Friedman Agnifilo questioned why Mangione is being held in the federal Metropolitan Detention Center in Brooklyn instead of a city jail.

"I thought you people were supposed to be working on it so we had custody," Supreme Court Justice Gregory Carro asked Assistant District Attorneys Christopher Prevost and Zachary Kaplan. "The federal jurisdiction said that we would go first."

Kaplan noted that the defense lawyer agreed to have Mangione held in federal lockup.

"When they’re hanging the death penalty over your head, you have no choice but to consent," Friedman Agnifilo said.

I've wondered about the search of LM's belongings when he was arrested. Pardon my ignorance, but should a search warrant have been obtained before law enforcement went through his belongings or would LM presenting a fraudulent ID have been considered probable cause to allow the search? I may be wrong, but I'd imagine even police in the smallest towns are trained thoroughly on when searches are acceptable and when they're not.

Following the hearing, Mangione—who has pleaded not guilty on all counts—returned to Brooklyn's Metropolitan Detention Center, where he will remain until his as-yet unscheduled trials. His next hearings for the New York charges have been scheduled for Thursday, June 26. He is also scheduled for a hearing in Pennsylvania on Monday, February 24, on weapons charges, but it's unclear if he will attend in person; the federal case against Mangione, which includes claims of stalking and murder, also has a hearing scheduled at New York's U.S. District Court on March 19.

After a jury is seated and the trial begins, I hope that the court will prohibit clothing that demonstrates support for the accused.

usually you cannot wear clothing with printed messages in court IMO but the restrictions are not 100% clear- this is NY civil, not criminal court cited below. (Maybe the judge in this case thought that ignoring the spectator's scarf was less disruptive than removing some one from the court room.)

How is that less disruptive? It's not just New York for which you should wear Conservative clothing to court. It's always been the norm. I sued my roommate in small claims court in San Diego in the early '80's and I knew to wear a Conservative grey suit. My roommate came in a flashy outfit, which didn't help her case. I went up against her brother, who was a lawyer (my lawyer brother advised me) and I still won.

Around 1:40 PM, the Mangione supporters in the public line briefly erupt into cheering for the arrival of Manhione’s defense attorney Karen Friedman Agnifilo. Audio clips of the cheering intermittently loops on reporters’ phones in the press queue.

Looks like there’s both green Super Mario Luigi outfits in the crowd, along with maroon sweater tributes to Mangione and Agnifilo’s matching outfits from the previous court appearance.

I will never understand the mentality of blind devotion and obsession by the fan girl/boy of a Defendant. It has happened since the beginning I guess. Charles Manson, Ted Bundy, Night Stalker, Menedez Brothers, OJ Simpson and on and on. Plus, I'm shocked at how many lawyers of the client they are defending of these alleged murderers end up in personal relationships with them.

What puzzles me most is why LM is pleading Not Guilty? He said in his writings that he was making a stand against Capitalism "someone had to do it" for the greater good of the people. If you are so convicted by your beliefs and principals that you would murder an innocent man to make a point, why not just man up and plead Guilty?? I guess the romanticized Savior Complex verses the cold harsh reality of life in prison changed his belief system??

Funny how that worked. Not.

Since his manifesto made it crystal clear that he allegedly believed he was on a mission to rectify a grievous wrong, that he was the only one willing to do this, then stand behind it. I know he’s saying he’s NG because he believes he was in the right, but if you want to be a martyr for a cause, then accept your penalty for your so-called sacrifice.

IMO, I think all involved on the defense side desire a trial. I believe LM wants his message to be in the media as long as possible.

having a bailiff remove some one could get the audience all up in arms. there is no jury at this point-just the attys and the judge, so maybe the judge just wanted to get on with the agenda. (all me hypothesizing- I have seen people removed from public meetings and while it is supposed to ensure order, sometimes it just gets more spectators upset and the person or persons being escorted out are touched, maybe argue, sit on the floor, need to be dragged out, etc.)

I agree. ETA: But there's something very off about all of this. The victim has been dehumanized, and the murderer glorified, even by his attorney. It's like a fantasy being played out by many, even those who should be held to high standards.

Just saw the headline below and it made me wonder if this is a copycat kind of crime of sorts. It targeted an insurance CEO, just not healthcare. It kind of feels like it might be a copycat crime because people can often get upset with workers comp insurance, feeling like the system is designed in favor of employers over the injured workers. This often leads to difficulties getting claims approved, benefit delays, and they sometimes feel they are being inadequately compensated, often due to aggressive tactics by insurance companies to minimize payouts.
