I think this was a preplanned thrill kill aimed at one or more of the girls in that house.

He studied under a very well known Professor at DeSales who had a lot of history on BTK and that manner of spree killing, plus the survey he published while there asking questions about how targets were selected, how they prepared, etc. leads me to believe our boy Bry has had this on his mind for awhile.

I would be absolutely fascinated if his former Criminology professors were used as "subject matter experts" in anything related to the trial, that they have credentials for testimony.

An absolute boatload of motions in limine just dropped. We're going to have a lot to talk about.

Wow, a lot to unpack here in some of these Motions. I find in particular MTS Death Penalty RE Autism Spectrum Disorder and MIL #3 use of the Term Murder more than a reach. AT states BK has a hard time thinking and processing information in a 'timely, normal' manner, but she fails to consider he was the Regional Extemporaneous Speaking winner in his Region. ;)

MIL #7 Bushy Eyebrows - Surprised to see it stated as fact that DM said she texted BF and then did go downstairs to BF's room and went to sleep after the incident. We'd heard different rumors on this, but according to DM's interviews it seems like she did indeed. Of all things she did remember and consistently repeated in her many interviews, BK was dressed in dark clothing wearing a mask but his eyebrows were distinctly noticeable to her.

Did we know this before?

Interviews on November 13, 2022. On November 13, 2022, D.M. was inside the house when the murders occurred and saw a figure dressed in black (hereinafter “intruder”) when she peeked out her bedroom door around 4:00 a.m. Shortly after seeing the intruder, she went downstairs to Bethany Funke’s room. The two girls fell asleep. Roughly 8 hours later, a 911 call was made from Bethany’s phone at 11:56 a.m.

Hah, I just finished reading the docs and called this very one out too. We've heard the girls DM and BF were texting each other. It makes sense that DM was uncomfortable and/or annoyed enough to go down to BF's room to sleep and proves, IMO, that she definitely did not see Xana or Ethan.

They had to have been in Xana's bedroom or hallway off of main living area. :(

Wow this is a lot. DM’s story is mind blowing. And did we know for sure before today that BK was on the spectrum?
I don't think we knew that as fact, I wonder if and when BK was officially diagnosed?

AT no likey Amazon clicks.... shared account, maybe someone else was clicking away... AI driven software, I guess maybe AI was plotting a murder and giving an unknown someone on a shared family account ideas to click on. AI turned misread innocent searches and suggest mean, bad, no good, very bad crimey things to buy.

That is the WORST cluster of lame arguments I've personally ever read.

I also wonder if there is also the problem that AT speculates wildly about other family members searching, leading to AI recos that somehow get clicked on ... but those witnesses are available to be called????

So while AT has some points at a generalised level, detail is going to matter a lot, and the other family members can obviously testify

And no one is going to "buy" that a family member was searching for camping gear, and AI generated a kabar knife (that bought itself.) Discard reasonable doubt, she's asking for the jury to SUSPEND ALL REASON.

I did find it interesting that DM had drawings of eyes on her walls, before the murders.

On the walls in her room were many pictures of eyes with prominent eyebrows. Many of which she had drawn. Some of the eyebrows are heavy, voluminous, puffy, or perhaps subjectively bushy. (Motion in Limine 7 - Exhibit 4, Dylan’s Room Search, p. 1-3.) According to Detective Lake, he found “artwork of human figures with an emphasis upon the eyes and eyebrows were pinned to corkboards.” (Motion in Limine 7 - Exhibit 5, Dylan’s Room Search, p. 2.)

That makes sense. She probably never even went back in. It was in her bedroom on the wall, iirc. Eyes and eyebrows.

It'll probably turn out to be innocuous. Like a make-up chart, even if hand drawn. Experimenting with arched brows, sort of thing.

Thanks. Seems to me those had to be there before the murders then. She didn't live in the murder house after the murders.

I would argue that if there were drawings she had done with prominent, heavy, voluminous, puffy, or God forbid, bushy eyebrows, that may lead me, or a reasonable juror to believe that she takes notice of eyes and eyebrows, and thus means that her description of the murderer's eyebrows is very believable. And if motion is granted to prevent the state or any witness from describing the murderer as having "bushy eyebrows", (I do not think that motion will be given much serious consideration), absolutely nothing, AFAIK, would prevent the state from showing DM several random pictures of men with different types of eyebrows, including "bushy", and asking, do any of these look similar to the eyebrows you saw? JMO

Even AT describes some of the eyebrow images from DM wall. Then quickly qualifies one. Subjectively bushy! What about subjectively puffy? Subjectively voluminous?

She's already said that any reference to 'bushy eyebrows' is too prejudicial because it accurately describes BK.

Worse, she makes it sound like a creepy wall display of eyes and eyebrows. They were drawings of PEOPLE.

Scheduled for April 9th, according to the latest case summary. Originally scheduled for April 3rd but state and defense stipulated to extending out the deadlines to submit and reply to MILS in late Jan IIRC. Judge granted a subsequent motion and then elected to change the hearing date for a week later.
