Just went through security and sat down in the courtroom. Kohberger hearing expected to start at 2pmPT. Less crowded today. Only a handful of media.

Bryan Kohberger just walked into courtroom. He is wearing a suit jacket with a green tie. Sitting between his lawyers. Court starting now.

The judge is questioning whether the media has the right to intervene about the camera issue at this point in the Kohberger case.

Attorney representing media coalition is arguing to the judge that the media does have the right to intervene when first amendment and access issues come up.

Attorney representing media coalition says this is an "access" issue -- that people have the right to see what is happening in the Kohberger courtroom. She says people should not have to travel to the courtroom to see what is happening inside.

There is an increasing need for people to see for themselves what is going on inside courtrooms in this country, attorney representing the media coalition at Kohberger hearing says.

Judge is still questioning whether the media has the right to "intervene" in this.

Judge says in the Daybell case the media was characterized as "interested" parties. But he is questioning whether the media can "intervene" in the camera issue at this point in the Kohberger case.

Judge says media cannot be "intervenors" at this point when it comes to question of cameras in Kohberger courtroom. But he says he will still consider the media's argument.

Kohberger defense says they are concerned cameras in the courtroom will turn the case into a spectacle -- and this will turn more into a tv show drama.

Kohberger defense says even though the media here is doing their job, people on social media still take the images and manipulate them.

Kohberger defense says they do not like where the camera is placed in the courtroom. They feel like there is a camera right behind them. If the court doesn't remove the cameras, then defense wants the cameras in a different location.

Kohberger judge brings up an interesting example -- says there are cameras on the House floor on Cspan. Maybe putting a camera at the back of the courtroom out of the way is better, he says.

Kohberger prosecution says media plays an important role in court process. They want to protect vulnerable witnesses/graphic evidence. They say the safest and best way to address concerns is prohibit cameras in courtroom, or to keep cameras out during certain testimony/evidence.

Media coalition lawyer is pushing for "pool" camera policy. One camera in Kohberger courtroom -- and then the video is given out to all media.
That is the way they are doing it now.

Media coalition lawyer tells judge photographers in the courtroom are getting wider shots. They can't control who later zooms in on the photos to show Kohberger.

Kohberger judge says he questions whether cameras in the coutroom is a dignified way to have a trial. He brings up OJ Simpson. "If anyone watched that case, it was a circus," he says.

Kohberger judge says he is asking the media to back off a little bit. He says he questions whether he can really trust the media to do the right thing. He says it's not the camera people, it's where the video goes and how commentators talk about it.

"It's not the same media it is now as it was 10 years ago with social media," Kohberger judge says. He wishes everyone had more respect for what is happening here. Says it's not entertainment, it is a tragic issue.

Media coalition lawyer argues that having cameras in the courtroom is the only way to have a real source of what happened. No cameras makes it easier for bad information to go out. If there is no actual footage of trial, responsible consumers have nowhere to go.

"The answer is more sunshine, not less," attorney representing media coalition at Kohberger hearing told judge.

If you want to avoid spectacle, take away the cameras outside the courtroom, not the camera inside -- media coalition lawyer tells Kohberger judge.

Kohberger judge says he is sending out a message to the media to be respectful, peaceful, and decent.

Kohberger defense is back up. Says they are not trying to throw the media out. They are just talking about the cameras.

1 - Media colation is represented in court today.

2 - Media attorney, Wendy Olson, says the media has the right to intervene when there are access issues. Olson says cameras in the courtroom are a part of access. "It allows broader access for people to see first-hand what's happening in the courtroom.”

3 - Judge John Judge argues with Olson that having cameras in the courtroom may not fall under First Amendment rights. Olson argues back and says media should have broader access in the courtroom because there is a greater need for the public to see what's happening.

4 - Judge Judge recalling ID Supreme Court Case regarding the press' right to intervene. Says it is somewhat limited. Judge doesn't believe the media is an interested party in this case.

5 - Judge Judge denied the motion to intervene. We're now listening to arguments about having cameras in the courtroom. Defense is first.

6 - Defense says they don't want to turn this case into TV drama. They claim photographers in the courtroom are doing well, but editors are tampering with the video. They want cameras out altogether.

7 - Defense says removing cameras would take out sensationalism in the case. They also argued about where the camera is positioned because the "cameras are in direct view of their computer screens.”

8 - Judge suggests installing a camera in the back of the courtroom may please everyone. Defense somewhat agreed. They compared it to older CSPAN coverage.

9 - The State argues they want to protect graphic images and vulnerable witnesses from exposure.

10 - Olson, representing the Media Coalition, argues journalists covering this case are experienced and understand appropriate boundaries.

11 - Olson also says CourtTV has experience working with the courts and appropriately taping the hearings in a fair manner.

12 - Judge Judge mentioned the OJ Simpson trial and called it a "circus," referencing the media coverage.

13 - Judge Judge says he's been very accommodating and questions whether he can trust where the film goes and how it's "manipulated.”

14 - Judge Judge wishes "everybody has a little more respect for what's happening here.”

15 - Olson argues that it's more important today to have cameras in the courtroom to show the judicial process, so there isn't misinformation spread afterward.

16 - Olson argues this is important to document for the community and thousands of people affected by this case.

17 - Olson said, "the public and this community will be best served if cameras in the courtroom."

18 - Defense does concede that the public plays a big role in making sure the attorneys do their jobs well.

19 - Judge Judge said coverage on cases can tilt opinion.

20 - Judge Judge did not make a decision today on cameras in the courtroom. Court has been adjourned.

I really don't expect any new information. Just regurgitated old stuff. "NEW SEASON: The family of murdered student Kaylee Goncalves says they may have uncovered a connection between the suspect, their daughter, and Maddie Mogen. <----- That alone was said by SG a few days following BK's arrest.

It's more an issue of translation, IMO. Detectives are not in the habit of conversing with individuals who provide significant leads to say "That was a great tip. Here's how the information you have provided shapes up." So when SG keeps saying they may have uncovered a connection, what he really means is, "We believe there is a solid connection between Kohberger and some of the victims, but we are discouraged from stating precisely what that is." Same for evidence showing advanced planning. SG isn't pulling this from thin air. The family have uncovered things through grit and determination. They are keen for the world to see who the defendant truly is, and how much pain he has caused.

I am in total agreement with you. The point of my post was that 48 hours is putting out a new episode as if this was new information. SG stated this months ago, soon after BK was arrested.

Fine. IIRC, didn't they actually build a box for the camera in OJ?

This is on point:

Judge Ito effectively agreed with what lawyers for both sides, along with representatives of various news groups and the American Civil Liberties Union, told him today: that whatever mistaken reporting on the case had taken place had happened outside the courtroom, not inside; that rather than encourage irresponsible reporting, cameras could both check and correct it, and that in a case crucial to public faith in courts, television was essential.

So they let cameras in the courtroom to argue about cameras in the courtroom :D Thank you for this! I think (moo) he let us know in his very first hearing the disdain he had for the press when (this was my take only) he threatened attys for AP coalition with sanctions for using the words "irreparable harm" in a 1A brief. Words that would appear AFAIK in just about every single 1A brief.

I'm only at the start of this but the Judge says the press and public have access to the courtroom (without cameras) but is this really an accurate statement? Wasn't it said on multiple occasions that his courtroom was the size of a bathroom? I recall Brian Entin remarking about the small size and lack of seating.
