So potential LWOP for the remaining charges? IMO, murderers deserve the deserve the death penalty, but many don't even get life sentences. I have a former classmate who served 20 years in prison for murder and was paroled, and someone where I worked was sentenced to 35 years for a murder he committed.

At least the backpack evidence is coming in, so a conviction should be fairly easy.

Realistically, they were warned that the federal death penalty would be very challenging to pursue and argue for successfully. I'm not surprised the judge didn't agree with their assertions.

Regardless, Luigi will likely get life in prison.

The DP doesn't surprise me, even though I thought he should have been eligible for it. Someone like LM will probably suffer more being locked in a 10x8 cell for the rest of his life, without all the many financial advantages he has been accustomed to all his life.

Gosh, I do hope he is allowed to partake of the prison gym. You know he loves to work out and stay buff for his selfies.

It will be interesting to see if the NY state judge concurs with the Federal judge on the evidence issues.

The evidentiary ruling is pretty straight forward and what was expected. The inevitable discovery doctrine made it clear.

The stalking/death penalty opinion is more complex. The Judge sort of acknowledges that the result is ridiculous.
The court has to decide if the stalking charges are crimes of violence. The Court begins by saying, "The Court would be remiss to not mention at the outset the apparent absurdity of the inquiry." https://storage.courtlistener.com/recap/gov.uscourts.nysd.640793/gov.uscourts.nysd.640793.103.0.pdf

But that the rules of interpreting this are so convoluted that the Court has to decide they are not. In my opinion, she clearly stating this needs to be over-ruled on appeal and sort of sets out the path on this. Will the DOJ appeal this? They might because it is a serious impediment to enforcing these statutes and so the implications are far beyond this case alone. But they may not bother.
