I don't know if there was a correct way for the judge to remove RA's attys of choice.
There is a procedurally correct way, but I believe Judge Gull was trying to extend a professional courtesy to R&B. Big mistake on her part IMO.

RA's 6th amendment right guarantees that RA is afforded access to an attorney to represent him, however it does NOT provide him the right to an attorney of his own choosing.

The issue I saw in the SCOIN hearings was that R&B had been emotionally and physically involved in the case for some time and RA wanted them to continue on as his legal counsel over Judge Gull's concerns of their Professional Misconduct.

“They say Allen “… ‘confessed’ to ‘molesting (those) two young girls and shooting them in the back.’ On another occasion, (Allen) professed his sorrow for molesting Abby, Libby, and others which he specifically named … These facts are known to be falsities, none of which are supported by the autopsy findings by Dr. Roland Kohr as to the cause of death of the girls and unsupported by the absence of any evidence that either one of the girls were sexually assaulted near or before the time of their deaths.”


Here is the memorandum is support of the motion to suppress to exclude confessions.
Page 10 reveals who he confessed the shooting and the molestation to.

Page 7 answers my question regarding RA's sudden interest in religion/confessions. The companions were communicating with him about his case and praying with him. Companions were not allowed to converse with him nor were they allowed to spread the word to other inmates.

"The inmate companions then spread the "good word" of Allen's "confessions" to inmates in general population at Westville, prompting these inmates to then share the information with their respective family members in public."

  • In the U.S. legal system, sua sponte generally refers to a decision made, or action taken, by a judge of his own accord, with no motion or request having been made by any party to the legal action.
Rozzi stated in his refusal to being DQ'd in October, the Defense had no prior notice, no official hearings on the matter in which they could respond or defend their actions.

You quoted me and replied there was a procedurally correct way to remove the attys and I asked you what would that be. I have no legal background; I don't understand how your reply answers my question.
 
Just to be clear, Monday, Tuesday, Wednesday is Jury Selection. This is happening in Fort Wayne. These proceedings are closed to the public and families. Media are permitted access though correct?

The Trial starts on Friday in Delphi. The Jury will be sequestered. The trial runs 6 days per week for 4 weeks.

Once the trial begins, Friday, the trial is open to the public and families.

No live streaming, no real time tweeting, no digital devices are permitted in the courtroom. Reporters are going to have to go “old school” and take notes in order to provide coverage of the trial.

So we won’t hear much probably until end of day.

With limited seating for both the media and the public inside the courtroom, people are camped out in front of the Allen County Courthouse here at 4 a.m.

TODAY: day one of jury selection in Allen County in the case against accused Delphi killer, Richard Allen.In total, 300 potential jurors will be questioned, with the goal of filling the 12-person jury box, plus 4 alternates.The trial is expected to begin Thurs. in Delphi.

Why, why, why does the media always show photos of victims and victimizers side by side? RA does not deserve the prestige, and AW and LG deserve better.

They were beautiful, young girls with full lives ahead of them and shouldn't be reduced to how their lives ended.

But RA? That's all he should be remembered for, how their lives ended.

Yes, that’s his fantasy portion of the crime.

Richard Allen places himself consistently as the perp and the girls dead in all his confessions.

A gun was integral to his controlling the girls clearly his imaginations leading up to this involved the possibility of shooting a girl in the back under some circumstance.

Richard Allen wouldn’t take his gun, rack it, then keep the gun if wasn’t an important accessory.

His replaying his fantasies and/or the actuals out loud is to indulge himself in the crime recreating it variously for his own pleasure with himself always the perp in the end.

The defense says RA is sane so all his talking about murdered minor girls and imaginative ways and motivation for killing them is just who Richard Allen is; a person with perversions that would be considered deviant by society but his defense says is sane for him.

I absolutely agree with this.

In the back of my mind, I also can't 100% discount the possibility that the gun portion of one of the confessions was a case of "telephone" game" by the person who heard. For example, if he said "I pushed the gun into one girl's back" (to control her) but what the hearer later told people was "I shot one girl in the back" out of simple mishearing or just wrong assumptions.
