If it’s a hung jury, the state’s attorney has to decide to retry or not, and I think that defense could ask for bail or pretrial detention conditions- if they don’t decide for a retrial then he’s free - what I don’t know is if they can retry him later or if they have to decide that they are or they aren’t- within a window of time- that would require a lawyer to explain- IANAL
This trial has had a huge price tag for a small, rural county. I fear they won’t have the budget for another try.

“It’s going to be all right,” Allen tells his wife.

He tells her that he “can’t believe” she thinks he committed the murders.

“You know me. You know this isn’t something I could do,” Allen says. “I’m not going to sit here and convince you. I know you know I didn’t do this.”

Kathy Allen asks her husband how the bullet from his gun ended up at the crime scene, adding, “They are going to come after you and I don’t know how to answer that.”


Thank you for this. The fact the jury asked to review this interview has me thinking they are being very serious about the facts. Has me feeling more towards a guilty verdict now. They want to be certain before entering a guilty plea. That interview would be powerful to me.

I can only hope.

That makes me think they may be going for hung jury. The people who saw the BG video have reported BG was nowhere near the kids. The interrogation by Holeman would make me acquit when coupled with how they tossed him into Westville and knowing what they did to him there. Mooo.
 
On some sequestered trials, the jury is sent home during deliberations if it's taking long. I don't see that happening here but rules vary quite a bit. MOO
I would never want to send this jury home, or anywhere where they might be subject to the spectacle or pressures of the crazies outside waiting for a verdict.
i truly hope they remain blissfully unaware how nuts it really is as they carry out this most solemn duty on behalf of our society.

Hoping for an untainted jury, and also hoping for their safety and sanity as they negotiate the days ahead.
 
Good theory, but it seems like it would be a lot more resource effective to return RA to the courthouse than wait until Monday, paying for two more nights of hotels for this jury.

Maybe it was a pre-pay through 11/15? Just guessing. IMO, the jurors are stuck on a couple of key points.... again, guessing. I think it will all be over mid afternoon Monday. JMO.

Oh, and I think it will be a hung jury>>??? ;)
 
I really hope at least a few jurors took copious notes of every single timeframe/timestamp/timeline testified to. I hope they are cross referencing it all. Especially Cecil's findings, Eldredge's findings, and that health app data.

I hope so too, because you’ll almost never get a tighter timeline with this many witnesses, the killer on video at the time of the abductions, the car on the HH store camera… and RA’s testimony about where he was when…
