Tuesday, October 15th:
*Jury Selection continues (Day 2) (@ 9am ET) – IN – Abigail Joyce Williams (13) & Liberty Rose Lynn German (14) (Missing Feb. 13, 2017, found killed Feb. 14, 2017, after walking on a local hiking trail & were discovered around noon about 50 feet from the north bank of Deer Creek which is about 0.5 miles from the Monon High Bridge Trail, Delphi) – *Richard “Ricky/Rick” Matthew Allen (44 @ time of crime/50/now 52) arrested & booked (10/26/22) into the Carroll County Jail & charged & arraigned (10/28/22) with 2 counts of murder while committing or attempting to commit kidnapping of both victims. Plead not guilty. Held without bond.
Amended charges (1/18/24/granted 3/18/24): 2 counts of felony murder (knowingly & intentionally), 2 counts of murder (while committing or attempting to commit kidnapping of both victims). Transferred to White County jail from Carroll County for security reasons. And was transferred (11/2/22) to IN. DOC at Westville Correctional Facility at a more secure facility. Was awaiting transfer to Westville Correctional Facility but Judge Gull denied move (6/15/23). She plans to take the arguments under advisement & will make a ruling on whether or not he will be moved out of Westville at a later date. Judge Gull denied move (7/5/23). On 12/6/23 Allen was transferred from Westville to Wabash Valley Correctional Facility (long term segregation). Allen was booked (5/6/24) into the Allen County Jail [for hearing on 5/7/24]. Allen back (5/7/24) to Wabash Valley Correctional Facility. Judge Gull granted transfer of custody to the Carroll County Sheriff [instead of IDOC] but will be held in Cass County jail until trial [8/1/24]. Carroll County
Trial began with jury selection on 10/14/24 (thru 10/16) & Trial reset to begin on 10/18/24. Jury will be sequestered.
Mondays thru Saturdays from 9am to 6pm. 12 jurors & 4 alternates.
Allen County Judge Frances C. Gull presiding / Carroll County Prosecutor Nicholas McLeland & Special Prosecutor James David Luttrull, Jr.
Andrew Baldwin & Bradley Rozzi are Allen’s public appointed attorneys & added Jennifer Auger [addressing the circumstances surrounding digital forensics].
Jury will be chosen from among 600 people from Fort Wayne, Allen County [will be transported to Delphi for trial]. Special judge Frances Gull expects jury selection to take approximately three days [10/14 thru 10/16]. She said the jury would then be sworn in on the fourth day (10/17/24) with opening statements beginning by Day 5, 10/18/24. That means the jury could start hearing testimony on 10/19/24. After jury selection, the actual trial phase of the proceedings will take place at the Carroll County Courthouse in Delphi. Gull confirmed Allen’s trial will take place six days a week — Monday through Saturday — if there are no religious objections from any of the jurors.

10/14/24 Jury Selection Day 1: Around 300 summons were sent to prospective jurors in Allen County to start the process of jury selection. 12 jurors & 4 alternates will be chosen starting Monday to be sequestered for up to a month. Today through Wednesday, 10/16-Jury Selection; Thursday, 10/17 Jury sworn in & expected to be a day of pending motions; and Friday, 10/18/24-Trial begins. By 11am 6 potential jurors were selected. As of 12:45pm 10 potential jurors have been selected [6 women & 4 men]. At about 3pm 11 potential jurors selected [7 women & 4 men]. About 4:30pm all 12 potential jurors are now selected [7 women & 5 men] & 1 alternate. At about 4:45pm 1 previously selected juror had an issue [now 7 women & 4 men]. At about 5pm 14 jurors total [8 women & 6 men].
The State plans to call around 50 witnesses & defense said they will call around 120.

One Hundred and Twenty???? No way. Who could they possibly interview that would add up to 120?

They barely had enough money for 3 to 5 expert witnesses. He does not have a large contingent of family and local friends supporting him, as far as I can tell.

WHO can they be counting in? They only asked for 4 or 5 transport requests. Where are all of these alleged witnesses coming from?

I think they may be counting ALL the SODDI witnesses? The D can stop the trial (jury must leave the courtroom) and do an offer proof...for the record, for appeals. Is that why there's 120 witnesses listed?

The MS said it was not too uncommon to have a very long list of potential D Witnesses. Think of it as a pool, and then they will need to select the ones they actually need during the trial.

MOO: they are either doing it to "confuse" the P (which I consider bad gamesmanship, since nothing should be a surprise during trial) or they will indeed be hoping to convince the Judge to allow them a bunch, and if not, they will move to the next group, and if not, they will move again etc etc etc.

Which should have all been settled in the pretrial hearings but oh well.

This Defense has been pulling stunts like this during the entire case IMO. I didn't expect the trial to be any different.

He was on the bridge moments before the girls arrived, and a witness could place him there. He admits he was out there during that time frame dressed nearly identically to the killer. He also has no alibi.

The defense can lie, manipulate and twist facts until the cows come home it’s still not going to work.

I'm interested in the analysis of the unfired bullet. Sure, the extraction/ejection marks. But also, the manufacturer of that bullet found at the scene, whether that bullet matches those retrieved from RA's home, whether there's evidence the bullet came from a box of ammo. at RA's home, maybe even where that ammo was purchased.

And, I'm also interested in boots/footwear. I've always wondered if there were footprints at the scene, do they match RA's footwear as to print, and size?

Lastly, for now...those things LE has held from public discourse...that only the killer would know...that RA shared via admission. Yeah, I'm really interested in what those things are.

it’s no wonder the prosecution wanted the Geofence data excluded from evidence if RA is nowhere to be found on it.

Going to be a very tough case for the prosecution in my opinion.
The man confessed over 61 times with details and made dozens of incriminating statements. He also, very quickly after the murders, put himself at the crime scene, at the the time, wearing the exact clothes BG was wearing. Not looking so tough to me because there's even more. When the jury hears RA over and over, in his own words, talk and describe what he did, then see in his own handwriting, in his own words admitting he killed Abby and Libby that day (letters to the warden)...why shouldn't they believe him?

I do think him admitting that it was his work issued box cutter that he used to inflict the girls' fatal injuries is one.

The Unified Command Center believed this was a sexually motivated crime from the beginning. That can easily be concluded by the fact that Libby was left completely nude.

The state in the pre trial hearings basically stated in their cross of Perlmutter that RA confessed that his intention was to sexually assault but he ended up killing Libby and Abby before he got the chance.

It's not a motive chosen by the P, it's what RA said his intentions were. ISP Harshman touch upon that fact in his testimony at the 3-day hearings, RA talked about his motive. NMcL has just confirmed it during voir dire. MO
