Abby & Libby - The Delphi Murders - Richard Allen Arrested - #199

I hope the jury isn’t in danger, but you raise an interesting point. With the trial being in Delphi, might there be a public uproar in town if he’s acquitted?
If he is, then there should be a public uproar imo! Considering how much this has / will cost the tax payers, who don’t even have access to the trial they’re paying for… they should be mad as heck if the State fails to prove their case Bard and RA is acquitted. To be clear - before anyone comes at me - I am not in any way suggesting any vocal or physical assaults towards the people involved on either side, nor towards the court staff, LE or jurors!! I am only positing that an acquittal should make people mad and in turn should make people really consider arrests more carefully in the future. Mooooo.

I’m so far behind because for this week I’m not able to follow the case until the evenings. I won’t get to watch the trial either until I’m back in NYC.

My cable provider at home dumped Court TV but I’m sure it will be covered elsewhere…maybe News Nation (although I find Banfield insufferable).

But I do know that in the evenings I’ll find info here, even if I have to continue skimming instead of reading closely.

Justice for you, Abby and Libby. Peace for your families.

Let the truth prevail.

Please don’t conflate my post about whether locals might be upset with an acquittal, with views about the cost of a trial. My concern is that folks might feel justice was not served.

Trials cost what they cost. This one is extremely expensive, due to the high-profile nature of the murders, costly delays, and the need for a public defender.

The public will not want arrests for MURDER to stop because of the cost. Sometimes defendants are convicted, sometimes they are not.

Two young people were slaughtered in that town.
No one in their right mind in Delphi would not have wanted an arrest to be made due to cost.

i don’t think you’ll be able to watch at home either given no video or audio recordings are being made for the public to view. Moooo.

And to be clear - not suggesting arrests shouldn’t be made. More saying if the State wants a conviction and to spend millions in trials / housing in prison or jail pre trial etc they should be certain of their case before they arrest someone is all. Maybe the State is certain and maybe they have the proof… I hope they do. Moo

The State is certain of their case, or they wouldn’t have brought it to trial.

A jury will decide based on evidence, and we can only hope they get it right. Sometimes they do, sometimes not. OJ Simpson and Casey Anthony trials are all that are needed for reference.

What’s the actual point of sequestering them if they get visitors?

I think it is visitations on Sundays and also some can work in the evenings on their laptops, but UNDER THE EYES AND SUPERVISION OF BAILIFFS AT ALL TIMES.

Some of the jurors have families including children which is why this probably opened up.

This could of course change.

I’m belatedly finding out who this man is, and I agree he’s a warrior, but not a legal one.

He’s an investigative reporter, so still just media, but he certainly seems dogged.

According to the MS, there is a number of people from the media banding together to (lawfully) request more access. This is a side of the press I appreciate.

All IMO

I don’t know as I agree with this statement - my *opinion* on this stems from all the social media attn to the case with people posting side by side photos against the BG sketches or posting theories naming this person or that as the killer - often without a shred of evidence to back their claims, and I wonder how many of those even called LE to have their concerns formally investigated? Sure, not all members of the community but enough that I wouldn’t say they’re explemplary.

Under Indiana law court recordings are meant to be made public.

So, that 3 day hearing would have been recorded, I would think, for the transcripts to have been transcribed.

Really speaking whatever was recorded should be public now only I think Judge Gull doesn't want any of the trial to be made public until the trial has ended.

Interesting. I have never heard of a sequestered jury not being well, sequestered.

That was the reason Diener gave, but I don’t think it was the real reason he wanted out.
Well, he also writes to that SM frenzy and what his family is experiencing in this official Court Order, so I doubt it's something he just puled from the dairy air IMO:

An interesting point noted in this article too that I'm just picking up now (red font and bolded by me):

... Judge Diener said, although a judge has 30 days to rule on any motion, he “keeps getting direct requests from nonparties for “public information” which state he has seven days (when mailed) or one day (when hand delivered) to respond to the request or face litigation.
It should be noted the Access To Public Records Act provides the limit of days is to respond, not provide the requested information.
Diener said in the court order that he is responsible for the entirety of the Circuit Court docket and he attempts to ignore the maelstrom if “interest” from the public, that “YouTube already hosts content regarding family members of this judicial officer including photos.”
