Thank you. I would have searched endlessly for that one little sentence. I guess "tried" tells the story.
I imagine those parents were pretty upset.

Replying to my own question because I can't find the comment someone just posted with a link to the defense motion.

I read the motion carefully and nowhere does it say that the prosecution plans to have an expert witness who will try to explain to the jury what is being said on the recording Libby made.

Instead, the defense states that they "believe" the prosecution is going to do so.

That's not proof or fact, its the usual defense team speculating, then pushing it out to the public rumor mill as fact. These kind of tactics by defense are typical disinformation, as usual. JMO

ETA: One would think that a defense team so concerned about speculation by the judge and prosecution would be careful to avoid doing the same. Throwing stones in glass houses, etc.

The family may have reserved seating but I don't think anyone can leave until the judge calls a recess. No drink, no bathroom runs, no coffee... Unless we find out otherwise no one can even leave until she calls a recess.


I wonder what happens if someone try to leave. Are they physically restrained? Sometimes bathroom emergencies happen...especially for women, in my opinion!

Does anyone know where to find a pic of the crime scene? I've looked but can't find it. I think a photo of the topography of the area would clear up some confusion about why they weren't found that night.

Not that I’m aware of. LE have referred to the general area where the bodies were found but not the precise location. The problem with the maps is that the land all appears flat whereas in reality it’s not. In various videos the steep slopes downward toward the creek are very noticeable.

At some point in time I’m also anxiously awaiting videos to be released to better understand the area and to clear up the confusion.

Isn't filing a motion the correct way to find out for sure and get it on the record?
 
He has a small family and apparently spent most of his off-time with his wife. He may not have wanted his daughter to suffer all the negative publicity. Can't blame him for that.

That could be a possibility but to a jury it also might appear only a small handful of people want to be associated with supporting him and also why his daughter is absent from that group.
 
We should start getting updates from court in an hour or two.
I went back and checked what happened on Friday. We did get some information right about now from reporter Kit Hanley, courtesy of another reporter in the courtroom (I imagine he left early for the noon broadcast).

The rest of the updates came around 1pm local.
 
Since we haven't hear the evidence we don't know yet. The last few testimonies gave some insight but not alot yet.
Also im wondering if they got some forensic evidence from his car. Muddy boots put in the trunk to keep from getting the interior of his car muddy. Could possibly have DNA or Mud/dirt traces that match the crime scene that he can't explain because didnt he say he's never been to that spot?

Also if it was muddy they could have shoeprints that match his shoes etc.
 
Do not suggest a member of the family is the culprit. They are not on trial. It is cruel to post such a thing. Just because you post it as a question does not mean it's OK to post. There is only one suspect and he is on trial.

Thanks. I went looking for Tobin information and found this article. It included discussion I had not seen regarding her decision on allowing the IPAS lawsuit. Her ruling came as no surprise.

"Another motion by the prosecution asked for the defense to not be allowed to enter into evidence a past Department of Corrections lawsuit that the defense called the “seed” of the current DOC policy on how to treat inmates with “serious mental illness.” The lawsuit was prior to Allen’s 2022 arrest and stay in the Department of Corrections under a safekeeping order. Judge Gull ruled that the defense can use the DOC policy, but not the lawsuit saying, “You don’t need the history of the policy. You have the policy.”"
The ruling makes perfect sense to me. It was before RA was incarcerated in IDOC. jmo

I would hope that a family's presence or absence would not factor in to a jury's deliberating.
