KG's family responding to delays.
I feel for SG and the other families, but the State only gets 'one bite' at the apple, so they need to be well prepared for anything AT might throw at them.

I do believe the State has BK locked in tight, I think the delays lie with the Defense and their never ending Motion Machine that is AT & Co. Maybe Judge JJ will finally put an end to it after this next hearing.

There is starting to be some major internet coverage as to the delays, even calls for replacing the judge. Is AT going to extremes to exonerate BK or to make a name for herself or all of the above? She was hired for the position, can she be unhired?

I have often wondered if our justice system has gone overboard for the "rights of the accused". I also believe that there is a lack of transparency on how much money is spent/given for the defense of accused.

Granted, there is a balance, but shouldn't there be a limit on time and money? The law really isn't that complicated. But has been turned inside out by defense attorneys seeking loopholes and exceptions.

I think the Delphi case has just reminded us what can happen if the judge tries to 'unhire' the defense team. Nothing but chaos ensues...

There is no question in my mind that the accused has all the rights- defense attorneys exploit our justice and court systems to nth degree-- and worst of all, by the time trial comes around the victims are all but forgotten, except of course by their loving grieving families.

The internet is going to 'internet'. I don't think they can or would replace the Judge or AT, she is doing her job as his Defense attorney.

More Motions and delays in general are not all that uncommon in a DP case, but at some point Judge JJ is going to have to draw a line in the sand and get a trial date scheduled.

If I had to guess, I'd say early-mid 2025. I hope.

Exactly, I wouldn't wish that on any case. Ever. :)

One way to read Websleuths for "facts only" is via the media threads, on which no discussion/speculation/opinion is allowed, only links to news articles, press conferences, legal documents, etc.

If you look on page 1 of this thread, you'll see links to the media thread/s for this case.

Welcome to Websleuths!

Between the prevalence of social media and the growing popularity of true crime entertainment, I think "the public" has a very false image of how long the process actually usually takes for large crimes. Certainly, when the media is doing a show on a case that has already concluded, they are telling the story as a condensed timeline: crime, manhunt, arrest, trial. And that makes it seem like cases just go from arrest to sentencing in 3 months. Just like all the crime dramas have lab results coming back the same day. It's not intentional, but it leads to a distorted time scale for the general public.

Here you have a quadruple murder, that involved the FBI as well as several local agencies (the FBI tends to be slow to produce results once an arrest has been made...I mean, they are a part of the federal bureaucracy, so this shouldn't surprise anyone), and is moving forward as a death penalty case. All of the players involved (prosecution, defense, the judge, the different LE) all have other cases in the system that they still have to work on at the same time, including cases that have been in line since before him.

Public perception seems to be that if a case is "notorious," it should get moved to the head of line in the courts and everyone involved must drop anything else they are working on.

Do I think the defense needs as much time as they are claiming before they will be ready? No. Do I think Judge Judge needs to start reining the defense back in to some extent? Yes.

But in a case like this, I think the public needs to look more at the timeline for Lori Vallow than Alex Murdaugh. Murdaugh only went so quickly because the prosecution of his case was taken over by the state Attorney General's office due to the extreme conflict of interest/long family history in prosecution/etc in that county.

New court documents:

Order Setting Deadlines and Hearing
--Notice of Defense of Alibi must be filed no later than April 17, 2024
Alibi must follow Idaho Code and "state the specific place or places at which the defendant claims to have been at the time of the alleged offense and the names and addresses of the witnesses upon whom he intends to rely to establish such alibi."
--Defendant's brief, witness list, and any evidence the defense wishes to present in support of the Motion for Change of venue must be filed no later than April 17, 2024
--The State's response brief, witness list, and any evidence in opposition to the Motion filed by May 1, 2024
--Change of Venue hearing May 14, 2024
--State's discovery to defense deadline: Sept 6, 2024
--Defense's discovery to be turned over to the State, including mitigation info: Jan 9, 2025

Amended Order for Disclosure of IGG Information and Protection Order
--The defense counsel, BK, and IGG defense experts Dr. Leah Larkin, Bicka Barlow, and Steven Mercer can view the IGG info the state has turned over. No one else
--If the defense wants to have an investigator see it, they must ask the court, must provide reason/proof as to why that investigator need to see it, and wait to get approval.
--No individual on the IGG family tree who has not already been discovered by the defense's investigation prior to receiving the IGG info can be contacted by any member of the defense without prior authorization from the court and justification of why this is necessary.
--The defense's mitigation expert does NOT have access to the IGG info and has created her own family tree. She may continue her investigation and contact any of those family members.

