I really don’t think this was a vacuum though.
I don't think it was a vacuum either, JMO.
A potentially armed and dangerous quadruple murder suspect, likely in the process of destroying evidence.

And people think they should have politely knocked...
Due to the presence of his parents (and possibly his 2 sisters) and that the FBI knew BK regularly ran in the neighborhood, I think LE should have simply picked him up just after a run when he was tired and just before arriving back to his parents home. No need to terrorize his parents and damage their home. The parents did nothing wrong. JMO.
No crate. But it also flies in the face of AT's weird inclusion. So bedroom doors were open. That Murphy didn't enter any of the bloody rooms isn't proof of anything.

JMO
Dog Crate and KG's purse were both found inside of KG's new car according to Mrs. G. It is perplexing. Was KG getting ready to leave? Not sure. JMO.

Steve G just mentioned a kill kit on Banfield.
He's mentioned that before with Nancy Grace awhile back and with I think it was 48 Hours last year. IMO.

LE likely isn’t going to wait for a suspect or POI to potentially destroy more evidence or allow additional time for planning. The potential of a handgun entering the equation likely influenced their decision.

Unless we definitively know the dad was clueless, we really can’t say for sure the parents did nothing wrong.

Hindsight is always 20/20 as well.

Sheath was likely tucked into ankle or belt/waistline if not attached to belt. Me? I’d have one of those horizontal hard sheaths which attach to the rear of a belt with fasteners & hardware or a shoulder type holster for a knife.

Some of my own posts frighten me, as if I’ve given waaaaay too much thought as to how to potentially get away with a crime. 😞
I cannot see ankle, personally. Have you ever carried a kbar at the ankle? They are heavy and misbalanced unless he was wearing mid high to knee high boots, but not with tennis shoes and socks unless he maybe had a special pocket in the lower part of the pants and nope, I just cannot make that work. Not at all without heavy boots, compression socks or an ankle sheath, which he apparently did not have. Tucked into the back of a waistline, yeah a lot of posers do that so possible but totally stupid. People who know how to handle knives don't want to be juggling a sheath on the move, but then here we are.

My favorite is a horizontal back of belt sheath or thigh holster sheath, easy access, no flopping, stays with you, slide it out, cut your rope for camp, slide it back, foldover snap, not one of those around the top of the grip things. ( see how I slide in a non murderous use for a knife:))

Elantras haven't really changed much cosmetically from 2011 to 2018 models.

Whatever that generation ran - the sheet metal most likely never changed. Been that way in the auto industry for decades, in terms of exterior appearance. Trucks & SUVs typically get the biggest makeovers because of the size & all the plastic used on the font ends, which is usually the most notable to an average onlooker. Cars are a bit harder to noticeably change in that manner due to the smaller height from the ground to the hood - smaller envelope in which to package major eye catching changes.

Is Idaho different than other states? Or was the area much "safer"? I don't know anyone who leaves their purse in their car while they are sleeping inside. Not ever.

I don’t disagree about the ankle but that might depend on what attire was being worn - boots (tactical/hunting) or even those ninja tabi split toed things can come half way up the shins these days. Highly unlikely but he did somehow lose track of it, which to me, is just unreal in itself. Yes, but here we are, regardless.

Nicely done with the innocent references. My amateur sleuthing abilities go off when mentioning camping uses on a murder thread though. 🚩🚩😉😜

Yes! I regularly use my Amazon shopping cart as a shopping list / wish list because the actual wish list is awful.

I'll fill it up with things I think I want or multiple versions of 1 thing. Then will typically delete most of it from the cart or use "Save for Later" before I checkout.

I think LE wants to know what was in the car along with the knife so they can try and show BK's state of mind. A black jumpsuit and gloves give context to the knife that a bright orange hunter's vest would not.

MOO
As soon as I saw that I knew it supported your 30 March purchase theory. They served a federal grand jury subpoena on Amazon for order history--Amazon provided them with subscription information and purchase history from 1 January 2022-13 December 2022.

After they received that, they requested a new warrant for the clicks, etc. in those two narrow time frames. He bought something on 30 March and they wanted to know what he'd been looking at and clicking on the 10 days prior.

2011-2018 was over two generations, and there was a change mid 5th generation and mid 6th generation
  • 2019-2020 Hyundai Elantra 6th Gen (AD) Facelift
  • 2017-2018 Hyundai Elantra 6th Gen (AD)
  • 2014-2016 Hyundai Elantra 5th Gen (MD/UD) Facelift
  • 2011-2013 Hyundai Elantra 5th Gen (MD/UD)
In 2014, the fifth generation was given a sportier trim, lights moved around. If you like cars, you could immediately see the difference in the change. It's why originally I thought they were sure about dates because I assumed they could see the trim in an image somewhere.

