . which one of the 4 or all 4 discovery?
DS: Number 1 - assist jury to understand the evidence, scientific expertise and methodolgoy
#2 the trial judge must decide on scientific principle -there are requirements/steps to gain certain acceptance

IF this is the same article....(sorry missed the name) that LKB referenced in the past......it is a document that initiated exceptional discussion and a GAME PLAN for the future ...year future UPGRADING of the field of forensic science INCLUSIVE!

HHJP: it will be received in evidence for the purpose of considering section four.
 
I'll tell you what. If DS continues to speak as she is now, she will lose the jury in the first minute. She cannot simplify anything because she herself doesn't get it. BAD combo IMO.
 
HHBP: it will be received in evidence for the purposes of the content of section 4.
 
here endeth the lesson. I get the impression that HHJP is not going to be giving anywhere near as much leeway today.
