That is a loaded question. The new attorney for the prosecution said the defense has not fully disclosed the data behind two expert mental health evaluations of Kohberger.

The state requested additional materials, including test results and the facts supporting the experts’ conclusions, to allow their own experts time to review and prepare a rebuttal. The supplemental discovery request specifically refers to evaluations by forensic psychiatrist Dr. Eileen Ryan and neuropsychologist Rachel Orr.

I find her voice and delivery very off-putting
So sorry, I mistakingly thought Barlow was the dark hair defense attorney who was up earlier. My comments were about that other attorney.

Prosecution says MM showed absolutely no sign of defensive wounds, the suspect's clothing precluded any scratching, and alludes to her toxicology being relevant (too drunk to fight back, probably).

"Would not anticipate the perpetrator's DNA to be under the fingernails."

I’m way behind and not sure who the gray-haired female defense attorney is, but all I hear is “blah blah blah, please don’t allow the DNA because it will prove my client is guilty.”

I’m not worried about my DNA being there because I didn’t kill anyone. IMO if BK were innocent, his lawyers would feel the same.

They can test that dna a second time (which the did) and then test it a hundred more times. It remains the SAME. LE confirms the profile as BK's...

This back and forth is all about the use of the term: "touch." Both the Defense and the Prosecution experts have used the term "touch" when describing the DNA on the sheath. This defense attorney is now arguing that that term leads one to think they know how the DNA got on the sheath which may be incorrect or speculative. The Defense wants that term banned from the proceedings. The concern from Prosecution and Judge is a mistrial IF the term slips out during testimony.

Judge does not want to police experts in their own field but does want counsel to work with their witnesses to refrain from using the term.

BK used the victims condition against them. They were drunk, and he knew it, which caused them to hardly be able to fight back. 😡
IMO, there is a difference in that drunkenness is initially the result of lifestyle choice, compared to autism which is a neurodivergent brain that the person has no choice in.

IOW, I could see a diagnosis of autism as more of a mitigating factor than an aggravating factor.

Defense wants the traffic stop out because they say the crime is prior act but not on a level with the crime.

Defense says it show BK in Moscow, at night, in the car, arguing, not wanting to give his phone number... clear video of the car...

They don't want the State to introduce all those elements to the jury.

Judge: why is that a problem?

D: because it might show that his car is similar to the one in the 1122 video.

Judge: isn't that the point?
I haven’t been able to find this traffic stop. Was it no release for a stated reason?

I would be livid listening to his attorney asking for his family be included in the courtroom if I were any of the victims family.

I would think that family members of an accused would be included in courtroom seating, given that a defendant hasn't been found guilty at this point in the process. And the family members have not committed a crime, they are victims of the crime if a defendant is found guilty.

I'm not saying they shouldn't be included. I am saying that it would be upsetting for me to listen to his attorneys/him whine about his family members needing to be in the courtroom when my family members were dead because of him.

I’m talking about the August 2022 traffic stop in Moscow for speeding and no seatbelt. Defense didn’t want it in evidence because BK asks why they need his cell number and says things about seatbelts not being useful (or similar - I had just tuned into the hearing at that point).

Oh sorry!

It does seem odd. The other two traffic stop videos that were released were from Washington and Indiana- maybe Idaho doesn’t release these things publicly? I wonder what he was wearing in that nighttime video from Moscow. Was he suited up for stalking?

Judge Hippler is going to go through 911 call, line by line, and portions of the call, particularly statements made to dispatcher by people other than DM or BF, will likely be redacted, as hearsay, including these statements made by EA...

"Um, one of our - one of the roommates who's passed out and she was drunk last night and she's not waking up."

"Oh, and they saw some man in their house last night. Yeah."
