No death penalty for Luigi Mangione — a federal judge dropped Counts 3 and 4 of the indictment.

So potential LWOP for the remaining charges? IMO, murderers deserve the deserve the death penalty, but many don't even get life sentences. I have a former classmate who served 20 years in prison for murder and was paroled, and someone where I worked was sentenced to 35 years for a murder he committed.

At least the backpack evidence is coming in, so a conviction should be fairly easy.

He's a narcissist so rotting in prison the rest of his life instead will hopefully bring his ego down a few notches (but I doubt it).

theyknow jurys are less likely to convict if the death penalty is involved

Thanks. Personally happy about this. Family members know him and the family

Realistically, they were warned that the federal death penalty would be very challenging to pursue and argue for successfully. I'm not surprised the judge didn't agree with their assertions.

Regardless, Luigi will likely get life in prison.

The DP doesn't surprise me, even though I thought he should have been eligible for it. Someone like LM will probably suffer more being locked in a 10x8 cell for the rest of his life, without all the many financial advantages he has been accustomed to all his life.

Gosh, I do hope he is allowed to partake of the prison gym. You know he loves to work out and stay buff for his selfies. ;)

It will be interesting to see if the NY state judge concurs with the Federal judge on the evidence issues.

The evidentiary ruling is pretty straight forward and what was expected. The inevitable discovery doctrine made it clear.

The stalking/death penalty opinion is more complex. The Judge sort of acknowledges that the result is ridiculous.
The court has to decide if the stalking charges are crimes of violence. The Court begins by saying, "The Court would be remiss to not mention at the outset the apparent absurdity of the inquiry." https://storage.courtlistener.com/recap/gov.uscourts.nysd.640793/gov.uscourts.nysd.640793.103.0.pdf

But that the rules of interpreting this are so convoluted that the Court has to decide they are not. In my opinion, she clearly stating this needs to be over-ruled on appeal and sort of sets out the path on this. Will the DOJ appeal this? They might because it is a serious impediment to enforcing these statutes and so the implications are far beyond this case alone. But they may not bother.

@Uebey

11:33 - Luigi walks out. He's shackled at the hands and waist. The case is officially called and we can hear things.

!!! Judge Carro sets a trial date for June 8 !!!BUT if the federal government appeals in the other case and delays it, the state case will be pushed to September 8.

Judge Carro: "It appears that the federal government has reneged on their agreement to let the state who did most of the work on this case to go first… This case got simpler in that it should be shorter. It’s no longer a terrorism case."

Carro (continued): "With that in mind, I'm going to set an earlier date than the federal government of June 8 for trial. If the federal government appeals Judge Garnett's ruling, then we will start on September 8."

KFA: "We will not be available on June 8."(She rattles off the various deadlines in the state case.)J: "Well, be ready."

LUIGI turns to us as he walks out. He says:"1 + 1 = 2. This is double jeopardy by any common sense."

Accused healthcare CEO killer Luigi Mangione railed about “double jeopardy” in a courtroom outburst Friday after a judge set a June 8 trial date in his headline-grabbing case.

Mangione’s lawyer, Karen Friedman Agnifilo, also claimed in court that they wouldn’t be ready for trial in June, prompting a scathing reply from the judge.

“Be ready,” Carro seethed from the bench.

Thompson’s relatives have asked that the accused killer go on trial in state court first, Assistant District Attorney Joel Seidemann said in court Friday.

The trial(s) when they happen absolutely need a judge that will command their courtroom.
Otherwise, it will be a circus. moo

There is already attempts to misrepresent the public, taint the jury pool. There is absolutely no double jeopardy in play.

Need a strong judge that will command their courtroom. Not appease to the defense.

I get that a defendant has the right to a defense, is considered innocent until proven guilty BARD, but to be clear, there are too many defense attorneys crossing into ......

the judge has to cowtoe to the defence a bit seeing as people are inocent until proven guilty

if he doent thats easy grounds for appeal