Other than the judge, is there anyone else who has the power to rein AT in regarding her demands to delays, etc.?

@micgems11, welcome to WS!

You will get discussions of facts but lots of other discussions, too. Most of us enjoy the variety but we are totally about tolerance, respecting various views, and being polite!

If you want to restrict your reading and discussions strictly to facts you might inquire if there are others who wish to join a side conversation group with you. Use the envelope icon, top right.

Again, welcome. I look forward to reading your input. Glad to have you aboard.

PS: And yes, the media thread will be facts with no discussion.

BK hasn't given her much to work with. So hoping that some sort of hole opens up to give BK a chance makes sense.

I totally agree that the judge does need to draw the line at some point.

There's just something that feels (IMO) disingenuous about simultaneously saying that you're not getting discovery fast enough but admitting that you're overloaded and haven't had a chance to go through most of what you already have.

People are treading cautiously because she's not afraid to remind folks over and over and over again that this is a death penalty trial. As if this is the first one in Idaho or the United States courts. Justice can be simultaneously speedy for the victims and the families AND just...

Saw this on the internet regarding BK: Make a great bumper sticker?
JUSTICE DELAYED IS JUSTICE DENIED
@Idaho transplant
OTOH Some victims families may not see their impatience w the current pace and their quest for trial sooner than judge now suggests, as justice rushed. But if trial judge sets motion deadlines & other matters in a way that appellate ct sees as denying the def't & def. atty adequate time to prepare defense case, then...

JUSTICE RUSHED MAY BECOME CONVICTION & SENTENCING OVERTURNED.

Sorry, don't agree. I am absolutely disgusted by trials being pushed out, 4, 5, 10 years or more. There is zero excuse for those types of delays. And whatever excuse there is, should be fixed.

Eliminate the DP, if that is the problem. Anyone hardly gets put to death anyway, with the lengthy appeal process.

Mar 1, NewsNation, A. Banfield talked w victim's Father Steve G. From transcript on youtube.

At 2:33, AB said
“AS YOU GET DEEP INTO
THIS PROCESS, ESPECIALLY IN A
DEATH PENALTY CASE IS
EVENTUALLY PROSECUTORS.
CONSIDER TALKING TO FAMILIES”
about a deal, possibly taking DP off the table.

At 3:40, Steve G said:
“>> BECAUSE THEY KNOW I'M NOT
GOING TO LISTEN TO THAT. I'M
NOT HERE COMPROMISE ON MY
DAUGHTER'S NAME. WE ARE GOING
TO GO FOR THE ULTIMATE LEVEL
OF. ACCOUNTABILITY. “

Does ^ I’m no going to listen to that ^ and ^not comprising daughter’s name^
convey that SG think he controls the DP issue, whether the DP will be pursued or dropped?
Or just wishful thinking? Or?

@mickey2942
Not sure what part of my post you're disagreeing w.
I too am disgusted when trials are "pushed out" 4, 5, 10 yrs.

But in THIS case,
Mid-Nov. 2022......deaths.
Late Dec 2022.......arrest.
Early Mar. 2024..... estimated trial in mid 2025.
If trial starts in mid 2025, that's 2 1/2 yrs est'ed ATM, not 4, 5, or 10.

And it's a DP case. And there's a HELL of a lotta discovery.
IDK the point at which def. team's request(s) for time is a bogus excuse, rather than a legit reason. Nor do I have a suggestion for fixing the prob. Maybe someone else here can offer suggestions for fixing in this case. Anyone?

This may not seem "rushed" to all victims' families, but if trial ct denies def's motions for time, an appellate court reviewing conviction may determine that def't did not get fair trial, for lack of time for def atty/ies to prepare def. case. And then reverse and remand for retrial?

If faced w choice btwn possibility of a 2025 trial or possibility of appellate court overturning a conviction, seems families would prefer 2025 (or possibly later) trial. ICBW
