I personally don't think they even need these character anecdotes to convict him.

In fact since it is someone's opinion if he was creepy, they will probably steer clear of most of that unless it is a professional's opinion.

Just my 2 cents' worth
I don't think "character evidence" comes in anyway unless somehow the defense opens the door to allow it. And I think there's a close to zero chance of that.

Well, it looks like this answers our question of what time the 2 survivors woke up and what they did (mostly). It makes me wonder at what time did they explore the house to see if they could figure out why their roomies hadn't answered their texts from earlier 4am-ish hour. Interesting that after a scary night, with a strange guy in the house, they were on Insta and Indeed.

What does Insta have other than pics people post? I'm not on it so don't know. I can only see what little they allow a non-subscriber to view. Does it have a messaging service cuz I can't imagine they were looking at/posting pics after the night they just had.

For those that don't know what Indeed is (unless there's another company with this same name)... it's indeed.com, a job search engine and hiring platform.

This is going to be really important. The defense wants the jury to be aware of BK's conditions (autism, ocd), so they don't pass judgement on him in the courtroom based on his mannerisms, and plan to use it to rebut evidence related to certain behaviors surrounding this crime. There is also a claim in there that he would be physically unable to commit these murders.

Oh, AT...

Partial corroboration? Of BK's alibi? More like partial alibi.

AT is still trying to sell Sy Ray's magic carpet ride. The seven minutes before BK turned his phone off. Who cares where he was????? An hour later he was in Moscow, looping the neighborhood where suddenly four previously alive and healthy coeds abruptly stopped being that.

And AT wants to knock off Amazon clicks, or at least cough up a droll expert to wear everyone out on how Amazon exists as a whole sale shopping machine, designed to marry products and pocketbooks, something we all understand on an organic level and don't particularly care how the sausage is made so long as we get what we want at a great price and get it delivered yesterday. Or order on March 31, get on next day, as it were.

Come again? Who's your expert? He's going to say what? He's going to use all the words that ever existed to explain how Amazon uses AI to engineer sales in a technical way that will eat up court time and move zero needles.

Why's she care so much about Amazon of BK was stuck in the muck on the far side of Moscow, not killing anyone?

It must be like turning in your term paper late. All that work and you're still staring at a failing grade.

Seems like a formidable foe like a military knife kind of levels the playing field there for ol' BK.

Besides, wasn't the scene described as sloppy? A real Marine would be clean. Deft and deadly, in war time. Perhaps BK left a bloodbath because he's clumsy. Physical limitations don't exonerated him, but it does explain the crime scene!

AT is stretching so hard she's turning into a rubber band. I think most of her requests will be denied. I'm sorry but some of these Motions are just...such desperate attempts. ID does not have a NGBRI so why should the Defense be allowed to present any expert testimony about BK's potential behavior or conduct during trial?

It funny that AT's filed New Motions to allow the Defense to file their responses under seal, after she has quoted and disclosed the States Request or Response Motions out to the public. Hah

I'm sorry I just can't with this. BK had fine enough motor skills to be an avid runner, boxer and apply for a LE job in Pullman.

I think this is why we've seen BK change his body, basically shrinking, in order to appear more frail and weak. Not to worry, the State will have plenty of evidence showing how healthy BK was at the time of his arrest. MOO

Ding ding ding. A person may have problems with fine motor dexterity but I really wouldn't categorize holding a 7" sharp blade and making slashing/stabbing motions to require fine motor dexterity. And I'd say his training in boxing and running were great physical therapy for any issues in his motor issues. But we are to believe that he wouldn't have been able to walk quickly through the house, climb stairs, attack unsuspecting/asleep people in small spaces with a long sharp blade, or quickly unzip a baggie coverall.

Not buying it.

This is rich. State rightfully wants to introduce the text messages between DM and BF, outside hearsay, under excited utterances like the 911, iiuc.

Tge Dedense provides a more comprehensive look at both women's phone usage spanning ten hour. Suggesting that because they both used Instagram and other apps, Snapchat, Indeed, etc, overcast span of time, their late morning messaging no longer calls under excited utterances. Or some such.

Probably all very typical Subday midpoint behavior for them, interspersed with confusion for the lack of responses from upstairs. IMO it was only when circumstances pressed them to investigate that their nerves ramped up on fears terne and then EVERYTHING they said and did was material, not for the truth of it, but for their states of mind at the time.

These appear more ominous than they are IMO. DM and BF were texting we know. And they were texting their roommates. They were probably trying to reach JM to find out if he had heard from Kaylee or if he had been over there. EA was HJ's girlfriend so they might have been trying to see if he had heard from Ethan.

They probably both also tried SC and Insta to see if they could reach them that way.

Iiuc AT is careful to say she's not introducing it on the merits of not knowing right from wrong. She wants it to counter BK's very presence in the courtroom. BK is prejudicial to BK because he's off putting, intense, stare-y.

Maybe there's time to send him to charm school so he won't sour the jury to himself for being naturally creepy.

Well my autistic children have an overwhelming sense of justice and an empathy level that puts 95% of people to shame.

Autism does not ever make you a murderer. I could understand perhaps an autistic person being more likely to be involved in an accident that led to poor outcomes but it is a disgrace to suggest being autistic explains killing 4 people.
Its more far more likely an autostic person would kill a murderer than be one.

AT is already challenging the State's 3D model of 1122. Because she can't question the experts who made it, can't confront it for accuracy? She calls it prejudicial.

She thinks the jury can gather their own spatial maps from seeing evidence photos.

How can a model be prejudicial? Except to show how little time it would take to get from floor to floor and more?

This just hit me. BK is tall. Awkward. I wonder what his stride is. Bet he could easily take a half staircase in 2-3 steps, a 12 foot room in a couple long strides.

Suddenly 12 minutes is an eternity inside a small if sprawling house.

rbbm afaik Instagram has a private/direct message feature, it's possible that they were communicating via PM with others or checking socials for more information. Indeed seems odd to me though, jmo.
