So I wonder who is it that has sufficient life’s experiences to permit making a judgement as to the mental state of Defendant Allen? The D certainly do not have expertise in the field of mental health either, and weren’t interested in dealing with or even getting an assessment of their client’s “mental breakdown” at the time. This motion reeks of last minute desperation IMO. Much like the results of the SW, the testimony of “guards, inmates and prison employees” must be extremely incriminating. JMO

“Allen's attorneys argued that the statements were part of a mental breakdown Allen suffered from the isolation and harsh prison conditions.

In Friday's motion, Allen's attorneys argue the guards, inmates and prison employees "do not have sufficient life experiences that would permit making a judgment as to the mental state of Defendant Allen." The motion argues their testimony violates trial court rules for lay witnesses.

The testimony of guards, inmates and prison employees also violates a different trial court rule for expert witnesses because they do not have expertise in mental health, the motion argues.“

These people will not be asked to analyze anything. They will simply be asked what they observed.
You are right that for all the defense team’s jumping up and down about RA’s mental health, they have steadfastly avoided having him evaluated, or suggesting he was incompetent to stand trial. That’s very odd I think.

Opinion

There is a procedurally correct way, but I believe Judge Gull was trying to extend a professional courtesy to R&B. Big mistake on her part IMO.

RA's 6th amendment right guarantees that RA is afforded access to an attorney to represent him, however it does NOT provide him the right to an attorney of his own choosing.

The issue I saw in the SCOIN hearings was that R&B had been emotionally and physically involved in the case for some time and RA wanted them to continue on as his legal counsel over Judge Gull's concerns of their Professional Misconduct.

MOO

Worse decision RA ever made after deciding to head out and murder people that day.

Just for the record. I haven't seen much info on Ra's stint in Wabash Valley. The testimony about his confessions triggered my memory about something I read and couldn't find regarding the meds he was receiving there.

This is the affidavit submitted by a S&L investigator:
16) Mr. Allen stated that since arriving at Wabash Valley Correctional Facility, he had been kept in solitary confinement, had not had any recreational time, and had not been allowed outside, and that he had no window. Although he had been there nearly two weeks, he believed he had taken one, perhaps two showers. He appeared disoriented to date or time. Prison officials confirmed that Mr. Allen had not been taken outside for recreational time, claiming it was a safety issue for “suicide watch.”

17) Mr. Allen expressed concern that he was receiving medications and that he was unsure what he was being given or why, as he had not recently seen a physician. He also stated that whatever medication he receives, he does not always get the same type or number or size or color of pills.
He had better get used to the fact that his life moving forward is going to be miserable and unhappy. But at least he will have a life, unlike Abby and Libby, whose lives he cut short, and in a horrible way. JMO.

Why, why, why does the media always show photos of victims and victimizers side by side? RA does not deserve the prestige, and AW and LG deserve better.

They were beautiful, young girls with full lives ahead of them and shouldn't be reduced to how their lives ended.

But RA? That's all he should be remembered for, how their lives ended.

My sentiments too. Imo, killers like the fact that they are forever associated with their victims. Not saying this about RA, as he's not been convicted, but its my opinion about those that have been convicted.

The line to watch the first day of jury selection of the #Delphi murders trial started forming outside the Allen County courthouse hours ago in a cold rain. Courthouse doors open at 8. Jury selection begins at 9. #wthr

2799 days after Abby Williams & Libby German were found murdered in #Delphi, the trial for Richard Allen is set to begin. I am in Ft Wayne this morning for #13News coverage of the #Delphi murders trial. Today is Day 1 of jury selection. #WTHR will be at the trial every day.

I wonder if this is a recent mugshot of RA? He looks soooo different here, younger.

RA has been like that to me in all of his mug photos, almost chameleon like. JMO

It upsets me too Megs. They shouldn't be place side by side to the Defendant accused of their gruesome murder. IMO

It's a day many in Indiana have been waiting for ever since Valentine's Day 2017.

Jury selection begins today for Richard Allen's murder trial.

He's accused of killing Abby Williams and Libby German in Delphi.

Catch up on the case here

It was in the motion to exclude confessions.

Here is the article you can find the motion.

“They say Allen “… ‘confessed’ to ‘molesting (those) two young girls and shooting them in the back.’ On another occasion, (Allen) professed his sorrow for molesting Abby, Libby, and others which he specifically named … These facts are known to be falsities, none of which are supported by the autopsy findings by Dr. Roland Kohr as to the cause of death of the girls and unsupported by the absence of any evidence that either one of the girls were sexually assaulted near or before the time of their deaths.”

The theory that the girls were molested may not be supported by autopsy findings, however, because the girls were found unclothed, except Abby who had been redressed, can there really be any doubt about them being molested by RA? JMO

New mugshot, shaved head. The opposite of poofy hair. Obvious much?

Looking back at the OBG and YBG sketches, today is the first time that I see the "poofy hair" in OBG. It's his cap but with his face down turned (I think he took pains to obscure his face as much as possible), his cap begins to look like a hairline, creating the illusion of abundant poofy hair. And abundant poofy hair connotes youth. Sketch makes sense. Both sketches.

Much maligned, the witnesses did an extraordinary job articulating what they remembered, and Libby too -- captured her abductor, his likeness, his voice, the weapon, the command and the exact point of contact.

Only one man was on the bridge.

JMO

Reporter on the scene at the courthouse in Fort Wayne this morning. They also have two reporters in the courtroom this morning.

Good background information -
Today through Wednesday - Jury Selection;
Thursday - Expected to be a day of Motions; and
Friday - Trial begins
