BK isn't up on capital murder charges because DM did or didn't identify him. She didn't. She saw someone wheres there's evidence someone was and described that someone in a way that doesn't exclude BK, whose one DNA puts him there.

AT is asserting that, if LE included more "things", it would have changed how the Magistrate looked at the DNA that, on its own, established probable cause. Every day and twice on Sunday.

And the only way to support that is to claim that LE purposefully misled the Magistrate by ..... um.... by..... um.... she couldn't really answer. They lied, I guess. Because they dust day which way BK's car was pointed an hour before the crimes, because they didn't include everything DM said in her interviews....

That's what a trial is for! No State puts its whole case in a PCA.

In addition to the closed part of the hearings/testimony, IMO the proffer and the response held much more information than what we heard in argument. The D referred the Judge to the proffer multiple times.

Regarding DM statements, no one made this accusation at the Hearing. AT only argued that The PCA omitted information, concerning DM's recollections. That is an actual fact.

She immensely helped the prosecution.

Because the defense cannot say DM proved the killer was not BK.

Did she say he was short. No.
Did she say he was fat? No?
Did she say he was wearing a ski mask completely covering his face? No.
Did she say he was wearing colorful clothes? No.
Did she say he was a person of color? No.
Did she say he looked like a female? No.
Did she say he had several people walking with him? No.

Did her description match BK's driver's license photo? Yes.
Did her description match the written description on his license? Yes.

This is all written down and probably video tapped. DM can read this and watch this and it will help "jog her memory."

It hardly supports the OP's claim that it is clear that LE deliberately included known false info re what DM said. Jmo

Consider: LE includes in the PCA that Murphy didn't leave the room he was in, but perhaps could have. How does that change probable cause? How does that omission become a lie? He may have been in a crate, under a bed, terrified or otherwise. How does that change anything? Apparently Murphy didn't even make himself known to LE all those many hours later. Murphy waited to be found.

Consider: LE includes all the details of DM's interviews and everybody else's too. What's that add? LE included her general description and provided details of the footprint to corroborate DM's recall, both of which corroborate the time.

Consider: what if LE included in the PCA that the Elantra was nosed in another direction, an hour before the crime occurred? How does that help or hinder anything?

How do any or all of those change anything?

They don't.

Bryan Kohberger case: Idaho makes key move on firing squad executions

Idaho lawmakers have advanced a bill to make the state's newly revived firing squad its main method of execution as the quadruple murder trial of aspiring criminologist and alleged co-ed killer Bryan Kohberger approaches.

One of the country's leading experts on capital punishment, Fordham University professor Deborah Denno, has also argued that the firing squad is an effective and humane method of execution.

The bill advances as prosecutors are seeking the death penalty for Kohberger in the stabbing deaths of four University of Idaho students: 21-year-olds Madison Mogen and Kaylee Goncalves and 20-year-olds Xana Kernodle and Ethan Chapin.

Presently the primary means of execution in Idaho is lethal injection.

I am not following what his birthday has anything to do with license plate registration. Driver's license - yes. Plate registration is annually (at least in WA) based on when the car was purchased. Was his PA plate expiring at the end of November? IMO, if it was NOT expiring, that could also be circumstantial evidence (consciousness of guilt).

Thank you for this....So, that last link suggests he didn't even need to get new plates yet...until April 2023. Am I interpreting that correctly? I guess I better read it. LOL My bad.

Is the Affidavit in the 2nd link the PCA? When I read through the 2nd links, I did not come to any affidavit to suggested this is a fact. JMO

Re DM's description, I would say it doesn't rule out BK, it's not a description of him and it's not 'identifying' him. JMO.
