Media to Be Allowed to View Trial Exhibits (10/16/2024)

“The Court, having had the News Media Coalition's Motion to Inspect Public Trial Exhibits, filed September 30, 2024, under advisement, now issues its Order addressing the media's complaints as follows: The hearing conducted in Carroll Circuit Court on July 30-August 1, 2024, was open to the public and the media and, in fact, attended by members of the media, as well as the public. At said hearing, well over 1,000 pages of exhibits, documents, and photographs were submitted by the parties in support of their respective positions. At the conclusion of the hearing on August 1, 2024, the Court took the matter under advisement. The Court indicated it would take approximately thirty (30) days to issue its rulings on the multiple motions which were heard. The media immediately, on August 2, 2024, demanded access to the exhibits. This was an unreasonable request as the Court had just taken the matter under advisement the previous day and the Court needed absolute access to the exhibits to review and make a ruling.

The Court would note that this murder case is one of over 300 pending cases on this Court's docket, with approximately thirty (30) of those cases being murder cases. The Court and the Court Reporter have worked into the evenings and on the weekends to comply with the demands made by the media.

Of the well over 1,000 pages of exhibits, documents, and photographs (several of the photographs were admitted into evidence as "confidential" by agreement of the parties due to the extremely graphic nature of the photographs) the Court has identified dozens of exhibits which are accessible to the media or the public as they contain employment personnel records, medical records, mental health records, financial bank records, records containing social security numbers and dates of birth, autopsy reports, work-product of counsel, depositions containing confidential exhibits, and reports which were marked by the creator of the report as confidential.

The Court has obtained the services of a Senior Judge to supervise the review of those exhibits which are accessible to the media. The Senior Judge, Judge Marianne Vorhees, has indicated she will make the exhibits available to the media on Tuesday, October 22, 2024, at 10:00 am at a location in the Allen County Courthouse, located in Fort Wayne Indiana.

The media is also demanding access to the exhibits which will be introduced at the trial, commencing October 18, 2024-November 15, 2024. At the conclusion of each trial day, the Court will allow the media access to those exhibits for fifteen (15) minutes.

I wonder if they will all have to dine together in private areas of restaurants. Else, how will they enter restaurants and not risk sitting near the public discussing the trial? Or are all their meals catered to the lodging?

I would imagine their meals will be brought in, but I'm laughing to myself remembering the restaurant episode from "Jury Duty," one of the greatest shows ever.

I saw this really good point made about the hair allegedly found in Abby’s hand. The defense brought this up during Voir Dire, and not in any of their filings, to include their motion to dismiss.

That tells us all we need to know.

But by doing what the Defense just did it has already started to create doubt with the jurors by bringing up that hair.

WOW! I've never seen anything like this. In my opinion, it makes it seem like everyone is in extreme danger if they are identified or something! I can totally understand the effort to conceal the identity of the jurors, but everyone else? This just feels so.....excessive for what we, the public, know about this crime. It really makes me wonder if this crime is part of some much larger crime, entity, whatever, that we don't know about yet. Remember Doug Carter's word.....tentacles. I feel very unsettled looking at that photo.

I wonder if there's also going to be heavy security at the place where the jury will be housed. I hope wherever they are staying doesn't get leaked.

The jury could be in danger if they convict, considering the extremes on SM nowadays. I'd be worried about crazy RA fans if I was on this jury. That's AJMO

I recall Saturdays too, but the docket on MyCase doesn’t show Saturdays. Election Day (11/5) and Veteran’s Day (11/11) are listed as court dates, which are state holidays. So perhaps not accurate.

Judge Diener recused himself because of the SM frenzy, I believe, so I can understand why all the precautions are being taken.

IMO the families and the townspeople have behaved exemplary. I know it would break them, but I have all confidence that they will 100% be lawful to the end.

Looks like they have time to request an absentee ballot.

Oh, interesting! I wonder what they do in a case like this?! Maybe they have someone assigned to collect their ballots and deliver them to all the polling stations? It probably rarely happens.

You’re right. The folks there have been peaceful. I think they took their cue from the families of Libby and Abby, who have demonstrated class and grace under the most difficult of circumstances.

No, imo. There would be a collective cry of anguish, and I would guess RA would not stick around, but I cannot picture anything more than that.

I know there are some nuts in regards to true-crime cases, but I don't think there is any danger of mob rule.

And, I seriously doubt he's going to be acquitted anyway. My opinion.

In this case, I’d say a public uproar is as likely for a guilty verdict as a not guilty verdict.

I am thinking it may end up as a hung jury. And Gull will send RA back to solitary confinement in a prison until a new trial.

Yes, I think they have to dine together.At least in small groups. Little clumps of people who naturally form friendships usually happen.

The hard part is they can't talk to the other jurors about the testimony they are listening to every day.
