Does her decision to allow an offer of proof at the trial mean she can change her mind just before the start of trial to allow that whole SODDI defense?

Only if they can present reliable evidence connecting one of their third party options to the actual crime.


Why is an offer of proof necessary? If a party wants to appeal a trial court's exclusion of evidence, the party needs to tell the trial court what the evidence would be if admitted. This serves two purposes. First, it gives the trial court an opportunity to change its ruling. Second, it provides the appellate court with a record it can use to determine whether the exclusion of evidence was proper.
 
I can't understand how the hair found in Abby's hand can be unrelated to the murder. A 13-year old's hand is in constant motion, touching things, etc., and any hair the hand comes in to contact with would quickly fall off. For there to be a hair found on her hand (I assumed her hands were bagged quickly at the scene), it makes sense that it is related to the murder somehow. They were found in an isolated location, so the hair did not come from an innocent bystander--since there were none. JMO But we shall see soon enough.
Abby and Libby were both at the crime scene.. it could have been one of their own hairs. The defense never said it was male.. Also, I have long hair and I lose a lot of hair every day.. my hair is in my husbands truck, on his clothing, on my clothing.. it's just everywhere. I think it's entirely possible that the killer brought a hair on his clothing or one of the girls had a hair on their clothing (either their own or from something like riding in a car where someone else shed hair.. a sister a sisters friend, etc) or even from their own heads that ended up in Abby's hand. Also certain fabrics are WAY better had grabbing hair also and anyone with an animal learns which items those are.. some things like jeans no hair, leggings.. hair all over them just from brushing against the dog or the cat sitting on your lap. Now it's the same with human hair and not to the extent of a dog brushing on your leg, but if you lose hair or sit in a car where someone lost hair, it will stick to your clothing with very little contact. I'd say this is one reason lint rollers exist.

Accused serial killer Rex H. was linked to I believe 2 bodies because they found female hair that belonged to his wife on the victims.. His was wife provably out of the country during both murders so she didn't leave it there herself.

There isn't an opportunity at trial for odin information. It is for an appeal. When Allen is found guilty, this info may (or may not) be used in an appeal.

So if the defence presents admissable evidence of possible third party involvement (I don't believe they have this btw) it will only be legitimate for an appeal?

If I understood it right, yes.
Theoretically, Judge Gull could change her decision after the offers of proof.

Opening statements begin Friday.
No audio, no video, and no live tweets or anything. All electronics are banned from the courtroom.

We'll likely have to wait for sporadic updates from reporters during court breaks, etc.
 
In previous cases, the hotel has reprogrammed TVs, like you can do with Parental Controls----and they will allow sports stations, and a few other options that do NOT have news shows on them. Like Reality TV type channels, OLD MOVIE stations, etc etc

There has to be something for jurors to watch at night. They'd go stir crazy otherwise. But if they can watch wildlife Documentaries, Reality Tv, BaseBall Playoffs, Football, etc, and read books and play board games with each other, it might be a nice little vacation from home life.
I'd have to be sneaking in the smallest smart phone I could manage, in my "prison wallet". :D

Seriously, I really couldn't be cut off from the world like that.

Thank you. No video is most likely for the best. I was hoping for audio though.
 
Judge Gull is certainly not a fan of transparency.
The MS has eloquently, IMO, argued something similar. In their opinion, JG's court seems to be neglecting the obligation a court has towards the public, through talking down at the media and not offering them enough information/tools to do their jobs, which is to keep the public informed. We see this in the repeated motions that have been raised by the media to release information and allow cameras/audio/any kind of visibility.

In my humble opinion JG takes the protection of the accused and jurors seriously, but doesn't have that same regard for the media. Which unfortunately can lead to the media reporting negatively about her decisions/fostering an antagonistic relationship, and most importantly, the spread of misinformation as the few people with press passes will be relying on their memory and hand written notes.

I would personally prefer there to be audio recording allowed. Again, that's not to malign JG in any way, only my personal opinion re: Allan County's relations with the media. (that's not even taking alternative media into account, just good ol' meat and potatoes traditional broadcasters)

I wonder if there is a time limit for opening statements? As strict as JG is with her time management my guess would be yes. JMO
 

WOW! I've never seen anything like this. In my opinion, it makes it seem like everyone is in extreme danger if they are identified or something! I can totally understand the effort to conceal the identity of the jurors, but everyone else? This just feels so.....excessive for what we, the public, know about this crime. It really makes me wonder if this crime is part of some much larger crime, entity, whatever, that we don't know about yet. Remember Doug Carter's word.....tentacles. I feel very unsettled looking at that photo.

I wonder if there's also going to be heavy security at the place where the jury will be housed. I hope wherever they are staying doesn't get leaked.

She has shown she's willing to go late into the evening, though, so it's hard to tell what she'll be like with stuff like that. Why are opening statements not until Friday? I know the jurors are sworn in tomorrow, but are they also spending the day getting settled into their accommodations? Or are there other motions being heard tomorrow? Swearing in doesn't take all day. Just curious.