Yes I agree & is the reason for my post. Sheet metal won’t change until a new generation comes. I see the differences too but it did escape some eyes here who aren’t quite as trained (for lack of better words).

I worked as a designer in the auto industry for 30 years. The facelifts are called midcycle refreshes in many design & manufacturing groups & while the sheet metal isn’t changed, the plastics are (front end - bumper covers, grilles, light arrays; rear end would be anything below the trunk lid cutout which is plastic & also includes all light arrays). Added components like rear spoilers can also enter the refreshes but would require a modified trunk lid with holes - doable because the addition of punching dies for holes can be a minimal cost compared to brand new dies for a redesigned panel (hood, door, quarter panel).

For clarity, I don’t believe LE were ever looking beyond the 5th Gen. I wasn’t implying the 2017 & 18 sheet metal wouldn’t change, FWIW.

@Ghostwheel regardless, we’re on the same pages regarding the sheath & car model years I think. 👍

I assume that AT will now file an appeal regarding the use of IGG? I'm guessing that the Idaho Supreme Court will not overturn the lower court's ruling, but AT may be going through the motions to try to get this to the U.S. Suprene Court.
Not a lawyer but I feel AT can argue to the moon over the use of IGG & it’s likely not going to change much. If the SCOTUS rules in her favor, they potentially will be emptying many prisons & I just don’t see that occurring in this case.

Had some dummy involved in the investigation taken the DNA related information & made something health related concerning BK or a relative public knowledge (like so & so has a tendency for leukemia on the paternal side, etc.) or used a known health condition found via DNA to narrow down a suspect, in other words using health &/or medical info, then the defense might have a leg on which to stand.

The DOJ’s interim FGG policy, which directs any federally funded agency (federal, state & local & in this case the ISP & FBI) was followed, as far as I am able to discern. The interim policy allows investigators to use FGG/IGG databases without 3rd party consent if it’s deemed the 3rd party consent would compromise the investigation & then allows covert means of collection with the prosecutor’s approval (pg. 6).

IMO - Me either although I’m in a different country & it’s appears quite common here for a car to get stolen & it’s then reported that there has been either a purse or wallet that was in the vehicle. Personally, it’s not something I’ve ever done or would do though. MOO

Such an extended interlocutory process on this is unlikely IMO

That stuff will happen post trial, if at all.

I’m actually surprised.

It's been a fair bet since no hearing was scheduled (as far as we knew).

The Judge wasn't going to wait this long merely to schedule a hearing.

So we can definitively put to rest any notion that law enforcement did any sort of reverse engineering with the year of the car.

Those emails show that in late November, the FBI expert told his colleagues they needed to expand the model year from 2011-2016, although he was more comfortable with 2011-2013.

The FBI didn't provide BK's name until December 19, which was over 3 weeks later. They had taken over from Othram on December, 10.

Another conspiracy theory bites the dust.

I hope this stands as yet another example of why you can't build complicated theories of the case based on convoluted interpretations of motions and examination of witnesses on the stand

If AT really had caught the investigator in a lie about the car expert's opinion this would have been apparent in her examination of him. Because she would have put her central allegation to the witness in order to support her Franks. You don't save it up for some other day in a 9D chess fashion.

AT has always known the content of these emails which is why she was so vague in her references. i do worry Franks has become a venue for conspiratorial filings.

IMO

I knew I liked this judge. Sensible. Common sense. moo

In addition, the defense’s assertion that investigators lied or withheld information from a prior judge to obtain search warrants was unfounded and does not support holding a separate hearing to challenge that evidence, 4th District Judge Steven Hippler wrote in his long-awaited court filings.

The orders and reasoning are fantastic and clear. We now know from Franks order that the expanded date range for Elantra from 2011-2013, to 2011-2016 occurred on Nov 26th 2022. At the behest of SA Imel. That puts to bed all those baseless conspiracies that Payne did this on his own after receiving the IGG tip on about Dec 19th. Also put to bed all those accusations and insinuations that DM's description of the defendant in PCA was at odds with her description over her at least x3 interviews. Judge Hipper found the description per PCA completely above board. Good.

I think as a result of the above, BK may have done something IN his bed late yesterday.

For all LE knew, the parents were at risk.

Unfortunately BK was the one deciding to put them in play.
